SUBJECT : CSW REPORT ON THE SUMMARY ADMINISTRATIVE

CONFISCATION PROCEEDINGS ON THE APPREHENDED 57
PIECES/421.33 BD.FT OF ANTIPOLO LUMBER LOCATED AT
PUROK-4, IYAO, BRGY. ANTICALA, BUTUAN CITY.

This is to acknowledge receipt of the memorandum dated April 28, 2023 of

CENRO Nasipit relative to the above-cited subject duly received by this office on May
24, 2023.

Please be informed that per review of the said CSW on the matter of the
resolution for the apprehended abandoned 57 pieces/ 421.33 bd.ft of Antipolo lumber,
this office observes substantial non-compliance with our policy , to wit:

1. There is no attached service of Notice of Apprehension/ proof of posting of

Notice of Apprehension considering that the 57 pieces of Antipolo were
abandoned.

Item no. 2 of Section 8 of DENR Administrative Order expressly provides that In

lieu of service of the APPREHENSION RECEIPT, a notice of the apprehension
shall be left by the apprehending officer on-site, posted or tacked into the nearest
tree, wall or other similar permanent structure.

The above-cited provision of our policy simply connotes that when the subject
apprehended forest products are abandoned a notice of apprehension shall be
left by the apprehending officer on site. Our policy uses the word shall means it
is obligatory to be complied with.

Be informed also that there was a memorandum dated January 16, 2023 issued
by the former PENR Officer, Achilles Anthony C. Ebron and still bears effect for
there is no new memorandum issued by the new OIC PENR Officer, Joseph Leo
E. Oconer, superseding the same. The said memorandum directed to geo-tag
the posting of Notice of apprehension on the abandoned forest products.

Anent to these, you are directed to attach the proof of posting of Notice of
apprehension in the case folder and re-submit same for subsequent
endorsement to the Regional office.
