Primary Steel:
All primary steel members will be pre-fabricated and supplied with Paint approved by Client. Sand Blasting
&Painting (1 Coat RED OXIDE & 2 final Coat OF SYNTHETIC ENAMEL PAINT) are INCLUDED. Grade of Steel
shall be Grade 50 confirming to ASTM A572 or equivalent & Bolt connections as per Class 8.8 & ASTM-
A325 HS Bolts.

Secondary Steel:
Secondary steel roof purlins and girt shall be made of cold-formed galvanized Zinc Coating of 120 gsm
sections.
All other secondary steel members like base angles, gable angles, flange stays and other small
miscellaneous items shall be supplied.
Grade of Steel shall be IS2062 E 350 & Bolt connections as per ASTM A 307 Class 8.8 Machine Bolts.

Sheeting & Fastener: Roof Sheet single skin PPGL sheet of 0.5 mm TCT JSW/ AMNS Profile. Fasteners Self
drilling screws HP make, Hex Flange Washer Head, XYLAN Coated, and AS3566 Class 3,1000hrs SST with
EPDM washers.

SECTION 5: DELIVERY DURATION

1) We require a period 4-6 Weeks for the readiness of Items Ex-Factory after receiving the following.
a) Signed contract
b) Down payment
c) Approved drawing duly signed, which will be submitted for approval within 1 week of item a & b
Whichever occurs later?
2) The total work mentioned in our scope will be completed within 90 working days post approval of GA
drawing by client.

SECTION 6: CHANGES / REVISIONS / CLAIMS/ INSPECTIONS


TRIUMPH TECHNOCRAT has the right to claim a variation on the price, time of delivery due to any change in
the “scope of works” as reflected in the contract. However changes must not hold settlement of any claims
raised for the executed works, as per the contract.

It is the responsibility of the customer or his representative to check the materials before signing on the
material dispatch note of TRIUMPH TECHNOCRAT. Claims of shortages shall only be accepted by TRIUMPH
TECHNOCRAT if received in writing within 7days of the date of acceptance. After receipt of such claims
TRIUMPH TECHNOCRAT shall verify the bills of Materials & Shipping List, if found to be correct,
replacement material shall be supplied only after receiving customers written confirmation for the
additional ex-works costs and delivery costs for such replacement material.
Inspection shall be carried out by your Inspecting Officer at our works on your cost before the material is
Dispatched to you. Such inspection & acceptance of material will be final & binding on both the parties. In
the event that the customer or his representative fails to conduct inspections at our works, the goods shall
be considered “Released by Concession”.
SECTION 7: EXCLUSIONS

1) Fabrication, painting or Erection of materials at site


2) Any Steel Element/ sheeting for High structure
3) Setting of Anchor-Bolts: We only check dimensional accuracy of Anchor-Bolts
4) Cranes Girder, Crane Rails and any items related to Cranes System.
5) Firefighting and detection works.
6) Drainage & sanitary works
7) Any kind of civil or flooring work at site.
8) Any miscellaneous item except as specified in this proposal
9) TRIUMPH TECHNOCRAT has rights to take back residual scraps, templates after handing over site
10) Any other item/ work which is not included in this proposal

SECTION 9: TRANSPORTATION

Price is delivered to your job site. You shall also have to bear Entry Tax/ Octroi or local tax if any,
Transit Insurance, Permits and unloading Charges at Job site.
Note: However Octroi /LBT/ entry tax, if any is to be paid by client.

SECTION 10: ERECTION SUPERVISION


We will depute our Erection Engineer for Supervision of Erection at your site.
Our Erection contractor will arrange for Team of Erectors, Crane & other tools & Tackles. Accommodation
and Electricity at work site to be provided by client.

SECTION 12: TERMS & CONDITIONS OF SALE

1.0 DESIGN & DRAWINGS

1.0.1 All buildings shall be designed as per ISC 800 Code standard specifications. TRIUMPH TECHNOCRAT
Standard building design is based on the following, unless otherwise noted:

1. Wind applicable load as per IS-800 Rev 02


2. AISI Cold Formed Steel Design Manual.
3. AWS D1.1 Structural Welding Code.
4. IS code Manual for Fabrication Tolerances?
5. One set of erection drawings for Steel, cladding & frame openings shall be provided.

1.0.2 TRIUMPH TECHNOCRAT shall prepare the approval drawings to ensure that the interpretation of
TRIUMPH TECHNOCRAT of all the customer’s requirements is accurate. TRIUMPH TECHNOCRAT
shall also provide the structural design calculations, if required by the customer. Standard
Structural design calculations include:
a) Material specifications & design assumptions.
b) Design of the primary & secondary structural framing.
c) Wind bracing design.
d) Column reactions.
1.0.3 Two (2) sets of drawings are provided to the customer of which one set must be signed by the
customer and returned to TRIUMPH TECHNOCRAT.
1.0.4 The information presented in the approval drawings is preliminary in nature and is not to be used
for the purpose of setting anchor bolts, design of foundations and other construction activities.
1.0.5 The approval of these drawings shall be accepted by TRIUMPH TECHNOCRAT only in the form of
the customer’s (or his authorized representative’s) signature within the “Approval” stamp placed
by TRIUMPH TECHNOCRAT on its approval drawings. Approval by any other means shall not be
accepted.
1.0.6 Signed approval drawings shall be final & binding.
1.0.7 Jobs that have been “Out for Approval” for more than 60 days will be subject to the pricing
schedule that is in effect at the time the approval drawings are returned to TRIUMPH
TECHNOCRAT. TRIUMPH TECHNOCRAT reserves the right to cancel orders that have been “Out for
Approval” for more than 90 days. In such cases, the customer shall be responsible for cancellation
and engineering costs.

1.0.8 Comments on returned approval drawings, which change the previously agreed upon scope of
work, must be in RED INK and covered by a change order that is duly signed and accepted by the
customer.
1.0.9 Approval drawings for standard buildings are normally submitted within 4-5 days. More complex
buildings require longer submittal time for approval drawings.

2.0 MATERIAL SPECIFICATIONS

2.0.1 TRIUMPH TECHNOCRAT reserves the right to modify the design of its standard buildings/substitute
material equal or better than original specified, as part of continues development process of our
products.

3.0 CHANGES IN ORDER / JOB ON HOLD / CLAIMS/ INSPECTION / CANCELLATION OF ORDER

3.1 Changes in Order:

3.1.1 Changes in the requirements, after a contract is signed and accepted, require the client to sign a
change order letter, prepared by TRIUMPH TECHNOCRAT, which describes the changes and the
impact it may have on price / delivery. No further action will be taken by TRIUMPH TECHNOCRAT
until a change order has been signed as accepted by the customer.

3.1.2 The price of fabricated components, made obsolete due to a change order that is initiated after
the start of fabrication, will be charged to the customer’s account.

3.2 Job on Hold:


3.2.1 All costs incurred when a job is placed “On Hold” by the customer, after the start of
manufacturing, will be charged to the customer’s account.

3.2.2 A job that is not released for production within 60 days from the date of its entry in sales register,
for whatever reason (including lack of technical clarification), will be put “On Hold”. TRIUMPH
TECHNOCRAT reserves the right to re-price such a job according to the price rates that are valid at
the time of release from its “On Hold” status.

3.3 Claims:
3.3.1 It is the responsibility of the customer or his representative to check the materials before signing
and dating acceptance on Delivery Challan / Material Dispatch Note TRIUMPH TECHNOCRAT
3.3.2 Claims of shortages shall only be accepted by: TRIUMPH TECHNOCRAT if received in writing within
seven (7) days of the date of the acceptance signature.
3.3.3 If, after receipt of such claims, TRIUMPH TECHNOCRAT‘S Bills of Materials and Shipping Lists are
found to be correct, replacement material shall be supplied only after receipt of the customer’s (or
his representative’s) written acceptance of the additional ex-works costs and delivery costs for
such replacement material.
3.3.4 TRIUMPH TECHNOCRAT shall not accept any consequential claims or liabilities, alleged to arise
from losses or shortages.

3.4 Inspections & Field Modifications:


3.4.1 TRIUMPH TECHNOCRAT has the quality control procedures that are followed during the production
and shipment of its products.

3.4.2 Inspection shall be carried out by your Inspecting Officer at our works on your cost before the
material is dispatched to you. Such inspection & acceptance of material will be final & binding on

Both the parties. In the event that the customer or his representative fails to conduct inspections at our
works, the goods shall be considered “Released by Concession”.

3.5 Cancellation of Order:

3.5.1 In the event a signed contract is cancelled by a customer, the higher of the following cancellation
charges will apply:
 15% of the total contract amount plus applicable taxes.
 All actual charges incurred by TRIUMPH TECHNOCRAT (and its subcontractors / suppliers) up
to the time of receipt of the notice of cancellation plus applicable taxes.

3.5.2 Cancellation charges are due immediately upon the receipt of the customer’s notice of
cancellation by TRIUMPH TECHNOCRAT.
4.0 MATERIAL DISPATCH SCHEDULE / POST ORDER MANAGEMENT

4.1 Material Dispatch Schedule:


TRIUMPH TECHNOCRAT requires a period of 6-8 Week for the readiness of Items Ex-Factory from
the date of receipt of the Approved drawings

4.1.1 The delivery time starts from the date of final approved drawings less one week (time required to
submit GA drawings). Client is expected to approve & return the GA Drawings, within agreed
stipulated time frame, any delays in this shall be resulting in the extension of delivery schedule.
4.1.2 Dispatch of Anchor Bolts will be within 7-8 days from the receipt of approved drawings/payments
whichever is later
4.1.3 Client may request changes to the Approval Drawings, this will result in overall schedule change
agreed at the time of order.

4.2 Post Order Management:

4.2.1 After the order is confirmed the agreement is signed/advance received the order is handed over
to TRIUMPH TECHNOCRAT Head office, there after all the coordination with regards to submission
of drawings/approval of drawings/production/payments/dispatch/installation etc. will be handled
by POM Department.
4.2.2 POM Department needs finance clearances at all stages to process the order, any deviations on
payment terms may result a deviation in commitments given at the time of order.
4.2.3 After successful completion of building TRIUMPH TECHNOCRAT submits the completion
certificate, if client fails to issue same and then he start to use the building. He will do same on
own risk, all warranties and stability certificate will be invalid.

5.0 PARTIAL SHIPMENTS / PERMITS & FEES / OFFLOADING AT SITE

5.1 Partial Shipments:


5.1.1 On large jobs, it is a standard practice of TRIUMPH TECHNOCRAT to make partial shipments.
5.1.2 When partial shipments are requested and accepted by TRIUMPH TECHNOCRAT, each shipment
will be assigned a prorated value of the dispatched materials that is claimed according to the
accepted terms of payment covering the total job value.

5.2 Permits and Fees:


5.2.1 It is the customer’s responsibility to obtain & pay for all building permits, licenses, public
assessment, prorated utilities, utility connections, occupancy fees and any other fees required by
any government authority in connection with the work provided for in the contract.

5.2.2 The charges towards Entry Tax/ Octroi or local tax, if any, Transit Insurance, Permits and offloading
at Job site is to be borne by the customer.

5.3 Off-loading/unloading of Material at Job Site:

The customer is responsible for accurately checking the materials upon arrival and offloading. Any
discrepancies must be noted on the material dispatch note.

8.0 FORCE – MAJEURE CLAUSE


The term force-majeure will cover the following:

8.0.1 Natural phenomena, including but not limited to weather, floods, droughts, earth-quake &
epidemics.

8.0.2 Acts of any Governmental authority, domestic or foreign, including but not limited to an
emergency, declared or undeclared priorities, quarantines embargoes, licensing control on
production or distribution restrictions.

8.0.3 Transportation delay due to force-majeure, non-availability of transport facilities or accidents,


damage to equipment in transit or during erection.
8.0.4 Strikes, slow-downs, lock-outs and sabotages.

9.0 Legal Jurisdiction:

This Contract is binding and subject to Ahmednagar Jurisdiction
