The United States Court of Appeals for the Fourth Circuit recently issued two orders affecting the
Mountain Valley Pipeline Project. Despite the clear language of the Fiscal Responsibility Act of
2023, the Fourth Circuit issued a stay of construction in the Jefferson National Forest and a stay
of the Fish & Wildlife Service’s Biological Opinion and Incidental Take Statement for the Project,
issued under the Endangered Species Act. Mountain Valley is evaluating all legal options, which
include filing emergency appeals to the Supreme Court of the United States.
Mountain Valley will refrain from new forward-construction activities while resolving the legal
challenges. Mountain Valley will continue and complete certain construction activities that were
in progress at the time of the court’s actions, all of which are consistent with the types of work the
Commission has previously permitted Mountain Valley to continue during construction delays to
provide environmental benefits.1 These activities include the following:

F Complete travel lane from 9115+00 to 9205+00 in order to access bridge at SJ-
5 from both sides so that failing header mats can be replaced.
H Complete crossing S-C29 (Station 12132+50). The dam and pump around is
installed with open trench through stream crossing. Mountain Valley will
complete lower-in, tie-in welds, backfill, and restoration. Estimated
completion 7/13.
In addition, Mountain Valley is currently engaged in, and will continue, Project activities that are
designed to address right-of-way stabilization, environmental maintenance and protection, safety,
integrity, and landowner concerns.
