This is a reference made under Section 20(3) of the Industrial Relations Act 1967

[Act 177] arising out of the dismissal of Mohamad Elmi bin Md Sawal

(hereinafter referred to as “the Claimant”) by Bafco Asia Sdn. Bhd. (hereinafter

referred to as “the Company”) on 7 October 2020.

INTERIM AWARD
(Consolidate of Cases)

[1] Cases No. 3/4-1405/21; 3/4-1406/21; 3/4-1407/21; 3/4-1408/21; 3/4-

1641/21; 3/4-1642/21; 3/4-1643/21; 3/4-1644/21; 3/4-2051/21; 3/4-2052/21; 3/4-

2053/21; 3/4-2054/21; 3/4-2055/21; 3/4-2056/21; 3/4-2057/21; 3/4-2058/21; 3/4-

2059/21; 3/4-2330/21; 3/4-2331/21 and 3/4-2333/21 had been consolidated with

Case No. 3/4-1404/21 via Interim Award No. 1590 of 2021 dated 1 November

2021.

[2] These cases were fixed for the first mention on 2 June 2021 and followed

by several mention dates. The hearing dates for the consolidated cases have

been fixed for 16 and 17 August 2023.

[3] Cases No. 3/4-1404/21, 3/4-1405/21, 3/4-1406/21, 3/4-2055/21, 3/4-

2056/21, 3/4-2057/21, 3/4-2330/21, 3/4-2331/21, 3/4-1408/21, 3/4-1641/21, 3/4-

1642/21, 3/4-1644/21 and 3/4-2058/21 had been deconsolidated via Interim

Award No. 2187 of 2022 dated 28 September 2022 as the Claimants withdrawn

their cases against the Company.

[4] In order for continuity of cases, the Court is required to consolidate Cases

No. 3/4-1643/21, 3/4-2051/21, 3/4-2052/21, 3/4-2053/21, 3/4-2054/21, 3/4-

2059/21 and 3/4-2333/21 with Case No. 3/4-1407/21.

[5] In the circumstances, the Court hereby orders Cases No. 3/4-1643/21, 3/4-

2051/21, 3/4-2052/21, 3/4-2053/21, 3/4-2054/21, 3/4-2059/21 and 3/4-2333/21 to

be consolidated with Case No. 3/4-1407/21.

[6] All the consolidated cases will be heard together for hearing on 16 and 17

August 2023.
