ABSTRACT

Indonesia as a country rich in arts and culture packaged in traditional cultural


expressions (TCX) has a lot of potential that can be developed. Especially with the Covid-19
pandemic, which has been endemic for several years, causing the economy to weaken, so that
traditional cultural expressions can be used as an option for post-Covid-19 economic recovery.
However, the lack of knowledge and understanding among the people has caused the
development of TCX to not run optimally. This is the time when people need to realize the
importance of legal protection in the form of copyrights. The position of the state as an organ
that is obliged to maintain and inventory as well as protect TCX according to the provisions
stipulated in Article 38 paragraph (1) of the Copyright Law. The legal problem that occurs is that
there are no specific rules governing mechanisms or state boundaries in protecting EBT, this has
the effect of not maximizing the use of TCX as an economic potential and the occurrence of
disputes over ownership of TCX among the public. To answer these problems, the type of
research used is normative juridical by examining various laws and literature that are relevant to
the theme discussed. So this research comes to the conclusion that there are still many people
who do not know the importance of TCX as a copyright that can be maximized as an economic
potential. The government as the holder of TCX copyrights has not optimally protected TCX
because there are no specific rules governing TCX ownership.
