1. I am the defendant herein as such I am well acquainted with the facts of the
case. The plaintiff filed the suit for permanent injunction with absolutely false and
concocted allegations. I humbly submit that apart from the present, the plaintiff filed
another suit O.S.No.320 of 2018 on the file of this Honourable Court against me and
others for same subject matter i.e. schedule property. I am contesting the said suit
by filing my written statement.
2. I humbly submit that in the present suit I have adduced my oral evidence
and documentary evidence. I humbly submit that for the reasons best known to the
plaintiff, the plaintiff not address the arguments. As I am under the impression that
as I am defendant, after submission of arguments by plaintiff only, my side
arguments will be heard. I humbly submit that the Honourable Court posted the
present suit to 17-11-2022 for submitting the arguments of both sides. I humbly
submit the advocate clerk of my advocate by mistake entered wrong entry about the
hearing date of the present suit and under those circumstances my side arguments
were not submitted on the above date. Under those circumstances the Honourable
Court posted the suit for judgement to today. I humbly submit the above said
mistake was noticed in the last week. I humbly submit my advocate advised me that
I have to file necessary petition for reopening the matter to submit the arguments on
my side. I humbly submit that there are no latches or negligence on my part in not
submitting arguments in time and the same was happened for the reason sated
supra. I humbly submit that I am having strong case and to defend my case it is
highly necessary to submit the arguments on my side.
3. Therefore it is necessary in the interests of the justice that the Honourable
Court may be pleased to reopen the matter to enable me to submit arguments on my
side. Else I will suffer huge and irreparable loss.
