A. PROBLEM – Common misconception about his role and functions

B. CASE FACTS:

Title: Rod Santos v Prime Manufacturing Company

Facts: Rod Santos is employed at Prime Manufacturing Company. Santos lost


control of his job of managing the department.

Issue: Did Santos fail to perform his role and function as HR manager at his
Company?

Rule: Due to a lack of knowledge of the position given to the defendant, he


got more distant from his staff and other plant managers. He also
exhibited little enthusiasm in his employment and focused on mental
tasks related to the department.

C. ANALYSIS/HYPOTHESIS:

Analysis: In 3 months of Santos’s employment, almost 32% of the


employee resigned for unknown reasons, as no exit interview
was conducted, because of the resignation of 32% of the
employee, the production schedule was delayed and foreign
customers were alarmed. He, therefore, acted with no doubt that
he failed to perform his role and function as HR manager at his
company which resulted in production delays.

D. ALTERNATIVE COURSE OF ACTION:

If and only if Santos did his role and function as an HR manager, no employees
will resign and the production of the garment will not be delayed and the distribution
to the foreign country will be on time because customer satisfaction is of Prime
importance.

And to the company’s applicant’s interviewees, do not just look at the academic
performance/achievement of the applicant, consider checking their skills and ability if
they will be able to do the job properly so that they will not put the company in
jeopardy.

E. RECOMMENDATION/CONCLUSION

Conclusion: Judgment affirmed, failure to perform duties.

Article 282, 283, and 284 of the Labor Code provides an exhaustive list of grounds
for termination of employment. The causes that may lead to dismissal will be either
personal causes — linked to the employee — or business-related.
