Open access compliance

● DOAJ only accepts fully open access journals

● Open Access

(Creative Commons or equivalent)
○ Allow immediate free access to the work
○ Permit any user to read, download, copy, distribute, print, search, or link to the full
texts of articles, crawl them for indexing, pass them as data to software, or use

Copyright & licensing
Copyright and Licensing Basics

The terms of the user license do not apply to the copyright holder.
Therefore:
● when copyright is retained by the author without restrictions, the license applies to the
readers and the publisher.
● when copyright is transferred to the publisher, the license applies to the readers and the
author(s).
● when the author retains copyright but commercial rights are transferred to the publisher
and a non-commercial license is used, the license applies to the reader and the author.
● when the author retains copyright but exclusive publishing rights are granted to the
publisher, this is equivalent to the transfer of commercial rights to the publisher, the
license applies to the reader and the author.
DOAJ Criteria:
Licensing
Importance of licensing

● Free access does not always mean open access!

● Open access = free access + usage rights (licenses)
● Use licensing to:
○ Inform readers how they may reuse content
○ Inform readers of any reuse that is not allowed
○ Protect the author and journal against unauthorised use
Caption: an illustration of the main license types and their terms
Licensing
DOAJ licensing requirements

● Licensing terms must be clearly stated on the journal website

● Copyright notice and publishing agreement must not conflict with license
● Different licenses may be applied under certain conditions
○ Funder requirements
○ Author’s employer requirements
● Only one license can be applied to an individual article
Licensing best practice

● Embed or display licensing information in full text articles

○ Useful when articles are downloaded and shared
○ Recommended but not required for inclusion in DOAJ
● Licenses allowing wide reuse are preferred by many
○ CC BY is required by some funders
○ But any CC license is accepted by DOAJ
DOAJ Criteria:
Copyright
Importance of copyright

● When an original work is created, the owner automatically has exclusive

copyright of that work
● Copyright is used to protect the work against unauthorized use
● Many works cannot be used without permission of the owner
● Open access allows owners to share rights
● Rights are shared using a license
The “Rights” of a Copyright Owner

● Exclusive right to:

○ Reproduce the work
○ Prepare derivative works based upon the work
○ Distribute copies of the work
○ Perform the work publicly
○ Display the work publicly
● Authorize others to exercise the rights, subject to certain statutory limitations.
● Moral rights such as attribution

Ideas and information are not covered by copyright,

how they are expressed are.
Copyright

Restrictions are sometimes imposed by the publisher even though the author retains
copyright:
● The publisher requires exclusive publishing rights. → The author no longer holds the
copyright without restrictions.
● The publisher requires a transfer of commercial rights or an exclusive grant of
commercial rights. → The author no longer retains copyright without restrictions.
● “All rights reserved” is never appropriate for open access content.
Example: Copyright Held by Authors

● [Journal_Name] allow the author(s) to hold the copyright without restrictions and allow the
author(s) to retain publishing rights without restrictions to the published articles. The owner of the
commercial rights of the article is the author.
● [Journal_Name] uses CC-BY NC SA or an equivalent license as the license for the publication,
distribution, use, and reuse of scholarly work in the journal.
Example: Copyright Transferred to Journal

● In order to be accepted and published by [Journal Name], author(s) submitting the article
manuscript should complete all the review stages. By submitting the manuscript, the author(s)
agreed to these following terms:
● The copyright of published articles shall be assigned to [Journal Name] as the publisher of the
journal. The intended copyright includes the rights to publish articles in various forms
(including reprints). [Journal Name] maintain the publishing rights to the published articles.
● Authors are permitted to disseminate published article by sharing the link/DOI of the article at
[Journal Name]. Authors are allowed to use their articles for any legal purposes deemed necessary
without written permission from [Journal Name] with an acknowledgement of initial publication to
this journal.
● Users/public use of this website will be licensed to the Creative Commons Attribution-
NonCommercial-ShareAlike 4.0 International License.
