AFFIDAVIT OF EXPLANATION

I, Pat Eduardo B Dela Cruz III, of legal age, bona fide member of Philippine
National Police and presently assigned at Meycauayan CPS, Bulacan PPO, after having
been sworn to in accordance with the law, do hereby depose and state:

That I am detailed as one (1) of the PNP Members of Meycauyan CPS to escort
one (1) Person Under Police Custody (PUPC) identified as Gilbert Tamis y Hugan who
was arrested for alleged violation of R.A. 9165 and was confined at Rogaciano M
Mercado Memorial Hospital for treatment of alleged Urinary Tract Infection;

That after the end of my tour of duty at 8:00 PM of November 28, 2021, I tried to
reach PCpl Felipe C Roderno through his cellphone number for numerous times to
remind him of his duty and so I could rest and take personal necessity but he was
unreachable. I informed our station’s TOC regarding the situation who informed me also
that the former was not responding;

That at about 11:30 PM of the same day, I asked the Duty Guard namely Rodel
Rivera Javier who was only few meters away from our room if he could watch after the
subject PUPC due to the fact that I was holding my excrement for extremely long period
of time and I needed to take relief to the nearby available comfort room. After the said
guard responded in affirmative, I diligently checked and assured that the handcuff of the
said suspect was tightly locked on his right hand and firmly attached on the hospital bed
and all windows were closed. However, when I returned, I was shocked when I realized
that the subject PUPC was already gone and the handcuff of said suspect was already
broken;

That immediately thereafter, I exerted all efforts to recover the said PUPC around
the vicinity of the said hospital but yielded futile. As such, I informed my unit
(Meycauayan CPS) the said incident which prompted PLT SCHNIEDER J GARCIA,
Duty Officer of the Day, Meycauayan CPS to issue an explanation memo with subject:
Explanation Re: Neglect of Duty directing me to explain in affidavit form why no
disciplinary action shall be construed against me for the escape of said suspect;

That said incident was not intentional as same was in fact attributable to the
failure of PCpl Felipe C Roderno to replace me at 8:01 PM (on time). PCpl Roderno had
only appeared at Meycauayan CPS at about 5:00 AM of November 30, 2021. This only
shows that based on our duty detail order, any liability arising from our escort duty shall
be shouldered by him (the next duty personnel) that time and in no case shall be
attributed against me who was already off from duty and that he was the one who
deliberately neglected the duty to secure the said PUPC; and

I am executing this affidavit to attest the truth of foregoing facts and humbly
prays for your indulgence and consideration.
