PART A
Answer ALL question.

QUESTION 1

Ahmad is a farmer. He had occupied a piece of land in Mersing, Johor under a temporary
occupation licence (TOL) since 2020. The TOL provides that the land is to be used for the
purpose of cultivation and private residence. The State Authority has approved Ahmad's
request for a yearly renewal. Ahmad grew coconut and vegetables for commercial purposes.
Rosmah, Ahmad’s wife dissatisfied with the wooden house built on the land. She decided to
renovate the house. While excavating the land for the renovation, the construction worker from
Rami Sdn Bhd found gold within the land. Ahmad and Rosmah got excited, and they asked
the construction worker from Rami Sdn Bhd to stop the renovation but start extracting the gold.

Haris was issued a temporary occupation license adjoining to Ahmad's land for the purpose
of rearing fish. About a week ago, the land near Ahmad's boundary subsided after a heavy
downpour. Ahmad feels that the subsidence was caused by Haris's construction of his fish
pond near the boundary.

In the meantime, Ahmad is also a co-registered owner of a piece of land measuring 10


hectares in Kulai. The title has a restriction in interest which states “Tanah ini tidak boleh
dipindahmilik, dipajak atau digadai tanpa persetujuan pihak Berkuasa Negeri”. Ahmad signed
an instrument of transfer in Form 14A to transfer his title to his son, Adi, aged 15. After the
instrument was attested by Rosmah, his wife, he went to present the instrument at the land
office for registration. The form was however rejected by the Land Office.

Answer the following questions separately;

a) Advise Ahmad if he can proceed with the extraction of gold within the TOL land.

b) The subsided boundary leads to destroying Ahmad’s vegetables, can Ahmad take action
against Haris?
(8 marks)

c) On what grounds the instrument of transfer in Form 14A was rejected by the land office.
(20 marks)
