QUESTION 1
Ahmad is a farmer. He had occupied a piece of land in Mersing, Johor under a temporary
occupation licence (TOL) since 2020. The TOL provides that the land is to be used for the
purpose of cultivation and private residence. The State Authority has approved Ahmad's
request for a yearly renewal. Ahmad grew coconut and vegetables for commercial purposes.
Rosmah, Ahmad’s wife dissatisfied with the wooden house built on the land. She decided to
renovate the house. While excavating the land for the renovation, the construction worker from
Rami Sdn Bhd found gold within the land. Ahmad and Rosmah got excited, and they asked
the construction worker from Rami Sdn Bhd to stop the renovation but start extracting the gold.
Haris was issued a temporary occupation license adjoining to Ahmad's land for the purpose
of rearing fish. About a week ago, the land near Ahmad's boundary subsided after a heavy
downpour. Ahmad feels that the subsidence was caused by Haris's construction of his fish
pond near the boundary.
a) Advise Ahmad if he can proceed with the extraction of gold within the TOL land.
