OF COUNSEL’S
WITHDRAWAL OF APPEARANCE

The undersigned counsel respectfully manifests that:

1. He has previously submitted his Withdrawal of Appearance as

counsel for the respondents-appellees in the above-captioned case
effective immediately on account of his appointment to the
Prosecution Service, Department of Justice, Oriental Mindoro, a
copy of his Withdrawal of Appearance and the corresponding
Appointment and Registry Return Receipts are hereto attached as

ANNEXES “A” to “D”, respectively;

2. Despite the submission of said Withdrawal of Appearance, herein

counsel has been furnished a copy of the Decision dated January
29, 2010 at his former office address which was subsequently
forwarded to herein counsel’s residential address;

3. Hence, it would be unfair to the party respondents to be furnished

a copy of the aforesaid Decision to their former counsel who has
formally withdrawn his appearance and not to the individual
respondents themselves, personally at their given addresses which
was requested for in the said Withdrawal of Appearance;

 4. Lastly, herein counsel respectfully requests that his name be totally
withdrawn as counsel for the respondents considering his very
recent appointment as Presiding Judge of the Municipal Trial
Court, Sta. Cruz, Occidental Mindoro, where the undersigned took
his oath and assumed office on June 01, 2009; copies of the Notice
with the corresponding Appointment itself are hereto attached and

marked as ANNEX “E” and “F”, respectively;

5. That this Manifestation and Reiteration be duly NOTED by this

Honorable Commission;
