SUPREME COURT
(Part V, Articles 124-147)
The Supreme Court came into existence on January 28, 1950. It is located in Delhi.
Integrated judicial system of Courts is present in India
o The Supreme Court is the apex court (top most in the hierarchy) in the country.
o The High Courts are below the Supreme Court.
o Under the High Court there is a system of subordinate courts. (District Courts and other
lower courts).
Note: There is a double system of courts in USA—one SC for the centre and the other SC for each state.
The Supreme Court is the guardian of the Constitution.
The Supreme Court is the guarantor and protector of the Fundamental Rights of the citizens.
The Security of tenure is provided to the judges by the Constitution.
Supreme Court judges can be removed by the President only in the manner and on the grounds
mentioned in the Constitution.
The Judges of the Supreme Court do not hold the office during the pleasure of the President.
So far how many judges of Supreme Court have been removed?
Ans: Zero
No Supreme Court judge was removed so far in independent India.
Note: Ministers do not have security of tenure and they hold the office during the pleasure of the
President.

Note: The Constitution has not prescribed a minimum age for appointment of a judge of the Supreme
Court.
Appointment of Judges
The judges of the Supreme Court are appointed by the President.
The Chief Justice of India (CJI) is appointed by the President after consultation with such judges of the
Supreme Court and High Courts as the President deems necessary.
The other judges are also appointed by the President after consultation with the Chief Justice of
India and such other judges of the Supreme Court and the High Court as the President deems
necessary.***
Note: While appointing the other judges of the Supreme Court the consultation with the Chief Justice of
India is obligatory for the President.
From the year 1950 to 1973 a practice has been established that the senior most judge of the
Supreme Court is appointed as the Chief Justice of India.
The convention was violated in the year 1973 when A N Ray was appointed as the CJI by superseding
three senior judges.
In the year 1977 M U Beg was appointed as the CJI by superseding the then senior most judge of the
Supreme Court.
In the year 1993 in the second judges’ case the Supreme Court ruled that that the senior most judge
of the Supreme Court alone be appointed as the CJI.
Oath
Oath of office is administered by the President of India.
In the absence of the President some other person appointed by the President would perform the
same.
Tenure (Term)
A judge holds the office till he/she attains the age of 65 years.
Salary
The salaries, privileges, leaves and pensions of the Supreme Court are determined by the Parliament
from time to time.
The salary of the Chief Justice of India is Rs 2,80,000/- (earlier 1 lakh)
The Salary of other Judge of the Supreme Court is 2,50,000/- (earlier 90,000)

Resignation
A judge submits the resignation to the President of India.
Impeachment or Removal
A judge of the Supreme Court can be removed through impeachment.
A judge can be removed from the office by the President on the recommendation by the
Parliament.
o (**Removal process of Supreme Court and High Court judge are same)
There are two grounds that are mentioned in the Constitution for the removal of judge of the
Supreme Court:
o Proved Misbehaviour
o Incapacity
The removal procedure of a Judge of the Supreme Court is initiated either in the Lok Sabha or in the
Rajya Sabha.
If the procedure begins in Lok Sabha
o A removal motion of a Supreme Court judge is signed by 100 members in the case of Lok
Sabha.
o The signed removal motion is to be given to the Speaker.
o The speaker may admit or refuse to admit the same.
o If it is admitted the speaker constitutes a three member committee to investigate into the
charges.
The committee should consist of
o the CJI (OR) a judge of the Supreme Court
o a chief justice of a high court
o A distinguished jurist.
If the committee finds the judge to be guilty of misbehaviour or suffering from incapacity, the Lok
Sabha can take up the consideration of the motion.
After it is passed in Lok Sabha with a special majority the motion is presented to the Rajya Sabha.
If it is also passed in the Rajya Sabha with a special majority an address is presented to the
President for the removal of the judge.
The President passes an order removing the judge.

If the committee finds the judge to be guilty of misbehaviour or suffering from incapacity the Rajya
Sabha can take up the consideration of the motion.
After it is passed in the Rajya Sabha with a special majority the motion is presented to the Lok
Sabha.
If it is also passed in the Lok Sabha with a special majority an address is presented to the President
for the removal of the judge.
The President passes an order removing the judge.
The Constitution has conferred a very extensive jurisdiction and vast powers on the Supreme Court. It is:
Federal Court like the American Supreme Court
Final court of appeal like the British House of Lords (the Upper House of the British Parliament).
Final interpreter and guardian of the Constitution
Guarantor of the fundamental rights of the citizens.
Further, it has advisory and supervisory powers.
The jurisdiction and powers of the Supreme Court can be classified into the following:
1. Original Jurisdiction.
2. Writ Jurisdiction.
3. Appellate Jurisdiction.
4. Advisory Jurisdiction.
5. A Court of Record.
6. Power of Judicial Review.
7. Other Powers.
1. Original Jurisdiction
As a federal court, the Supreme Court decides the disputes between different units of the Indian
Federation.
Any dispute between:
a. the Centre and one or more states; or
b. the Centre and any state or states on one side and one or more states on the other; or
c. between two or more states.
In the above federal disputes, the Supreme Court has exclusive original jurisdiction.

2. Writ Jurisdiction (Art. 32)
The Constitution has constituted the Supreme Court as the guarantor and defender of the
fundamental rights of the citizens.
The Supreme Court is empowered to issue writs including habeas corpus, mandamus, prohibition,
quo-warranto and certiorari for the enforcement of the fundamental rights of an aggrieved citizen.
**High Courts also have writ jurisdiction (Art. 226)
3. Appellate Jurisdiction
The Supreme Court is primarily a court of appeal and hears appeals against the judgements of the
lower courts.
It enjoys a wide appellate jurisdiction which can be classified under four heads:
a. Appeals in constitutional matters.
b. Appeals in civil matters.
c. Appeals in criminal matters.
d. Appeals by special leave.
4. Advisory Jurisdiction
The Constitution (Article 143) authorises the President to seek the opinion of the Supreme Court in
the two categories of matters:
a. On any question of law or fact of public importance which has arisen or which is likely to
arise.
b. On any dispute arising out of any pre-constitution treaty, agreement, covenant etc
Compulsory to give advice in case of (b), not in (a)
Advice not binding on President
5. A Court of Record
As a Court of Record, the Supreme Court has two powers:
1. The judgements, proceedings and acts of the Supreme Court are recorded for perpetual memory and
testimony.
o These records are admitted to be of evidentiary value and cannot be questioned when
produced before any court.
o They are recognised as legal precedents and legal references.
2. It has power to punish for contempt of not only of itself but also of high courts, subordinate courts
and any tribunals in India.

On examination, if they are found to be violative of the Constitution (ultra-vires), they can be
declared as illegal, unconstitutional and invalid (null and void) by the Supreme Court. Consequently,
they cannot be enforced by the Government.
Note: The words “Judicial Review” is not mentioned in the Constitution. (Derived from Article 13(1) and
13(2)
7. Other Powers
Supreme Court has numerous other powers:
The Supreme Court is the ultimate interpreter of the Constitution.
The election disputes related to the President and Vice President can be challenged only in the
Supreme Court and the decision of the Supreme Court shall be final.
It enquires into the conduct and behaviour of the chairman and members of the UPSC on a reference
made by the president. If it finds them guilty of misbehaviour, it can recommend to the president for
their removal. The advice tendered by the Supreme Court in this regard is binding on the President.
It has power to review its own judgement or order. Thus, it is not bound by its previous decision and
can depart from it in the interest of justice or community welfare. In brief, the Supreme Court is a
self-correcting
Important Points:
Under Article 121 - no discussion shall take place in Parliament with respect to the conduct of any
judge of SC/HC in the discharge of his duties.
o **Exception – It can be done upon a motion for presenting an address to the President praying
for the removal of the Judge.
In the absence of the CJI the President can appoint a judge of the Supreme Court as an acting CJI.
The CJI can appoint a judge of a High Court as an ad hoc (temporary) judge of Supreme Court. (This
can be done by the CJI only with the prior permission of the President).
The CJI can request a retired judge of the Supreme Court or High Court to act as a judge of the
Supreme Court for a temporary period of time.
The CJI can set up the Benches of SC in other places of the Country by the CJI with the prior
permission of the President.
The Constitutional cases or references made by the President under article 143 of the Constitution
are decided by a bench consisting of at least five judges. (Advisory power of SC)
All other cases are usually decided by a bench consisting of not less than three judges.

अर्वलोकन
सर्वोच्च न्यायालय
सर्वोच्च न्यायालय 28 जनर्वरी, 1950 को अक्तित्व में आया। यह लदल्ली में क्तथथत है ।
भारत में न्यायालयों की एकीकृत न्यालयक व्यर्वथथा मौजूद है
o उच्च न्यायालय के अधीन अधीनथथ न्यायालयों की व्यर्वथथा है । (लजला न्यायालय और अन्य लनचली
अदालतें ) ।
नोर् : संयुि राज्य अमेररका में न्यायालयों की दोहरी व्यर्वथथा है - एक SC (सर्वोच्च न्यायालय) केंद्र के ललए और
सर्वोच्च न्यायालय के न्यायाधीशों को राष्ट्रपलत द्वारा केर्वल संलर्वधान में तरीके और आधार पर हटाया जा सकता
है ।
o उत्तर: शून्य)
स्वतंत्र भारत में अब तक सुप्रीम कोटय के लकसी न्यायाधीश को नहीं हटाया गया ।

नोर् : मंलत्रयों के पास काययकाल की सुरक्षा नहीं है और र्वे राष्ट्रपलत के प्रसादपययन्त पद पर रहते हैं ।
या
दस (10) र्वर्ों तक उच्च न्यायालय (न्यायालयों) में र्वकालत कर चुका हो।
या
राष्ट्रपलत की राय में एक प्रलतलित न्यायलर्वद होना चालहए ।
नोर् : सर्वोच्च न्यायालय के न्यायाधीश की लनयुक्ति के ललए संलर्वधान ने न्यूनतम आयु लनधाय ररत नहीं की है ।
न्यायाधीशोों की ननयुक्ति
परामशय के बाद लनयुि लकया जाता है लजन्हे राष्ट्रपलत आर्वश्यक समझते हैं ।
भारत के मुख् न्यायाधीश और सर्वोच्च न्यायालय और उच्च न्यायालय के अन्य न्यायाधीशों के साथ राष्ट्रपलत
द्वारा आर्वश्यक समझे जाने के बाद अन्य न्यायाधीशों को भी राष्ट्रपलत द्वारा लनयुि लकया जाता है । ***

नोर् : सर्वोच्च न्यायालय के अन्य न्यायाधीशों की लनयुक्ति करते समय, भारत के मुख् न्यायाधीश के साथ परामशय
करना राष्ट्रपलत के ललए अलनर्वायय है ।
र्वर्य 1950 से 1973 तक ऐसी परम्परा थथालपत हो गयी थी लक सुप्रीम कोटय के र्वररितम न्यायाधीश को भारत
के मुख् न्यायाधीश के रूप में लनयुि लकया जाता था ।
लकन्तु र्वर्य 1973 में इस परम्परा का उल्लंघन लकया गया था जब तीन र्वररि न्यायाधीशों को अपदथथ करके
ए.एन. रे को CJI (भारत के मुख् नयायधीश) के रूप में लनयुि लकया गया था।
र्वर्य 1977 में सुप्रीम कोटय के तत्कालीन र्वररितम न्यायाधीश के ऊपर एम यू बेग को बतौर सीजेआई के रूप
में लनयुि लकया गया था।
दू सरे न्यायाधीश के मामले में र्वर्य 1993 में सुप्रीम कोटय (सर्वोच्च न्यायालय ) ने फैसला लदया लक अकेले सुप्रीम
कोटय के र्वररितम न्यायाधीश को CJI (मुख् न्यायाधीश )के रूप में लनयुि लकया जाना चालहए।
प्रथम र्वाद 1982 में सुप्रीम कोटय ने कहा लक CJI (भारतीय मुख् न्यायाधीश ) की सलाह केर्वल परामशय कारी है -
बाध्यकारी नहीं|
दू सरे न्यायाधीश र्वाद 1993 में सर्वोच्च न्यायालय ने अपने पहले के फैसले को उलट लदया और भारतीय मुख् न्यायाधीश
द्वारा सलाह को 'सहमलत' शब्द के अथय में बदल लदया। लेलकन, भारतीय मुख् न्यायाधीश अपने 2 र्वररितम सहयोलगयों
से सलाह लेगा।
तीसरे र्वाद 1998 में लदशालनदे शों को जारी लकया गया। SC ने कहा लक भारतीय मुख् न्यायाधीश को उच्चतम न्यायालय
के 4 र्वररितम न्यायाधीशों के एक कॉलेलजयम से परामशय करना चालहए और यहां तक लक अगर दो न्यायाधीश प्रलतकूल
राय दे ते हैं , तो उन्हें लनयुक्ति के ललए सरकार को लसफाररश नहीं भेजनी चालहए।
चौथे न्यायाधीश र्वाद में 2015 एनजेएसी अलधलनयम (2014 में अपनाया गया) को हटा लदया गया और कोलेलजयम

कायटकाल (अर्वनध)
र्वेतन
सर्वोच्च न्यायालय के र्वेतन, लर्वशेर्ालधकार, अर्वकाश और पेंशन समय-समय पर संसद द्वारा लनधाय ररत की जाती
हैं ।
भारत के मुख् न्यायाधीश का र्वेतन रु। 2,80,000 / - है (पहले 1 लाख)

सर्वोच्च न्यायालय के न्यायाधीश की लनष्कासन प्रलक्रया या तो लोकसभा या राज्यसभा में शुरू की जाती है ।
अगर लोकसभा में प्रलक्रया शुरू हो जाती है -
o सुप्रीम कोटय के न्यायाधीश के लनष्कासन प्रिार्व पर लोकसभा के मामले में 100 सदस्ों द्वारा हिाक्षर
लकए जाते हैं ।
o यलद यह स्वीकार लकया जाता है तो स्पीकर(लोकसभा अध्यक्ष ) आरोपों की जां च के ललए एक तीन
सदस्ीय सलमलत का गठन करता है ।

सनमनत में
अगर सलमलत न्यायाधीश को दु व्ययर्वहार का दोर्ी या अक्षमता से पल़ित मानती है तो लोकसभा प्रिार्व पर
लर्वचार कर सकती है ।
लोकसभा में लर्वशेर् बहुमत के साथ पाररत होने के बाद यह प्रिार्व राज्य सभा को प्रिुत लकया जाता है ।
यलद इसे राज्य सभा में लर्वशेर् बहुमत के साथ पाररत लकया जाता है तो न्यायाधीश को हटाने के ललए राष्ट्रपलत के
o सुप्रीम कोटय (सर्वोच्च न्यायालय )के न्यायाधीश के लनष्कासन प्रिार्व पर राज्यसभा के मामले में 50 सदस्ों
द्वारा हिाक्षर लकए जाते हैं ।
o यलद यह स्वीकार लकया जाता है तो सभापलत आरोपों की जां च के ललए एक तीन सदस्ीय सलमलत का गठन
करता है ।
सनमनत में
CJI (भारत का मुख् न्यायाधीश )और सुप्रीम कोटय (सर्वोच्च न्यायालय ) का एक न्यायाधीश
लकसी उच्च न्यायालय के मुख् न्यायाधीश
एक प्रलतलित न्यायलर्वद।
यलद सलमलत न्यायाधीश को दु व्ययर्वहार या अक्षमता से दोर्ी मानती है तो राज्यसभा प्रिार्व पर लर्वचार कर
सकती है ।
इसे राज्यसभा में लर्वशेर् बहुमत से पाररत लकए जाने के बाद प्रिार्व लोकसभा में प्रिुत लकया जाता है ।
यलद इसे लोकसभा में लर्वशेर् बहुमत के साथ पाररत लकया जाता है , तो न्यायाधीश को हटाने के ललए राष्ट्रपलत के
समक्ष प्रिुत लकया जाता है ।

"भारत के सर्वोच्च न्यायालय के पास दु लनया के लकसी भी लहस्से में सर्वोच्च न्यायालय की तुलना में अलधक शक्तियााँ प्राप्त
हैं ।"
संलर्वधान ने सर्वोच्च न्यायालय को एक बहुत व्यापक अलधकार क्षेत्र और व्यापक शक्तियां प्रदान की हैं । यह है :
सर्वोच्च न्यायालय के अलधकार क्षेत्र और शक्तियों को लनम्नललक्तखत में र्वगीकृत लकया जा सकता है :
1. मूल क्षेत्रालधकार
2. न्यायादे श क्षेत्रालधकार
3. अपीलीय क्षेत्रालधकार।
4. सलाहकार क्षेत्रालधकार।
5. अलभलेखों का न्यायालय
6. न्यालयक समीक्षा की शक्ति।

7. अन्य शक्तियााँ ।
1. मूल क्षेत्रानधकार
एक संघीय अदालत के रूप में सर्वोच्च न्यायालय भारतीय संघ की लर्वलभन्न इकाइयों के बीच लर्वर्वादों का फैसला
करता है ।
लनम्नललक्तखत में से लकसी के बीच कोई लर्वर्वाद होने पर:
संलर्वधान ने नागररकों के मौललक अलधकारों के गारं टर और रक्षक के रूप में सर्वोच्च न्यायालय का गठन लकया
है ।
सर्वोच्च न्यायालय को एक पील़ित नागररक के मौललक अलधकारों के प्रर्वतयन के ललए बंदी प्रत्यक्षीकरण,
3. अपीलीय क्षेत्रानधकार
सर्वोच्च न्यायालय मुख् रूप से अपील की अदालत है और लनचली अदालतों के लनणययों के क्तखलाफ अपील
सुनता है ।
यह एक लर्विृत अपीलीय क्षेत्रालधकार प्राप्त करता है लजसे चार प्रमुख शीर्ों के अंतगयत र्वगीकृत लकया जा
सकता है :

4. सलाहकार क्षेत्रानधकार
संलर्वधान (अनुच्छेद 143) के तहत राष्ट्रपलत को लनम्नललक्तखत दो श्रेलणयों में सर्वोच्च न्यायालय की राय लेने का
अलधकार दे ता है :
a. सार्वयजलनक महत्व के लकसी मसले पर लर्वलध या तथ्य के लकसी भी प्रश्न पर जो उत्पन्न हुआ है या जो उत्पन्न
होने की संभार्वना है ।
b. लकसी भी पूर्वय-संर्वैधालनक संलध, समझौते , प्रसंलर्वदा आलद से उत्पन्न लर्वर्वाद पर
(b) के मामले में सलाह दे ना अलनर्वायय, (a) के मामले में सलाह दे ना अलनर्वायय नहीं
सलाह मानना राष्ट्रपलत पर बाध्यकारी नहीं है |
5. अनभलेखोों का एक न्यायालय
1. उच्चतम न्यायालय के लनणयय, काययर्वाही और कृत्यों को सार्वयकाललक अलभलेख और गर्वाही के ललए दजय लकया
जाता है ।
o इन अलभलेखों को स्पष्ट् मूल्य के रूप में स्वीकार लकया जाता है और लकसी भी अदालत में पेश लकए जाने

जां च करने पर यलद र्वे संलर्वधान के उल्लंघनकताय (अल्ट्र ा-र्वायसय ) पाए जाते हैं तो उन्हें सुप्रीम कोटय द्वारा अर्वैध,
असंर्वैधालनक और अमान्य (शून्य और शून्य) घोलर्त लकया जा सकता है । पररणामस्वरूप, उन्हें सरकार द्वारा

न्यानयक समीक्षा की आर्वश्यकता -
संघर्वाद की अर्वधारणा को बनाए रखने के ललए (केंद्र और राज्य सरकारों के बीच संतुलन)
नागररकों के मौललक अलधकारों की रक्षा करना।
नोर् : संलर्वधान में "न्यालयक समीक्षा" शब्द का उल्लेख नहीं है । (अनुच्छेद 13 (1) और 13 (2) से व्युत्पन्न)
7. अन्य शक्तियााँ
और व्यर्वहार की जााँ च करता है । यलद र्वह उन्हें दु व्ययर्वहार का दोर्ी पाता है , तो र्वह राष्ट्रपलत को उनके
लनष्कासन के ललए लसफाररश कर सकता है । इस संबंध में सर्वोच्च न्यायालय द्वारा दी गई सलाह राष्ट्रपलत के
ललए बाध्यकारी है ।
इसके पास अपने स्वयं के लनणयय या आदे श की समीक्षा करने की शक्ति है । इस प्रकार, र्वह अपने लपछले
लनणयय से बाध्य नहीं है और न्याय या सामुदालयक कल्याण के लहत में इससे हटकर भी फैसले ले सकता है ।
संक्षेप में, सर्वोच्च न्यायालय एक आत्म-सुधार संथथा है |

महत्वपूर्ट नबोंदु:
अनुच्छेद 121 के तहत - अपने कतयव्यों के लनर्वयहन में SC / HC (सर्वोच्च न्यायालय |उच्च न्यायालय) के लकसी
न्यायाधीश के आचरण के संबंध में संसद में कोई चचाय नहीं होगी।
अपर्वाद - यह न्यायाधीश को हटाने के ललए राष्ट्रपलत को संबोलधत प्राथयना पत्र र्वाले प्रिार्व के सम्बन्ध में लकया
जा सकता है ।
CJI (भारत का मुख् न्यायाधीश) की अनुपक्तथथलत में राष्ट्रपलत सर्वोच्च न्यायालय के न्यायाधीश को काययकारी
CJI उच्चतम न्यायालय या उच्च न्यायालय के एक सेर्वालनर्वृत्त न्यायाधीश से अथथायी समय के ललए उच्चतम
न्यायालय के न्यायाधीश के रूप में कायय करने का अनुरोध कर सकता है ।
राष्ट्रपलत की पूर्वय अनुमलत से CJI द्वारा दे श के अन्य थथानों में SC (सर्वोच्च न्यायालयों) की पीठों की थथापना की
जा सकती है ।
संलर्वधान के अनुच्छेद 143 के तहत राष्ट्रपलत द्वारा तैयार लकये गए संर्वैधालनक मामले या संदभय कम से कम पां च
न्यायाधीशों र्वाली एक पीठ द्वारा तय लकए जाते हैं । (SC की सलाहकार शक्ति)
अन्य सभी मामले आमतौर पर तीन न्यायाधीशों र्वाली पीठ द्वारा तय लकए जाते हैं । (3 से कम नहीं)
