Dear Sir:

We are from the Office of the Legal Aid – The College of


Maasin, College of Law. Last semester, we conducted a field
research/survey on the top environmental problems of selected
barangays in our city as part of our Level 1 Certification of the
Law Student Practice pursuant to AM No. 19-03-24-SC Rule 138-
A.

Based on the survey held last November 7 to 8, 2022 in


Barangays Asuncion, Combado, Ma. Clara, Mahayahay, and
Soro-soro, we identified the top 2 environmental problems in
the said areas, namely: Waste Segregation/ Waste Disposal
and Open Defecation System. The barangay officials whom
we’ve spoken to during the survey expressed some concerns
pertaining to the two.

Along with studying the information gathered, we also


reviewed laws and local ordinances relevant to such areas. In

line with this, we are proposing several points that, if possible,


be added as an amendment/s, particularly, to the City
Ordinance No. 2017-092 or the Maasin City Comprehensive
Solid Waste Management Ordinance. These points are the
following:

1. Insert provision on Art. VII, Sec. 27.1 - For additional


responsibility of the MRF operator, i.e. reporting incidents
when non- barangay residents dispose of their garbage to
another barangay/s.

2. Add a specific provision in Art. 14 penalizing non-


barangay residents/outsiders disposing garbage to other
barangays.

3. Increase collection frequency in barangays outside


city proper, such as Brgy. Mahayahay and others within
the same cluster taking into account several factors such
as volume of collectible garbage, optimum convenience
of the homeowners, etc. as provided in Art. 6, Sec. 21.4 of
the same ordinance.
