Heard learned counsel for the petitioner and learned

counsel for the State.

Considering the affidavit filed in support of the delay

condonation application, I find that sufficient cause has been

shown to condone the delay in filing the revision application.

The delay is condoned and the revision application shall be

treated to be within time.

The Interlocutory application stands allowed.

Learned counsel for the petitioner submits that the

petitioner was sentenced for one year six months imprisonment

and he is in custody for one year and five months.

Considering the aforesaid facts and circumstances of

the case, let the petitioner, above named, be directed to be

released on bail during the pendency of this revision application

on furnishing bail bond of Rs. 10,000/- (ten thousand) with two

sureties of the like amount each to the satisfaction of Judicial

Magistrate 1st Class, Purnea in connection with C.A. No.

1251/2003, CIS No. 4737/2013, TR No. 1611/2018, subject to

deposit of fine awarded by the trial Court as part of sentence.
