Petition under Section 1 51 CPC praying that in the circumstances stated in the
affidavit filed in support of the petition, the High Court may be pleased to direct the
respondent No.3 to receive the Sale Certificate issued by the petitioner Bank upon
successful sale under the provisions of the SARFAESI Act, 2002 in respect of property
admeasuring Ac.5.03 guntas in survey No.36/,4/3.of Gopanpally village, Serilingampally
mandal, Ranga Reddy district and register and release the same in the interest of
justice, pending disposal of WP No. 28208 of 2021 , on the file of the High Court. _-

The court while directing issue of notice to the Respondents herein to show
cause as to why this application should not be complied with, made the following
order.(The receipt of this order will be deemed to be the receipt of notice in the case)._
ORDER:

It is stated by learned counsel for the petitioner that in similar

circumstances, this Court granted interim order dated 06.01.2020 in l.A.No.l o[
2020 in W.P.No.159 of 2020. The same is not disputed by learned Assistant
Government Pleader for Revenue.

ln view of the same, there shall be interim direction as prayed for. However,
any such registration shall be treated as a provisional one and subject to the
result of the writ petition.

Registry shall make an endorsement on the writ petition to the effect that
the same shall not be permitted to be withdriwn.
