FIRST AMENDMENT TO THE SURVIVOR’S TRUST OF THE FITZMAURICE FAMILY TRUST ‘The SURVIVOR’S TRUST of the FITZMAURICE FAMILY TRUST, dated July 23, 1991 (the “Trust”) is hereby amended in part as follows: 1, ARTICLE SIX, Paragraph 6.1 (f) of the Survivor's Trust only, is hereby amended to read as follows: “() Distribution of Survivor’s Ti mn Death of Survivis Spouse. Upon the death of the surviving spouse, the Trustee shall distribute the Trust Estate as follows: (i) Thirty-five percent (35%) to Michael Scano, but only if he survives the surviving spouse; (ii) Fifteen percent (15%) to The Board of Trustees of Cedars Sinai Hospital, Los Angeles, California, for the Hemoglobinopathy Program, in gratitude for the care provided to the Surviving Trustor’s son, Gary William Scano, who had a terminal blood condition. (iii) The balance to The Board of Trustees of Children’s Hospital of Los Angeles, California, for the Thalassemia Research Program in memory of Surviving Trustor’s children, Kristine Marie Scano and Gary William Scano, who had terminal blood conditions and were cared for at Children’s Hospital. Each sum shall be distributed outright.” 2. ARTICLE SEVEN, Paragraph 7.2 of the Survivor's Trust only, is hereby amended to read as follows: “7.2 Successor Trustees. If the surviving spouse for any reason shall fail to qualify or cease to act as Trustee of the Survivor's ‘Trust, then GREGORY WILSON, CPA of Torrance, California, shall act as Trustee. If GREGORY WILSON is unable to serve as ‘Trustee for any reason, then MARIA RUGGERIO of San Pedro, California, shall serve as Trustee.”3. _ SOPHIE FITZMAURICE, the Trustor, hereby confirms all other provisions of the SURVIVOR’S TRUST OF THE FITZMAURICE FAMILY TRUST AGREEMENT dated July 23, 1991.
