PART I – INTRODUCTION
ARTICLE I: SHORT TITLE & STATEMENT OF PURPOSE
(a) The present rulebook shall form the rules for conducting and participating in the Fall
Inductions 2023 of the Moot Court Society of Jindal Global Law School. The present
Rulebook shall henceforth be referred to as “Inductions Rulebook”.
(b) Please note that no participant is allowed to approach any professor in the University for
assistance/help of any form with respect to the Fall Inductions 2023. This rule shall be
strictly enforced with no exceptions. Clarification for any concern regarding Fall
Inductions 2023 can be sought by emailing mcsi@jgu.edu.in.
ARTICLE II: DEFINITIONS
(a) “Competition” means the “Fall Inductions 2023”.
(b) “Competition Case” means the official Moot Proposition drafted and published for the
purposes of the Competition.
(c) “Competition Rules” means the rules in this Document, and any supplemental rules, which
are published at a later date.
(d) “Memorial” means the written arguments submitted on behalf of both sides in accordance
with the official Competition Rules by each participant in the Competition.
(e) “MCS” means the Moot Court Society
(f) “Oral Round” means a participant’s pleadings, submitted orally in front of adjudicators on
behalf of one of the parties.
(g) “IC” means the Induction Committee of the Competition. The IC will function as the
authoritative administrators of the Competition. The composition of the IC may be
amended, if necessary, with notice of the change to the participants.
(h) “Unique Identification Code” means the number allotted to each participant. After
registration, each participant will be provided with a Unique Identification Number, which
will serve as their identifier for the Memorials and the Oral Rounds.
(i) “Timeline” means the official document with the final schedule of events published by the
IC. The Timeline shall contain information with respect to the date of release of the
competition case, submission of memorials, dates of competition and all other relevant
information. The IC reserves the right to change the timeline, if necessary, with reasonable
notice of the change to the participants.

PART II: ORGANIZATIONAL RULES
ARTICLE III: ADMINISTRATION
(a) The Competition is organized by the Moot Court Society of Jindal Global Law School,
Sonipat, NCR of Delhi. The IC shall function as the authoritative and administrative body
for the purposes of organizing the Competition.
(b) The IC has unrestricted discretion to alter the composition of its membership. Any
subsequent change in the IC’s membership will be notified to the participants via email,
within a reasonable time from its occurrence.
(c) The official email for all correspondence regarding administrative doubts is
mcsi@jgu.edu.in.
ARTICLE IV: DISCRETION OF THE ADMINISTRATION FOR INTERPRETATION OF RULES
(a) The IC will have the exclusive authority to interpret the Rules enshrined within this
document and as enshrined with the Constitution of the Moot Court Society of JGLS. The
Rules will be interpreted in a manner that is fair and equal and may at times include
deviations to uphold such fairness and equality. In the event of such a deviation, the IC
will inform all participants within a reasonable time from the occurrence of the event.
(b) Any circumstance not envisaged by these Rules will be adjudged by the IC.
(c) All decisions of the IC shall be binding.
(d) The decision of the IC can be appealed at first instance before the MCS Faculty
Coordinators within 24 hours of the decision taken by the IC.
Provided that, the substantive score of any participant cannot be directly appealed and is
final. Only matters relating to imposition of specific penalties or the interpretation of the
Rules may be appealed.
(e) Any appeal which fails to follow this escalation matrix and deadline is eligible to be deemed
to be null and void.
ARTICLE V: JURISDICTION OF THE INDUCTIONS COMMITTEE
(a) Any challenge to the Jurisdiction of the IC must be brought before the Inductions
Committee by e-mailing the same to mcsi@jgu.edu.in.
(b) The Inductions Committee holds the absolute authority to rule upon its ability to
adjudicate upon any subject-matter brought before the same.
Provided that such subject-matter does not impede upon the workings/decisions of any
other society of JGLS or JGU or the workings/decisions of any administrative or academic
offices including but not limited to the Office of the Chief Proctor, Office of the Executive
Dean JGLS, Office of the Registrar JGU and the Office of the Vice-Chancellor JGU.

(c) The Inductions Committee has the right to hear petitions of any member of the JGU
Community with regards to any procedural concerns or other concerns that may arise with
regards to the Inductions.
ARTICLE VI: QUALIFICATION FOR PARTICIPANTS
(a) The Competition is open to students enrolled in the following programs –
1) LLM – All batches barring those in their freshman year of Law School.
2) BA. LLB – All batches barring those in their freshman year of Law School.
3) BBA. LLB – All batches barring those in their freshman year of Law School.
4) BCom. LLB – All batches barring those in their freshman year of Law School.
5) LLB – All batches barring those in their freshman year of Law School.
(b) Clarifications
1) Students enrolled in the B.A. (Hons.) Legal Studies program are not eligible to
participate in the Competition.
2) Students who have an on-going ban from the MCS during the Induction process
or are currently participating in a moot or have been allotted a moot that they are
due to participate shall not be eligible to apply.
3) A student from the graduating batch may participate in the Inductions and bid for
a moot even if the moot finishes post their graduation, provided that the student
is eligible to participate despite having graduated as per the rules of the moot they
wish to bid for.
4) Certain moots on the master list may not permit participation of students enrolled
in the LL.M Program. Accordingly, students from the LL.M Program must
thoroughly check the eligibility criteria for the moots before taking part in the
Bidding process.
5) Students who are enrolled for the LL.M Pathways/J.D. Dual degree can only
participate in moots that conclude before the commencement of the said program.
6) Students enrolled in the Semester Exchange Program in the Fall Semester
(including those deferred from Spring Semester) shall be allowed to participate in
the Fall Inductions.
Provided that the participants are not on their Semester Exchange Program on the
date of the Oral Rounds of their selected Moot Court Competition.
Provided further that the participant has compulsorily informed the Moot Court
Society of the details (Name of Program, Duration, Start Date, End Date, etc.) of

their Semester Exchange Program by way of a written communication prior to the
Bidding Rounds of the Fall Inductions.
7) Any Student who is a part of a Semester Exchange Program shall be allowed to
withdraw from a selected competition without any penalties.
Provided that the student communicates their withdrawal in writing to the Moot
Court Society within 24 Hours of their allotment of the Moot.
Provided further that in the event that Oral Rounds dates are unknown, the
student shall communicate their withdrawal within 24 Hours of the release of such
information.
8) Any student found to be in violation of sub-clauses (6) and (7) shall be liable to
sanctions under Article 21 of the Moot Court Society Constitution.
Illustration I: A has been selected for a Semester Exchange from 09th August 2023
to 31st December 2023. A’s Moot is scheduled to conclude on 21st September 2023.
In such a scenario, A would have to (by virtue of the fact that A’s Moot concludes
within the duration of A’s Semester Exchange Period) withdraw from the present
competition.
Illustration II: A has been selected for a Semester Exchange from 09th August
2023 to 31st December 2023. A’s Moot is scheduled to conclude on 28th March
2024. In such a scenario, A would not have to (by virtue of the fact that A’s Moot
does not conclude within the duration of A’s Semester Exchange Period) withdraw
from the present competition.

PART III: THE INDUCTIONS PROPOSITION


ARTICLE VII: CLARIFICATIONS TO THE PROPOSITION
(a) Each participant may make a formal request to the IC for clarifications regarding the facts
of the Competition Case during the period for clarifications specified by the IC. Please
have in mind that clarification requests should be clear and only in relation to facts of the
case, not ‘leading’ questions on substantive arguments. It is at the discretion of the Case
author and/or IC to choose which clarification requests are answered.
(b) The deadline for requesting clarifications will be part of the Timeline specified by the IC.
No requests for clarification received after the deadline will be accepted.
(c) Responses supplied by the Case author will be made jointly available by the IC to all
participants prior to the deadline for Memorial submission and such responses should be
treated as an official addendum to the Competition Case, to be read together with the Case.

ARTICLE VIII: MEMORIALS
(a) All Memorials submitted for the Fall Inductions 2023 shall be drafted and submitted in
English.
(b) All Memorials shall be submitted in an Electronic Format within the prescribed time limit
and prescribed submission portal provided by the IC.
(c) All Participants shall prepare memorials for the side allocated to them.
(d) It is the responsibility of the participants to ensure that there are no technical problems
with the attached files. Amongst other reasons, delays connected to technology,
infrastructure, equipment, and conflicting schedules will not be condoned.
(e) The Memorial should be contained in a single file with the allocated Unique Identification
Code followed by the first letter of the party; an “R” for Respondent and “P” for
Petitioner; whichever side has been allotted.
Illustration: If the Unique Identification Code of X is 7, and X has been allotted the
‘Petitioner’ side, then X’s memorial file shall be named “7P” (excluding the quotation
marks).
(f) The submission of the Memorials shall be in the format prescribed in these Rules and any
further communications of the IC.
(g) All versions submitted to the IC, and to any other person under these Rules must be
identical. Subject to paragraph (f), no changes of any kind may be made after submission
of Memorials to the IC.
(h) Each memorial should be electronically submitted in two formats:
a. Microsoft Word document with the .doc or .docx file extension.
b. PDF format.

PART IV: MEMORIAL FORMATTING


ARTICLE IX: SUBMISSION OF FINAL VERSION OF MEMORIALS
Electronic documents submitted on the submission portal provided by the IC under Article VIII
clause (b) must be the final version and must contain no information or features other than those
required in these rules (e.g., no comments, track changes, etc.).
ARTICLE X: MEMORIAL STRUCTURE
(a) Each Memorial shall contain the following sections in the following order:
a. Front Page
b. Table of Contents
c. Statement of Relevant Facts

d. Statement of Jurisdiction
e. Questions Presented
f. Summary of Arguments
g. Arguments Advanced
h. Prayer/ Relief Sought
(b) Addition of any section other than those mentioned above (e.g. List of Abbreviations) or
reordering of the sections shall carry a penalty as provided under Rule 6.3.2.
ARTICLE XI: FONT AND SPACING
(a) Subject to paragraphs (b), (c) and (d) the text of all parts of the Memorial must be in Times
New Roman, font size 12 and double-spaced.
(b) Front page must be in Times New Roman, font size 16.
(c) Footnotes must be single-spaced, Times New Roman, font size 10.
(d) Headings and sub-headings throughout the Memorial may be in a different font size.
ARTICLE XII: ANONYMITY OF MEMORIALS
The name, JGU ID, batch, e-mail or any other personal identification factor of the participant
shall not be on any portion of the Memorial. Each participant will be given a unique identification
code, which shall substitute the participant’s name until the disclosure of the oral phase of the
Competition.
ARTICLE XIII: FORMATTING GROUNDS FOR PENALIZATION
Non-compliance with the formatting requirements will be penalized with a deduction of penalty
points from the Memorial pursuant to the Rules as provided under Rule 6.3.2.

PART V: STANDARDS FOR MEMORIAL DRAFTING


ARTICLE XIV: FRONT PAGE
The Front Page of the Memorial must have only the following information, which should be in
the following order (this information should be center aligned, in Times New Roman, font size
16, with normal page alignment except where stated otherwise) (refer to Annexure 1):
(a) In the top right-hand corner of the page, the Unique Identification Code allocated by the
IC followed by “P” (for a Petitioner Memorial) or “R” (for a Respondent Memorial) (e.g.
Participant 12 would put “12P” in the top right-hand corner of the Petitioner’s Memorial
cover page).
(b) The name of the Court
(c) The name and the year of the Competition
(d) The name of the Case

(e) The title of the document (i.e., “Memorial for Respondent” or “Memorial for Petitioner”)
ARTICLE XV: STATEMENT OF RELEVANT FACTS
(a) The Statement of Relevant Facts should be limited to facts relevant to the 'Arguments'
section in the Memorial, and may not include unsupported facts, distortions of stated facts,
argumentative statements, or legal conclusions.
(b) The Statement of Relevant Facts should be limited to 2 pages.
ARTICLE XVI: QUESTIONS PRESENTED
(a) In this section, participants should present the legal questions the Court is being called
upon to decide for the case. They must be presented as neutral questions, i.e. participants
should not state their position on the questions raised in this section.
(b) The questions must be precise, relevant to the facts and each question should ideally not
be more than a sentence. While each legal question might have further sub- questions,
participants must state only the main legal questions in this section. Usually, there are 3-5
main legal questions in every problem.
ARTICLE XVII: SUMMARY OF ARGUMENTS
A good Summary of Arguments should consist of a substantive summary of the “Arguments
Advanced” section of the Memorial as provided in Article XVIII, and not just a simple
reproduction of the headings contained in the Arguments section.
ARTICLE XVIII: ARGUMENTS ADVANCED
(a) Substantive, affirmative legal arguments, or legal interpretations of the facts of the Case
may only be presented in this section of the Memorial.
(b) The word limit for the Arguments Advanced section shall be 3200 words. This word limit
is inclusive of titles and subheadings. However, the word limit does not include footnotes.
(c) Clarifications
a. This word limit is only a maximum. Participants are free to maintain a word count
well below this if they feel they have completed their arguments to the fullest
possible extent within that amount.
b. This world limit is only for the “Arguments Advanced” section, and not for the entire
memorial.
ARTICLE XIX: FOOTNOTES & CITATIONS
(a) Participants must adhere to OSCOLA 4th Edition format which must remain consistent
throughout the written submission and always provide all relevant and necessary
information.

(b) It is not permitted to provide any information in the footnotes that is not related to the
identification of an authority or source. Speaking footnotes are not permitted.
Illustration: When citing an Article from the Indian Constitution, it is sufficient to state
the Article number in the footnote, according to the specifics of the chosen citation style.
It is not required or permitted to reproduce the Article in the footnote.
(c) Endnotes and in-text citations are not permitted.

PART VI: EVALUATION OF MEMORIALS


ARTICLE XX: GENERAL RULES FOR EVALUATION OF MEMORIALS
(a) Substantive assessment of each Memorial shall be conducted individually and
independently by judges.
(b) Every memorial will be marked on a maximum of 100 points by each judge.
(c) Negative points for penalties will be awarded in the manner detailed in Part VI.
ARTICLE XXI: SUBSTANTIVE SCORING
Each judge can award a maximum of 100 points and memorials will be judged based on the
following criteria:
(a) Proper Drafting and Argumentation, Clarity and Organization.
(b) Quality and extent of research: relevant treaties, customs, case laws, regional judgements,
academic writings etc.
(c) Use of Facts.
(d) Recognition of problem; correct, clear, and logical arguments.
(e) Correct legal analysis and its application to facts.
(f) Evidence of Original Thought.
(g) Grammar and style.
ARTICLE XXII: PROCEDURAL SCORING (PENALTIES)
(a) Non-compliance with rules concerning formatting and submission of Memorials will result
in a deduction from the points allotted by the judges. Irrespective of the actual penalties
incurred, no more than 30 points can be deducted for each Memorial for non-compliance
with procedural requirements. This limitation does not apply to penalties for late
submission under Rule 6.3.3.
Illustration I: X receives a penalty of 10 for footnotes, 5 for unnecessary information on
the front page, and 20 for late submission. The total penalty incurred by X is 35.

Illustration II: Y receives a penalty of 10 for footnotes, 5 for unnecessary information
on the front page, 20 for exceeding the word limit and 20 for late submission. The total
penalty incurred by Y is 50.

*Explanation: If the Arguments Advanced section has a word count greater than 3200 and lesser
than or equal to 3230 the penalty shall be 1 mark. If it has a word count greater than 3230 and
lesser than or equal to 3260 the penalty shall be 2 marks, and so on.
(c) Late Submission
a. The deadline for submission of Memorials will be as communicated by the IC.

b. If a participant fails to submit their Memorial by the deadline, a penalty of 5 points
shall apply for every 2 hours post the deadline. The 2-hour time period shall be
calculated from 12:01:00 AM onwards.
Explanation I: Submission at any time post 12:00:59 AM and before 2:00:59 AM on the
specified date will incur a 5-point penalty. Submission in the next 2-hour window will incur
a 10-point penalty, and so on.
Explanation II: To avoid a late submission penalty, both PDF and Word formats must
be submitted prior to the deadline specified. If either or both documents are submitted
late, the memorial shall be subject to penalties as specified above.
A participant who does not submit their memorial within 24 hours of the deadline will not
be eligible to participate in the Competition.
ARTICLE XXIII: INDUCTION INTO THE MOOT COURT SOCIETY
(a) The IC and the MCS Board shall jointly determine the number of slots available in the
MCS.
(b) Participants shall be inducted into the MCS based solely on their Memorial Score.
(c) Memorials shall be divided into multiple pools with each pool of memorials being
evaluated by a different faculty member. The number of pools shall depend on the number
of faculty members available to evaluate memorials.
(d) A uniform percentage of students will be selected from each pool.
Provided that, the IC reserves the right to select a higher number of students from any
pool in the event of a tie in the memorial score, or in the event an uneven number of slots
remain after dividing equally amongst the pools.
Illustration I: If 100 memorials have been submitted and 70 slots are available in the MCS,
these 100 memorials will be given to 10 Faculty with each evaluating 10 memorials. Those
candidates securing the top 7 positions out of the 10 will be allowed to participate in the
oral rounds. In this way 7 students from 10 different pools (totaling 70) will be selected.
Illustration II: If 100 memorials have been submitted and 72 slots are available in the
MCS, these 100 memorials will be given to 10 Faculty with each evaluating 10 memorials.
Those candidates securing the top 7 positions out of the 10 will be allowed to participate
in the oral rounds. In this way 7 students from 10 different pools (totaling 70) will be
selected. For the remaining 2 slots, the IC reserves the right to determine which pool(s) it
ought to be allotted to, based on the scores of Memorials in each individual pool.

PART VII: ORAL ROUNDS
ARTICLE XXIV: GENERAL RULES OF ORAL PLEADINGS
(a) Only participants inducted into the MCS based on the process detailed in Article XXIII
shall be eligible to participate in the Oral Pleadings.
(b) Oral Pleadings will be in English only. There will be no deviation from this language
requirement.
(c) All eligible participants must ensure that they are present during their oral round.
ARTICLE XXV: SCOPE OF ORAL ROUNDS
(a) All participants shall prepare oral pleadings for the side allocated to them.
(b) Each participant shall have 9 minutes (subject to change if the IC deems necessary) to
present their arguments, including time for answering questions from adjudicators. The IC
reserves the right to modify the time prior to the commencement of the oral pleadings.
(c) The IC has all legal rights to any and all recordings (if any) and dissemination of such
recordings whether audio, video, or other forms of recording which take place during the
present process.
ARTICLE XXVI: SCORING CRITERIA FOR ORAL ROUNDS
(a) Each oral pleading will be marked on a maximum of one hundred (100) points by each of
the judges.
(b) The final Oral Pleading score of each participant shall be the average of the score they
receive from each member of the judging panel.
ARTICLE XXVI-A: SUBSTANTIVE SCORING FOR ORAL ROUNDS
Each oralist can be awarded a maximum of one hundred (100) points per oral pleading based on
the following criteria:
(a) Knowledge and Use of Law;
(b) Answering Questions;
(c) Knowledge and Use of Facts;
(d) Persuasiveness, Forensic Performance, and Courtroom Conduct;
(e) Organization and Structure.

PART VIII: RANKINGS


ARTICLE XXVII: GENERAL PROCEDURE FOR RANKINGS
(a) Ranks shall be determined using the Final Score of participants, which shall be a
combination of the participants Oral Score and Memorial Score.
(b) The Oral Score used shall be the same as mentioned in Article XXVI clause (b).

(c) To calculate ranks, the raw Memorial score of participants (on the basis of which
participants were inducted into the MCS) shall not be used directly. Instead, the Percentile
system shall be employed.
ARTICLE XXVIII: THE PERCENTILE SYSTEM
(a) For the purpose of calculation of ranks, the Percentile system shall be employed to evaluate
Memorial scores.
(b) The Percentile system attempts to moderate scores across different pools of judges. In
order to do so, the following formula will be employed:
Memorial Percentile of X = (Memorial Score of X/Highest Score Provided to a Memorial
in the Pool) * 100
Illustration: X’s raw Memorial score is 70 out of 100. The highest score given in X’s pool

ARTICLE XXIX: FINAL CALCULATION
(a) The Final Score shall provide an 70% weightage to each participant’s Oral Score and a
30% weightage to each participant’s Memorial Percentile.
(b) The Final Score of each participant shall be calculated as follows:
Final Score of X = (Memorial Percentile of X * 0.3) + (Oral Score of X * 0.7) Illustration:
X’s Memorial Percentile is 87.5. X’s Oral Score is 90. X’s Final Score = (87.5 * 0.3) + (90
* 0.7) = 89.25
ARTICLE XXX: TIE-BREAKING
(a) In the event of a tie where two or more participants’ Final Score is equal, but Memorial
Percentile and Oral Score are differing, the participant(s) with the higher Oral Score shall
be given a higher rank.
(b) In the event of a tie where two or more participants’ Final Score, Oral Score, and Memo
Percentile are equal, the tie shall be broken by considering the higher score in the following
components of a participants Oral Score, in the order mentioned below:
1. Knowledge and Use of Law
2. Answering Questions
3. Knowledge and Use of Facts
4. Persuasiveness, Forensic Performance, and Courtroom Conduct
5. Organization and Structure
(c) In the event of a tie where two or more participants’ Final Score, Oral Score, Memo
Percentile, and each component of the Oral Score are equal, the participant with the higher
raw Memorial score shall be given a higher rank.

(d) In the event of a tie where two or more participants’ Final Score, Oral Score, Memo
Percentile, each component of the Oral Score, and raw memo score is equal, a coin toss
or other suitable method of randomization shall be applied to determine the rank provided.
