LAWS4063A: ADMINISTRATIVE LAW WORKSHEET FOR TOPICS 2 & 4: ADMINISTRATIVE ACTION & LAWFULNESS ‘The content of this worksheet will be discussed in the lecture on 29 March. Question 4 [15 marks] Indicate whether the following items would qualify as ‘administrative action’ in terms of the Promotion of Administrative Justice Act. Give reasons for your answers. (You may reasonably write ‘more about some items than others, but you must cover all three.) a) An application for a disability grant from the Gauteng Department of Welfare. b) Adecision by Wits University to suspend a student pending the outcome of a disciplinary enquiry. ©) A decision of the Sandton Cake Decorators’ League to expel one of its members. Question 2 [10 marks] The Department of Education is looking to fund a new University which will provide free, quality, decolonised education to tertiary students. It requested, among other things, that all apf submit a robust and detailed curriculum plan to ensure that the funding does not go to an institution which will continue to teach the same content currently taught in mainstream Universities. Furthermore, the Decoloniality Act 1 of 2020 makes such consideration of the curriculum mandatory in tendering or providing funding. When the Department looks at the application of one Azania University, it rejects the University's application on the basis that many of the lecturers who will be teaching come from mainstream institutions. No mention is made by the Department of the curriculum proposed by Azania University. ‘Assuming administrative action is present, advise Azania University on the grounds of review that they may employ (also mention the overlap of applicable grounds where relevant) in challenging this decision.
