:LARGER PROPERTY :
(Description of Entire Property)
All that Property measuring
1) 1 Acre 03 Guntas in by.No.32, duly converted for non- agricultural
residential purposes vide order of The Special Deputy
Commissioner, Bangalore District, Bangalore, bearing No. BDIS. ALN.
(E)VB/SR.264/ 2004-05 dated l 6-02-2006/ 3 1-03-2006.
B. Further, the said Lingappa vide sale deed dated 15/03/1948, resold the
property in Sy No. 33/1, measuring an extent of 4 Acres and 23 guntas in
favour of Gundappa S/o Chenna Reddy, registered as document No.
4532/1947-48, of Book No. 1, Volume No. 978, in page nos. 1 to 3.
C. Further, the said Gundappa S/o Channa Reddy vide sale deed dated
27/04/1956, resold the property in Sy No. 33/1, measuring an extent of
4 Acres and 23 guntas in favour of Lingappa, registered as document No.
671/1956-57, of Book No. 1, Volume No. 1530, in page nos. 143 to 144.
D. It appears that vide the sale deed dated 12.06.1959, Sri Lingappa
conveyed the entire extent of 4 Acres and 23 Guntas of the property in
Sy No. 33/1 favour of Sri Shamanna Reddy and Sri Chinnaswamy Reddy,
registered as Document No. 1270/1959-60, of Book No. 1, Volume No.
177, Page Nos. 68 to 71, registered at the office of, Sub-registrar
Bangalore South Taluk.
E. Subsequently vide sale deed dated 31.12.1959, Sri Shamanria Reddy and
Sri Chinnaswamy Reddy conveyed the above property in favour of Sri
A.G. Narayana Reddy, registered as document No. 4495/1959-60,
Volume No. 150, Page Nos. 236 to 238, registered at the office of Sub-
registrar Bangalore South Taluk.
K. Further, the said Sri. Nanja Reddy, Sri. Chinnaswamy Reddy and Sri.
Shamanna Reddy, applied for the conversion of the land in Sy. No. 33/1
to a total extent of 4 acres and 26 guntas, before the Special Deputy
Commissioner, Bangalore District, and got the aforementioned property
form Agricultural purposes to Residential purposes vide Order dated
16.10.1992 bearing Order No. B.DIS.ALN.SR(S): 2/1992-93.
Sy.No.33/3:
D. The said Doddanna Reddy applied for the conversion of Land in Sy. No.
33/2 from agricultural purpose to Residential purpose and subsequently
on 28/07/2003, the Deputy Commissioner, Bangalore vide Order No:
B.Dis/ALN(E)VB/SR/228/2003-04, allowed the application of the said
Doddanna Reddy and issued the certificate of conversion of land from
Agricultural purpose to Residential Purpose.
Sy.No.33/3 :
A. Likewise, another portion of the Property in Sy. No.33/3 belonging to K.
G. Narasimha Reddy measuring an extent of 3 Acres is held by the family
members of K. G. Narasimha Reddy. In view of the death of K. G.
Narasimha Reddy on 06.06.2010, his wife Smt. Neelamma and their only
son Venkatesh Reddy have succeeded to the deceased’s estate and got
the katha and other revenue documents mutated in the name of
Venkatesh Reddy. The same is evident through Katha Certificate dated
13.l I .2013.
B. Later Smt. Neelamma and her son Venkatesh Reddy have decided to
develop the schedule property into residential apartment and in view of
the same they entered into joint Development Agreement on
19.02.2015 with M/s. Bren Corporation (formerly known as M/s. SJR
Enterprises), a Proprietary Concern, duly represented by its Proprietor
Mr. J. Boopesh Reddy, registered as document No. 3927/2014-15,
registered at the office of Sub-Registrar, Shivajinagar, Bangalore. In the
said agreement it is agreed that the owners allotted the builder to
develop the schedule property and further the Builder shall retain 80%
of the super built-up area and the respective owners that is Smt.
Neelamma and Mr. Venkatesh Reddy shall retain remaining 20%.
C. In view of the share allotted to the builder, the said Smt. Nellamma and
Mr. Venkatesh Reddy executed a General Power of Attorney on
19.02.2015 in appointing M/s Bren Corporation, registered as
document No.491/2014-15 in the office of Sub-registrar, Shivajinagar,
Bangalore. By virtue of the aforementioned GPA the property in Sy No.
33/2 measuring an extent of 3 Acres fell in the possession of M/s Bren
Corporation.
D. The said Mr. Venkatesh Reddy had applied for the conversion of the land
in Sy No. 33/3 measuring an extent of 3 acres to be converted from
agricultural purpose to residential purpose. Subsequently, the Special
Deputy Commissioner, Bengaluru, vide order No. B.DIS.ALN.SR(S)/2/92-
93 and issued the certificate for conversion of the land in Sy. No. 33/3
measuring an extent of 3 acres from agricultural land to residential
land.
E. The said Smt. Neelamma and her son Venkatesh Reddy entered into a
Sharing Agreement dated 31.10.2015, with M/s. Bren Corporation
represented by its Proprietor Mr. J. Boopesh Reddy. By virtue of the said
Sharing Agreement the parties of the said agreement identified the flats
falling to their respective shares.
G. Subsequently the Smt. Neelamma and Mr. Venkatesh Reddy and M/s
Bren Corporation entered into an Allocation agreement dated
31.10.2015 and identified the apartments falling into their respective
shares.
K. Further, in accordance with the share allotted to the builder the owners
executed a registered General Power of Attorney dated 26.04.2014 and
appointed M/s. Bren Corporation duly represented by its Proprietor Mr.
J. Boopesh Reddy, registered as document No. 36/2014-15 in the office
of Senior Sub-registrar, Shivajinagar, Bangalore, in respect of property in
Sy. No. 32 measurin g1 Acre and 3 Guntas, Sy. No. 35 measuring 1 Acre
and 20 Guntas, Sy. No. 46 measuring 3 Acres and 12 Guntas and Sy. No.
33/1 measuring 4 Acres and 23 Guntas. By virtue of the aforementioned
GPA dated 26.04.2014, M/s. Bren Corporation duly represented by its
Proprietor Mr. J. Boopesh Reddy acquired the possession of the
Schedule property.
Q. Further I am of the opinion that Mr. Rahul Narayana Shetty (to an extent
of property measuring 4 acres 23 guntas), Mr. Sunderam Shetty (5 acres
35 guntas however the extent is covered for the entire project and same
area belonging to him is not covered in the Block-1, However he has
been allotted with some apartments to his share and the same is evident
in the Sharing Agreement, therefore he has been made a party to the
agreement of sale). Mr. J. Boopesh Reddy (Property measuring 3 acres 2
guntas) Smt. Neelamma and her son Venkatesh Reddy (property
measuring 3 acres) have got absolutely clear marketable title on the
property in question and they can sell flat/s in favour of prospective
Purchaser/s.
