Sy.No.33/1:

A. Originally land measuring 4 acres 26 guntas in Sy. No. 33/1, situated at


Kasavanahalli Village, Vartur Hobli, Bangalore South Taluk was owned
and possessed by Sri Lingappa. The said Lingappa acquired the same by
virtue of Sale Deed dated 04/07/1956, executed by Sri Gundappa S/o
Chenna Reddy in favour of Lingappa S/o Appaiahanna, registered as
document No. 136/1946/47, of Book No- 1, Volume No: 842, stored in
Page Nos. 49 to 51.

B. Further, the said Lingappa vide sale deed dated 15/03/1948, resold the
property in Sy No. 33/1, measuring an extent of 4 Acres and 23 guntas in
favour of Gundappa S/o Chenna Reddy, registered as document No.
4532/1947-48, of Book No. 1, Volume No. 978, in page nos. 1 to 3.

C. Further, the said Gundappa S/o Channa Reddy vide sale deed dated
27/04/1956, resold the property in Sy No. 33/1, measuring an extent of
4 Acres and 23 guntas in favour of Lingappa, registered as document No.
671/1956-57, of Book No. 1, Volume No. 1530, in page nos. 143 to 144.
D. It appears that vide the sale deed dated 12.06.1959, Sri Lingappa
conveyed the entire extent of 4 Acres and 23 Guntas of the property in
Sy No. 33/1 favour of Sri Shamanna Reddy and Sri Chinnaswamy Reddy,
registered as Document No. 1270/1959-60, of Book No. 1, Volume No.
177, Page Nos. 68 to 71, registered at the office of, Sub-registrar
Bangalore South Taluk.

E. Subsequently vide sale deed dated 31.12.1959, Sri Shamanria Reddy and
Sri Chinnaswamy Reddy conveyed the above property in favour of Sri
A.G. Narayana Reddy, registered as document No. 4495/1959-60,
Volume No. 150, Page Nos. 236 to 238, registered at the office of Sub-
registrar Bangalore South Taluk.

F. Subsequently A. G. Narayana Reddy by vide sale deed dated 24.O4.1972,


resold the property in Sy. No. 33/1, measuring an extent of 4 acres 23
Guntas if favour of Sri Nanja Reddy, Sri Chinnaswamy Reddy and Sri
Shamanna Reddy, all children of Sri Doddanna Reddyide, registered as
document No.627/1972-73 at the office of Sub- Registrar Bangalore
South Taluk. After acquiring the property in Sy. No. 33/1, measuring 4
acres 23 guntas, in the aforementioned manner, the purchasers i.e., Sri
Nanja Reddy, Sri Chinnaswamy Reddy and Sri Shamanna Reddy were in
enjoyment of the said property as absolute owners.

G. Further it is observed that, Sri. Nanja Reddy, Sri. Chinnaswamy Reddy


and Sri. Shamanna Reddy, distributed the property in Sy. No. 33/1, to an
extent of 4 acres 26 Guntas the same is evident vide M R No: 16/1993-
94 in the following manner:

a. Share allotted in the name of Sri. Nanja Reddy:- 2 Acres and 1


Gunta.

b. Share allotted in the name of Sri. Chinnaswamy Reddy:- 21


Guntas.

c. Share allotted in the name of Sri. Shamanna Reddy:- 2 Acres and 1


Gunta.

In view of M. R No. 16/1993-94, the Sri. Nanja Reddy, Sri. Chinnaswamy


Reddy and Sri. Shamanna Reddy got the Khatha and other revenue
documents mutated in their names respectively. The said children of Sri.
Doddanna Reddy, i.e., the allottees in this came to be in the possession
and enjoyment of the aforementioned properties respectively ever
since. The same is evident from RTC produced for the period 1994-95 to
2014-15.

H. Subsequently Shri. Shamanna Reddy along with his children i.e.,


Chandrappa Reddy, Rajappa, Ramesh, Prakash and Nirmala alias
Ankamma on 08/03/1992, executed an Agreement of Sale in favour of
Mrs. Saroja Vasanth W/o Sri. Vasanth in respect of property in Sy No.
33/1 measuring an extent of 2 acres and 1 gunta.

I. Subsequently Shri. Chinnaswamy Reddy along with his children i.e.,


Ananda Reddy, Smt. Neelamma, Smt. Vanajamma and Premakumari
alias Baby on 08/03/1992, executed an Agreement of Sale in favour of
Mrs. Saroja Vasanth W/o Sri. Vasanth in respect of property in Sy No.
33/1 measuring an extent of 21 guntas.

J. Subsequently Shri. Nanja Reddy along with his children i.e.,


Chinnakeshawa, Kanthamma and Renuka on 08/03/1992, executed an
Agreement of Sale in favour of Mrs. Saroja Vasanth W/o Sri. Vasanth in
respect of property in Sy No. 33/1 measuring an extent of 2 acres and 1
gunta. It is pertinent to mention her that by virtue of the
aforementioned Sale Agreements dated 08.03.1992, Smt. Saroja Vasanth
was under the possession of property in Sy. No. 33/1 to a total extent of
4 Acres 23 Guntas.

K. Further, the said Sri. Nanja Reddy, Sri. Chinnaswamy Reddy and Sri.
Shamanna Reddy, applied for the conversion of the land in Sy. No. 33/1
to a total extent of 4 acres and 26 guntas, before the Special Deputy
Commissioner, Bangalore District, and got the aforementioned property
form Agricultural purposes to Residential purposes vide Order dated
16.10.1992 bearing Order No. B.DIS.ALN.SR(S): 2/1992-93.

L. Subsequently, by virtue of the Sale Agreements dated 08.03.1992, on


18.11.1993, Smt. Saroja Vasanth entered into 5 Assignment Agreements
with Mr. Prasanna Kumar Shetty in respect if the properties in Sy. No.
33/1 measuring extents of 1 Acre, 1 Acre 1 Gunta, 21 Guntas, 1 Acre and
1 Acre 1 Gunta respectively. It is observed that the said Mr. Prasanna
Kumar Shetty was nominated in the aforementioned manner, the land
measuring a total extent of 4 Acres and 23 Guntas as a Purchaser and to
develop the same.

M. It is observed that Sri. Nanja Reddy on 27.01.1995 executed a General


Power of Attorney in favour of the aforementioned Mr. Prasanna Kumar
Shetty in respect of property in Sy. No. 33/1 measuring an extent of 2
Acres and 1 Gunta, vide Document No. 1423/1994-95, of Book No. IV
and handed over the possession of the said property to Mr. Prasanna
Kumar Shetty. Further, Sri. Chinnaswamy Reddy, on 27.01.1995
executed a General Power of Attorney in favour of the aforementioned
Mr. Prasanna Kumar Shetty in respect of property in Sy. No. 33/1
measuring an extent of 21 Guntas, vide Document No. 1424/1994-95, of
Book No. IV and handed over the possession of the said property to Mr.
Prasanna Kumar Shetty. Further, on 30.03.1995 Sr i. Shammanna Reddy,
executed a Notorised General Power of Attorney in favour of the
aforementioned Mr. Prasanna Kumar Shetty in respect of property in Sy.
No. 33/1 measuring an extent of 2 Acres and 1 Gunta and handed over
the possession of the said property to Mr. Prasanna Kumar Shetty. By
virtue of the Assignment Agreements dated 08.03.1992 and
subsequently the General Power of Attorneys dated 27.01.1995 and
30.03.1995, the said Mr. Prasanna Kumar Shetty came to be in the
possession of the Property iin Sy. No. 33/1 measuring a total extent of 4
Acres and 23 Guntas.

N. It is further observed that, Sri. Nanja Reddy, Sri, Chinnaswamy Reddy


and Sri. Shamanna Reddy all children of Sri. Doddanna Reddy,
represented by their GPA holder Mr. Prasanna Shetty @ Mr. Prasanna
Kumar Shetty executed a Sale Deed dated 15.02.2012 in favour of Mr.
Rahul Nrayana Shetty S/o Mr. Prasanna Kumar Shetty vide Document
No. 2410/2011-12, of Book NO. I, stored in C. D No: SHVD141, registered
at the office of Sub registrar Shivajinagar, Bangalore, in respect of the
property in Sy. No. 33/1, measuring a total extent of 4 Acres and 23
Guntas. By the virtue of the aforementioned Sale Deed dated
15.02.1992 Mr. Rahul Narayana Shetty S/o Mr. Prasanna Kumar Shetty
acquired the ownership and title of property in Sy. No. 33/1, measuring
a total extent of 4 Acres and 23 Guntas and subsequently got the
revenue documents mutated to his name.

O. Survey Sketch, Akarbaridh, Tippani Report confirms the extent and


measurement of the aforementioned property. Further, the
Endorsement issued by the Tahsildar, Bangalore South Taluk confirms
the fact that there are no tenancy claims with regard to Sy.No.33/1 and
the Encumbrance Certificate produced for the period 01.04.1958 to
31.10.2015 the above stated reflects all the aforementioned
transactions.

Sy.No.33/3:

A. Originally as per the terms of the Settlement Deed dated 22.07.1963


arrived between Sri Lakshmaiah Reddy S/o Giddanna Reddy and Smt.
Narasamma W/o Lakshmaiah Reddy, property measuring 4 acres 28
guntas of dry land, 1 acre 24 guntas of wet land totally measuring an
extent of 6 acres 02 Guntas was allotted to Smt. Narasaamma,
registered as document No.2088/1963-64 at the office of Sub-registrar,
Bangalore South Taluk, Bangalore. In pursuance of the Settlement Deed
Smt. Narasamma was put in the possession and occupation of the said
property. The RTCs’ produced covering the period 1909-70 to 2002-O3
reflects the name of Smt. Narasamma and she has been in possession
and enjoyment of the same as absolute owner.

B. Subsequently it is observed that Smt. Narasamma died intestate leaving


behind her children K. G. Munireddy, K. G. Narasimha Reddy, K. G.
Doddanna Reddy, K. G. Prabhakar Reddy and K. G. Kodandarama
Reddy. Subsequently all the family members effected the partition as
per the terms of the Partition Deed dated 07.11.2002. The said Partition
Deed was duly registered as document No.9926/2002-03 in the office of
Sub-registrar, Bangalore South Taluk, Bangalore. In terms of the said
partition property in Sy. No. 33/2 was allotted in the following manner:

a. Share allotted in the name of Sri. K. G Narasimha Reddy:- 3 Acres


and 30 Feet road .

b. Share allotted in the name of Sri. K. G Doddanna Reddy:- 3 Acres.

In the above said partition it is revealed along with Sy.No›.33/ 2 other


survey numbers were also divided which was belonging to the said HUF.
In pursuance of the partition khatha of the above property got mutated
in the names of the respective parties vide MR No: 26/2003-04

C. By virtue of Partition Deed dated 07.11.2002, property in Sy. No.33/2


was phodied by the Department of Survey and property belonging to K.
G. Doddanna Reddy was assigned with a New Sy. No.33/2 measuring 3
Acres and 2 Guntas and for property measuring 3 Acres belonging to K.
G. Narsimha Reddy a New Sy. No. 33/3 was allotted respectively. By
virtue of MR No. 31/2003-04 the revenue documents such as the Katha
and the RTC got mutated and recorded in the names of respective K. G.
Doddanna Reddy and K. G. Narasimha Reddy.

D. The said Doddanna Reddy applied for the conversion of Land in Sy. No.
33/2 from agricultural purpose to Residential purpose and subsequently
on 28/07/2003, the Deputy Commissioner, Bangalore vide Order No:
B.Dis/ALN(E)VB/SR/228/2003-04, allowed the application of the said
Doddanna Reddy and issued the certificate of conversion of land from
Agricultural purpose to Residential Purpose.

E. Thereafter it is observed that K. G. Doddanna Reddy died intestate


leaving behind his wife Smt. Parijathamma and his children Girish Reddy
and Harish Reddy. Soon after the death of K. G. Doddanna Reddy, Smt.
Pairijathamma and her children Girish Reddy and Harish Reddy,
executed a registered Sale Agreement dated 21.03.2012 in favour Mr.
Sundaram Shetty, registered as document No.2781/2011-12 in the office
of Sub-Registrar, Shivajinagar, Bangalore. Later through Sale Deed dated
23.O5.2012 Smt. Parijathamma and her children Girish Reddy and
Harish Reddy as vendors along with their Agreement Holder Mr.
Sunderam Shetty as confirming party conveyed property measuring 3
acres 2 guntas in Sy.No.33/ 2 in favour of Sri J. Boopesh Reddy,
registered as document No.731/2012-13 in the office of Sub-registrar,
Indiranagar, Bangalore.
F. In pursuance of the sale deed dated 23.05.2012 and as the schedule
property is situated within the revenue administrative jurisdiction of
BBMP, the above property got transferred and mutated in the name of
Sri J. Boopesh Reddy and the same is evidenced through Katha Extract &
Certificate dated 22.09.2012 issued by BBMP, Bangalore. Survey Sketch,
Akarbandh, Tipni Report confirms the extent and measurement of the
aforementioned property. Further, the endorsement issued by the
Tahsildar, Bangalore South Taluk confirms the fact that there are no
tenancy claims with regard to Sy. No.33/2 and Encumbrance Certificate
produced for the period of 01.04.1961 to 31.10.2015 reflect all the
transactions as stated above.

Sy.No.33/3 :
A. Likewise, another portion of the Property in Sy. No.33/3 belonging to K.
G. Narasimha Reddy measuring an extent of 3 Acres is held by the family
members of K. G. Narasimha Reddy. In view of the death of K. G.
Narasimha Reddy on 06.06.2010, his wife Smt. Neelamma and their only
son Venkatesh Reddy have succeeded to the deceased’s estate and got
the katha and other revenue documents mutated in the name of
Venkatesh Reddy. The same is evident through Katha Certificate dated
13.l I .2013.

B. Later Smt. Neelamma and her son Venkatesh Reddy have decided to
develop the schedule property into residential apartment and in view of
the same they entered into joint Development Agreement on
19.02.2015 with M/s. Bren Corporation (formerly known as M/s. SJR
Enterprises), a Proprietary Concern, duly represented by its Proprietor
Mr. J. Boopesh Reddy, registered as document No. 3927/2014-15,
registered at the office of Sub-Registrar, Shivajinagar, Bangalore. In the
said agreement it is agreed that the owners allotted the builder to
develop the schedule property and further the Builder shall retain 80%
of the super built-up area and the respective owners that is Smt.
Neelamma and Mr. Venkatesh Reddy shall retain remaining 20%.

C. In view of the share allotted to the builder, the said Smt. Nellamma and
Mr. Venkatesh Reddy executed a General Power of Attorney on
19.02.2015 in appointing M/s Bren Corporation, registered as
document No.491/2014-15 in the office of Sub-registrar, Shivajinagar,
Bangalore. By virtue of the aforementioned GPA the property in Sy No.
33/2 measuring an extent of 3 Acres fell in the possession of M/s Bren
Corporation.

D. The said Mr. Venkatesh Reddy had applied for the conversion of the land
in Sy No. 33/3 measuring an extent of 3 acres to be converted from
agricultural purpose to residential purpose. Subsequently, the Special
Deputy Commissioner, Bengaluru, vide order No. B.DIS.ALN.SR(S)/2/92-
93 and issued the certificate for conversion of the land in Sy. No. 33/3
measuring an extent of 3 acres from agricultural land to residential
land.

E. The said Smt. Neelamma and her son Venkatesh Reddy entered into a
Sharing Agreement dated 31.10.2015, with M/s. Bren Corporation
represented by its Proprietor Mr. J. Boopesh Reddy. By virtue of the said
Sharing Agreement the parties of the said agreement identified the flats
falling to their respective shares.

F. Survey Sketch, Akarbandh, Tipni Report confirms the extent and


measurement of the land in Sy. No. 33/3. Endorsement issued by the
Tahsildar Bangalore South Taluk confirms the fact that there are no
tenancy claims with regard to Sy. No. 33/ 3. Further, the Encumbrance
Certificate produced for the period 01.04.1961to 31.l0.2015 the
above stated sale transactions are reflected.

G. Subsequently the Smt. Neelamma and Mr. Venkatesh Reddy and M/s
Bren Corporation entered into an Allocation agreement dated
31.10.2015 and identified the apartments falling into their respective
shares.

H. Subsequently with an intent to construct residential apartment on the


said property in Sy. No. 33/3 M/s Bren Corporation approached BBMP
and obtained Sanction Plan and License vide LP.No.0448/2015-16 dated
25.11.2015 for construction of Blocks-I Wing 1, 2, 3, 4.

I. It is observed that, Mr. Sundaram Shetty, Mr. Rahul Narayana Shetty,


Mr. Venkatesh Reddy and Mr. Boopesh Reddy executed an
Amalgamation Deed amongst themselves dated 24.12.2014.

J. With as intention to develop the schedule property into residential


apartment Mr. Rahul Narayana Shetty along with adjacent property
owner Mr. Sunderam Shetty entered in to Joint Development
Agreement on 26.04. 2014 with M/ s. Bren Corporation (formerly known
as M/ s. SJR Enterprises), a Proprietary Concern, duly represented by its
Proprietor Mr. J. Boopesh Reddy, The said JDA was duly registered as
document No. 241/14- 15 in the office of Senior Sub-registrar,
Shivajinagar, Bangalore, in respect of property in Sy. No. 32 measurin g1
Acre and 3 Guntas, Sy. No. 35 measuring 1 Acre and 20 Guntas, Sy. No.
46 measuring 3 Acres and 12 Guntas and Sy. No. 33/1 measuring 4 Acres
and 23 Guntas. In the said agreement is it revealed owners empowered
the builder to develop the Schedule property and further that they will
transfer 62% of the super built up area in favour of the builder and
owners have decided to retain remaining 38% for themselves.

K. Further, in accordance with the share allotted to the builder the owners
executed a registered General Power of Attorney dated 26.04.2014 and
appointed M/s. Bren Corporation duly represented by its Proprietor Mr.
J. Boopesh Reddy, registered as document No. 36/2014-15 in the office
of Senior Sub-registrar, Shivajinagar, Bangalore, in respect of property in
Sy. No. 32 measurin g1 Acre and 3 Guntas, Sy. No. 35 measuring 1 Acre
and 20 Guntas, Sy. No. 46 measuring 3 Acres and 12 Guntas and Sy. No.
33/1 measuring 4 Acres and 23 Guntas. By virtue of the aforementioned
GPA dated 26.04.2014, M/s. Bren Corporation duly represented by its
Proprietor Mr. J. Boopesh Reddy acquired the possession of the
Schedule property.

L. Subsequently with an intention to share the Super Built-up area of


schedule property Mr. Rahul Narayana Shetty along with adjacent
property owner Mr. Sunderam Shetty entered in to a registered
Supplemental Joint Development Agreement on 30.10.2015 with M/ s.
Bren Corporation (formerly known as M/ s. SPR Enterprises), a
Proprietary Concern, duly represented by its Proprietor Mr. J. Boopesh
Reddy, registered as document No. 3480/2015-16 in the office of Senior
Sub-registrar, Shivajinagar, Bangalore, in respect of property in Sy. No.
32 measuring 1 Acre and 3 Guntas, Sy. No. 35 measuring 1 Acre and 20
Guntas, Sy. No. 46 measuring 3 Acres and 12 Guntas and Sy. No. 33/1
measuring 4 Acres and 23 Guntas. Further on the same day the
aforementioned Mr. Rahul Narayana Shetty along with Mr. Sunderam
Shetty entered in to a registered Genral Power of Attorney on
30.10.2015 with M/ s. Bren Corporation (formerly known as M/s. SJR
Enterprises) and appointed M/s Bren Corporation as the Attorney holder
for Development and Sale of the Schedule property, registered as
Document No. 373/2015-16. Subsequently, to the same effect Mr.
Sundaram Shetty, Mr. Rahul Narayana Shetty, Smt. Neelamma, Mr.
Venkatesh Reddy and Mr. Boopesh Reddy and BREN Corporation
entered into an Allocation agreement dated 31.10.2015.

M. Further the aforementioned Mr. Sundaram Shetty, Mr. Rahul Narayana


Shetty, Smt. Neelamma, Mr. Venkatesh Reddy and Mr. Boopesh Reddy
executed a relinquishment deed dated 31.10.2013 in favour of
Bangalore Development Authority, registered as Document No.
2235/2013-14, of Book No. 1, Stored in C D No: BDAD196 and
relinquished their rights, free of cost over Parks, Open spaces and
proposed RMP-2015, as per the Residential Development Plan.

N. Subsequently, M/s Bren Corporation, the GPA holder of Mr. Sundaram


Shetty, Mr. Rahul Narayana Shetty, Smt. Neelamma, Mr. Venkatesh
Reddy and Mr. Boopesh Reddy, in respect of in respect of property in Sy.
No. 32 measuring 1 Acre and 3 Guntas, Sy. No. 35 measuring 1 Acre and
20 Guntas, Sy. No. 46 measuring 3 Acres and 12 Guntas and Sy. No. 33/1
measuring 4 Acres and 23 Guntas, applied for Non-objection certificates
BWSSB, BSNL and the Airport Authority and the said authorities issued
their Non-objection certificates for construction and development of
residential Apartment at in respect of property in Sy. No. 32 measuring 1
Acre and 3 Guntas, Sy. No. 35 measuring 1 Acre and 20 Guntas, Sy. No.
46 measuring 3 Acres and 12 Guntas and Sy. No. 33/1 measuring 4 Acres
and 23 Guntas.

O. Further, M/s Bren Corporation received Construction license and


Environmental clearance certificate and started with carrying out their
construction activities.

P. Thus in view of the foregoing it is unequivocally clear that the Schedule


property belongs to Mr. Rahul Narayan Sghetty, Mr. Sundaram Shetty,
Mr. J. Boopesh Reddy, Smt. Neelamma and her son Mr. Venkatesh
Reddy. No minor’s interests are forthcoming and no registered
encumbrances or charges are seen. There are no legal impediments by
way of any laws or regulations etc which bar the owners to sell the
property.

Q. Further I am of the opinion that Mr. Rahul Narayana Shetty (to an extent
of property measuring 4 acres 23 guntas), Mr. Sunderam Shetty (5 acres
35 guntas however the extent is covered for the entire project and same
area belonging to him is not covered in the Block-1, However he has
been allotted with some apartments to his share and the same is evident
in the Sharing Agreement, therefore he has been made a party to the
agreement of sale). Mr. J. Boopesh Reddy (Property measuring 3 acres 2
guntas) Smt. Neelamma and her son Venkatesh Reddy (property
measuring 3 acres) have got absolutely clear marketable title on the
property in question and they can sell flat/s in favour of prospective
Purchaser/s.
