Consular Officers, however, are usually associated with “Low Politics”. Largely in

In conclusion, Diplomatic Officers are the very representative of the SS and are
concerned with State-to-State transactions, whereas Consular Officers on the other
hand are more localized in that they are concerned with performing duties for the
overseas citizens regarding their legal needs, duties, and other government
proceedings.

2. In the movie ARGO, describe as many as you can the VIOLATIONS committed
against DIPLOMATIC LAW.
Having watched the movie Argo (2012), the Violations committed against Diplomatic
Law are as follows:
Diplomatic Immunity
- Diplomats throughout the Iranian Hostage Crisis depicted in Argo were
stripped of their protection from Judicial or Executive Enforcement. The entire
Diplomatic Mission were held hostage and denied of any Immunity as per
Diplomatic Law.
Extraterritoriality
- The US Embassy was stormed by militants and took 66 Americans hostage.
This is a direct violation of the Embassy’s enclave in Iran, as it is quite literally
foreign soil within Iran.
Inviolability of Records, and etc.
- The US Embassy after having been infiltrated and seized, has then been
thoroughly dissected from records. As seen in Argo, shredded documents
were pieced together for their political advantage, and was even used to
expose the identities of the six that managed to escape being held hostage.
This is a direct violation of the Inviolability of the US Embassy’s data and
records.
Inviolability and Immunity of Premises and Property
- In addition to Extraterritoriality, it is seen through the movie Argo that the very
premises of the US Embassy has been seized by the militants, and as such is
a showcase of how it is no longer inviolable and immune from any action from
the Receiving State.
Freedom and Inviolability of Communications
- In lieu of the aggravating political situation within Iran, communication
between Diplomats held hostage and in hiding was greatly limited. As such,
there was a great limitation in ensuring the safety of the six and the hostages,
which directly violates the inviolability of communications by and between the
US and the seized US Embassy of Iran.

Functional Immunities are granted to the Diplomatic Mission and its staff as they
are needed for them to perform their duties without hindrance. As such, the Nature of
Functional Immunities are that they are in the favor of both the RS and SS as it grants
the involved individuals the freedom to exercise their responsibilities and obligations
without restriction. Moreover, I believe it is paramount that we understand that no
culture is exactly the same between states, as such there are varying differences in
practices amongst diplomats throughout the world. It is paramount that they are
provided the freedom to enact their own culture as they are the very representative of a
certain state. In essence, Immunities grant Diplomats the privilege to fully-represent
their States. With this, it can be understood that Immunities serve to protect diplomats in
that it grants them access to actually be walking embodiments of the State they
represent.
However, while on paper Immunities serve the interest of both the SS and the
RS, it can also be subject to misuse. The effects of Immunities is that they can provide
Diplomats with too much freedom, and can leave this privilege to be overused. Although
it is still arguable that such is not always the case. Moreover, Immunities can also be
subject to various loopholes in that it can provide multiple advantages to the Diplomats
in that their duties on national interests can be clouded with their own personal
interests. However, it is also important to note that Immunities also have non-adverse
effects in that it is able to preserve national interest and can safeguard the concerns of
both the SS and RS respectively.

(a.) DISTINGUISH Diplomatic Privilege from Diplomatic Immunity, with
appropriate EXAMPLES of each.
Diplomatic Privileges and Diplomatic Immunities are usually intertwined, but they
too can be differentiated from each other. As such, in simpler words the former
(Privileges) can be attributed to “exemption”, while the latter (Immunities) can be
attributed to “protection”. For example, full DPIs are granted to Diplomats and their
families. This is an exemplification of exemptions provided not only to the diplomat, but
also to his/her family, and as such is a Privilege. Another example is the Inviolability of
Records. This is an Immunity for it serves to protect the assets of the Diplomatic
Mission from any potential harm that the data can serve for the Diplomatic Staff or the
interests of the SS. In conclusion, the Privileges and Immunity differ in that they carry
out a different objective from each other for the Diplomatic Mission and its staff.
