Municipal Ordinance No. 23–2017

 The 20th Sangguniang Bayan of Bue-
navista, Agusan del Norte, enacted Municipal
Ordinance (MO) No. 23 – 2017 entitled
“IMPOSING CURFEW ON MINORS IN THE
MUNICIPALITY OF BUENAVISTA, AGUSAN
DEL NORTE, PROVIDING PENALTY FOR PAR-
ENTS FOR TOLERANCE OR NEGLECT, AND
FOR OTHER PURPOSES
 Sections 3, 10 & 11 of M.O. No. 23 –
2017 provide, inter-alia, that minors are
strictly prohibited to roam about town, more
particularly in public places, from ten o’clock
in the evening to four o’clock in the morning
(10:00 PM—4:00 AM); that it shall be the
“moral” & “legal” duty of the punong
barangay, sangguniang barangay members
& lupong tagapamayapa to ensure the strict
implementation of the ordinance & the
Sangguniang Brgy may deputize the Baran-
gay Tanods in their jurisdiction in the imple-
mentation of this ordinance, respectively...

Bueanavista, Agusan del Norte enact-
ed Municipal Ordinance (MO) No. 26
– 2017 entitled “PROHIBITING THE
SALE OF LIQOURS ON MINORS,
PROVIDING PENALTY THEREFORE,
AND OTHER PURPOSES”
 Sections 5 and 6 of M.O. No. 26
– 2017 provide, inter-alia, that it
shall be the “unlawful for any minor
to: (a) Drink liquor in any public or
private establishment; (b) Purchasein
any manner liquors for his benefit or
for the benefit of others” and that “the
following acts are also prohibit-
ed…(a) Any person who helps or
abets minors in the commission ofthe
preceding section; (b) Any person who
distributes liquors to minors

ploitation & Discrimination Act"
 R.A. 7610 provides in ART. III Child
Prostitution & Other Sexual Abuse, Sec 5.
Child Prostitution and Other Sexual Abuse. –
Children, whether male or female, who for
money, profit, or any other consid-eration or
due to the coercion or influence of & adult,
syndicate or group, indulge in sexual
intercourse or lascivious conduct, are
deemed to be children exploited in
prostitution & other sexual abuse; & Sec.6.
Attempt To Commit Child Prostitution. –
There is an attempt to commit child prosti-
tution under Sec. 5, par.(a) hereof when any
person who, not being a relative of a child,
is found alone with the said child in- side the
room or cubicle of a house, an inn, hotel,
motel, pension house, apartelle or other
similar establishments, vessel, vehi- cle or
any other hidden or secluded area under
circumstances which would lead a
reasonable person to believe that the child
is about to be exploited in prostitution and
other sexual abuse;

Municipal Ordinance (MO) No. 05 – 2019
entitled “PROHIBITING MINORS TODRIVE
MOTOR VEHICLES IN THE MUNIC- IPALITY
OF BUENAVISTA, PROVINCE OF AGUSAN
DEL NORTE, PENALIZING PAR- ENTS
AND/OR GUARDIANS OR ANY PER- SON
NEGLIGENCE OR TOLERANCE THEREOF
AND FOR OTHER PURPOSES
 Sections 5, 8 & 9 (c) of M.O. No. 05
– 2019 provides “Prohibited acts for mi-
nors. – Minors are prohibited to drive
motor vehicles to any point of destination
within the territorial jurisdiction of the
Municipality of Buenavista, Agusan del
Norte; Liability of Parents or guardiansor
any person in the commission of the pro-
hibited acts under the Ordinance by their
children or ward. The Punong Barangay is
hereby directed to deputize the barangay
tanods in his or her area of jurisdiction in
the implementation of this ordinance,
