ORDER

1. The issue for consideration is the alleged storage of inflammable

chemicals at Rana Complex, Village Rithala, Sector-7, Rohini, Delhi,

which has potential of impacting public health in violation of the

“Manufacture, Storage and Import of Hazardous Chemical Rules,

1989 (1989 Rules) under the Environment (Protection) Act, 1986 and

the Hazardous and Other Wastes (Management and Transboundary

Movement) Rules, 2016 (2016 Rules).

2. Vide order dated 28.11.2018, a report was sought from Delhi

Pollution Control Committee (DPCC). The report furnished by DPCC

confirmed that different chemicals were found stored for distribution

to customers including titanium dioxide, plastic colours, CPE

(Chlorinated Polyethylene Resin), oxidising Polyethylene, PVC

Stabilized etc. The report further stated:

“Solid waste management were found very poor and loose


empty bags containing powder of the said Chemical besides
residual chemical after washing of hand & mouth of the
labour, bathing found in the adjoining as well as opposite
empty plots.”

“That in view of guidelines on implementing liabilities for


Environmental Damages due to Handling & Disposal of
Hazardous Waste and Penalty, issued by CPCB, further
action initiated for assessment of damages. Federation of
Indian Chamber of Commerce and Industries (FICCI) Lab has
collected the samples from the site. On the basis of
Assessment, subsequent action will be initiated for risk
assessment, remediation cost of liability and penalty as per
the guidelines of CPCB.”

3. Vide order dated 01.03.2019, the Tribunal directed the DPCC to

furnish a further action taken report on the subject of onsite and

offsite emergency plans by the occupiers.

4. Accordingly, the report filed on 07.08.2019 by the DPCC states that

compensation for damages have been collected, supply of electricity

and water have been disconnected and the units have been closed.

5. In view of above, no further order appears to be necessary at this

stage.
