DRAFT RESOLUTION No. 08

(Series of 2023)

“A RESOLUTION REGULATING THE PARKING SPACE OF VEHICLES OWNED BY BARANGAY MABAYUAN,

ALONGSIDE OR IN FRONT OF THE BARANGAY HALL UP TO THE AREA OF BASKETBALL COURT”.

WHEREAS, Section 391 of the Local Government Code likewise states that the Sangguniang Barangay, as
the Legislative Body of the Barangay, shall enact Laws as may be necessary to discharge the responsibilities
conferred upon it by law and to promote the general welfare of the inhabitants therein;

WHEREAS, on July 29, 2019, the Department of Interior & Local Government (DILG) issued a
Memorandum Circular No. 2019-121 that requires all Governors, Mayors, & Barangay Captains to conduct Mass
Clearing Operations in their jurisdiction against all types of road obstructions, such as “illegal terminals, illegal
vendors, illegal constructions, vehicles, & etc., within sixty (60) days only, after which an extensive apprehension
and penalty will be imposed on all violators;

WHEREAS, on account of the situation, there is an urgent need to rationalize the use of our streets in order
to minimize, if not completely eliminates road accidents by providing protection to pedestrians particularly during
rush hours;

WHEREAS, on the other hand, OTMPS members often issue citation tickets to vehicles owned by Barangay
Mabayuan for illegal parking even though such vehicles are parked in front of the Barangay Hall considering that
there is no other place to park.

WHEREAS, relative to these adversities, and after a conscientious deliberation on the matter, the
members of the Sangguniang Barangay reached a decision to designate a parking area for vehicles exclusively
owned by Barangay Mabayuan and visitors to avoid being accosted or apprehended by OTMPS for alleged illegal
parking;
 WHEREAS, a signage will be provided in the area indicating where and what specific vehicles are allowed
to park.

On motion of Kagawad Mike R. Sagun duly seconded by Kagawad Earl L. Escusa and with the unanimous
accord of the Sangguniang Barangay members, be it:

RESOLVED, AS IT IS HEREBY RESOLVED BY THE SANGGUNIANG BARANGAY OF MABAYUAN,

OLONGAPO CITY, BY VIRTUE OF THE POWERS VESTED IN IT BY LAW, IN SESSION ASSEMBLED, to
regulate the parking space of vehicles owned by Barangay Mabayuan, alongside or in front of the Barangay Hall up
to the area of Basketball Court.

RESOLVED FINALLY, that a copy of this resolution is forwarded to the OTMPS, Office of the DILG, & CITY
COUNCIL of Olongapo City for their information, guidance, and reference.
