ORDER OF INVESTIGATION
A verified Petition was filed by Heirs of Kristina Y. Limpong
represented by Martha Limpong-Tambolero (petitioner) for the reversion of Lot 1 with Survey Plan No. PSD-11-012799 AMD (identical to Lo.t 1, PSU 134073 AMD) and Cancellation of Issued Title OCT No. (P14614) P-2133 including Transfer Certificate of Title Nos. (TCT) 148- 2015000116, 148-2015000117, and 148-2015000118 respectively situated Sitio Kanayan, Barangay, Daliao, Maasim, Sarangani Province.
Petitioner, among others, seek to establish FRAUD alleging that
the respondent, who married one of the heirs, secured the patent of the subject land in question without the knowledge and consent of other heirs.
Upon careful perusal of the complaint, petitioner stated that the
land in question covering a total area of 20.8948 hectares, was originally owned by their grandmother, Ibat Tagum who had been occupying the property since 1950, after the World War II, then assigned and ceded the same to her five (5) children, including Kristina Y. Limpong, mother of the petitioners. Respondent married Lydia, one of the children of Ibat Tagum caused the fraudulent machination in the application and processing of land subdivision survey over Lot No. 1, Psu-134073 Amd under his name without knowledge of other heirs which resulted to the issuance of Originak Certificate of Title No. P-14614) P-2133 in the name of Laga Katug. Further, before the death of the wife of respondent, the former executed an Affidavit dated February 18, 1976 being the recognized administrator and her acknowledgment to the ownership and occupation of the paraphernal property belonging to her and her siblings, hence, this complaint, praying for the cancellation of the Original Certificate of Title (OCT) No. P2139 and be reverted to the government including the corresponding issuances of its Transfer of Certificate of Title (TCTs) emanated therein.
Pursuant to DENR Administrative Oder No. 2016-31 on the
Procedure in the Investigation and Resolution of Land Claims and Conflicts Cases, the PENRO conducted a preliminary evaluation. Upon determination of the compliance with the requirements, the Petition was forwarded to the Regional Executive Director (RED) and referred the same to the Legal Division for early evaluation whether the Petition has sufficient basis.
Upon evaluation of the available records, the Legal Division
determined that the Petition has indeed sufficient basis. Therefore, recommended for the issuance of an Order of Investigation.
Finding the Petition to be sufficient in form and in substance, an in-
depth actual investigation and ocular inspection is therefore, indispensable.
WHEREFORE, pursuant to the provisions of DENR Administrative
Oder No. 2016-31 on the Procedure in the Investigation and Resolution of Land Claims and Conflicts Cases, the PENR Officer of Sarangani is hereby directed to cause the immediate investigation of the case and thereafter submit to this Office the report within thirty (30) days from termination of proceedings for dispositive action.
