ORDER OF INVESTIGATION

A verified Petition was filed by Alvin M. Daulog, as represented by

his wife Psyche D. Daulog for the cancellation of the unregistered patent
of Lot No. 8973, PLS 73 with a total area of 49, 234 square meters,
more or less situated at Luayan, Buluan, Cotabato (now Luayan, South
Cotabato) identical to Barangay Dumaligdig, Tantangan, South Cotabato
with Homestead Patent No. V-229732 covered by Homestead
Application No. V-6170.

Petitioner, among others, seeks for the cancellation of the

application of the respondent, Felicisimo Lintag, over Homestead Patent
No. V-229732 covered by Homestead application No. V-6710 on the
ground that the former had already acquired the subject land in question
through a notarized “Deed of Absolute Sale” dated August 6, 2003.
 Upon careful perusal of the complaint and the attached
documents, petitioner alleged that he demonstrated the acts of
ownership over the land as he is the current cultivator of the same by
planting several crops, was issued with a Barangay Certification dated
2022 and 2023, registered the property under his name for tax purposes
and has been religiously paying taxes of the land, hence, complying all
the requirements required under CA 141 in effect, a ground for the
cancellation of the homestead application of the respondent.

Pursuant to DENR Administrative Oder No. 2016-31 on the

Procedure in the Investigation and Resolution of Land Claims and
Conflicts Cases, the PENRO conducted a preliminary evaluation. Upon
determination of the compliance with the requirements, the Petition was
forwarded to the Regional Executive Director (RED) and referred the
same to the Legal Division for early evaluation whether the Petition has
sufficient basis.

Upon evaluation of the available records, the Legal Division

determined that the Petition has indeed sufficient basis. Therefore,
recommended for the issuance of an Order of Investigation.

Finding the Petition to be sufficient in form and in substance, an in-

depth actual investigation and ocular inspection is therefore,
indispensable.

WHEREFORE, pursuant to the provisions of DENR Administrative

Oder No. 2016-31 on the Procedure in the Investigation and Resolution
of Land Claims and Conflicts Cases, the PENR Officer of Sarangani is
hereby directed to cause the immediate investigation of the case and
thereafter submit to this Office the report within thirty (30) days from
termination of proceedings for dispositive action.
