Dear Sir,

As per your request we have examined the papers and documents referred to us in respect of the
captioned client of your esteemed Bank and our opinion concerning the same is as follows:

01. Owners of the : Md. Anisur Rahman date of birth: 02.02.1977,


property National ID No.7813889875095, son of Md. Joynal
Abedin Boyati & Mst. Sokina Begum, having his
present & permanent address at Village: Sot Dalima,
Post Office: Baufol-8620, Police Station: Baufol,
District: Potuakhali.

02. Name of the Previous : As per Deed of Sale being No.397 dated

that Md. Anisur Rahman mutated his name as per R.S.
operation with the concern AC Land Office, in respect
of land measuring 07.17 (Seven point one seven)
decimal under R.S. Dag No. 557 vide Mutation
Separation Case No. 3544 (IX-I/2022-23 dated
16.10.2022, corresponding Jot No. .

It appears that, Abdul Hai, Habibur Rahman (Habib),
Abdul Kaium, Abdul Naim, Nur Nehar was the S.A. &
R.S. recorded owner of the Schedule land.
Thereafter said Abdul Hai died leaving behind his legal
heirs Ahmed Hossain, Monoara Begum, Helena Begum
Who acquired the land by way of inheritance.
Thereafter said Habibur Rahman (Habib) died leaving
behind his legal heirs Md. Dulal Miah, Md. Julhas,
Monoara Begum (Khuki), Mosammat Sokhina Begum
(Babuli), Komla Begum, Milon Begum Who acquired
the land by way of inheritance.
Thereafter said Abdul Kaium died leaving behind his
legal heirs Nurul Islam, Din Islam, Shamima Begum,
Sayma Begum Who acquired the land by way of
inheritance.
Thereafter said Abdul Naim died leaving behind his
legal heirs Md Akhter Hossain, Md. Akram Hossaim,
Mobarak Hossain, Amdad Hossain, Hena Begum,
Begum Ara Who acquired the land by way of
inheritance.
Thereafter said Md Akhter Hossain died leaving behind
his legal heirs, Sabbir Ahamed, Md. Ujjal, Nasima
Begum Who acquired the land by way of inheritance.
Thereafter, (1) Ahmed Hossain, (2) Monoara Begum,
(3) Helena Begum, (Successor of Abdul Hai), (4) Md.
Dulal Miah, (5) Monoara Begum (Khuki), (6)
Mosammat Sokhina Begum (Babuli), (7) Komla
Begum, (8) Milon Begum (Successor of Habibur
Rahman) (9) Nurul Islam, (10) Din Islam, (11)

said land measuring 101 decimals and to sell vide
Deed of Power of Attorney being No. 8020 dated
27.05.2011/29.05.2011 registered with the South
Keraniganj Sub-Registry Office of Dhaka.

Thereafter said Md. Julhas Miah & Md. Shadat Hossain


as the lawful attorney of (1) Md. Dulal Miah, (2)
Monoara Begum (Khuki), (3) Mosammat Sokhina
Begum (Babuli), (4) Komla Begum, (5) Milon Begum,
(6) Nurul Islam, (7) Din Islam, (8) Shamima Begum,
(9) Sayma Begum, (10) Md. Akram Hossaim, (11)
Mobarak Hossain, (12) Amdad Hossain, (13) Hena
Begum, (14) Begum Ara, (15) Sabbir Ahamed, (16)
Md. Ujjal, (17) Nasima Begum (Buri) sold the land
measuring 3.97 (Three point Nine Seven) decimal to
Md. Anisur Rahman vide Deed of Sale being No. 397
dated 10.01.2022/12.01.2022, [along with Govt.
delivery receipt being No. K-5797] registered with
the South Keraniganj Sub-Registry Office of Dhaka.

As per Deed of Sale being No.2792 dated 07.03.2022

It appears that, Almas, Alfas, Nur Miah was the S.A. &
R.S. recorded owner of the Schedule land.

Thereafter Almas died leaving his legal heirs Rawshan


Ara who acquired the land by way of Inheritance.

Thereafter, Rawshan Ara appointed Md. Sumon &


Habibur Rahman as his constituted Attorney to inter
alia to develop the said land measuring 3.25 decimals
and to sell vide Deed of Power of Attorney being No.
4246 dated 17.05.2016 registered with the South
Keraniganj Sub-Registry Office of Dhaka.

Thereafter said Md. Sumon & Habibur Rahman as the


lawful attorney Rawshan Ara sold the land measuring
3.20 (Three Point Two Zero) decimals to Md. Anisur
Rahman vide Deed of Sale being No. 2792 dated
07.03.2022, registered with the South Keraniganj Sub-
Registry Office of Dhaka.

Thus said Md. Anisur Rahman become the present
owner of the land measuring 07.17 (Seven point one
seven) decimal and got mutated the same with the govt.
revenue record vide mutation separation case no. 3544
(IX-I/2022-23 dated 16.10.2022, corresponding Jot No.
and paying ground rent thereof.
11. Ground Rent : Submitted photocopy of ground rent payment receipt
Payment Receipt(s) being receipt no. 269822022229 dated 26.10.2022 in
the names of present owner i.e. Md. Anisur Rahman,
the rent has been paid up to 1429 B.S., in respect of
land measuring 07.17 decimal under Dag No. R.S. -
557, which Mutation Khatian no. 2564; corresponding
Jot No. .
12. Non-Encumbrance : Submitted of Non-Encumbrance Certificate bearing
Certificate. Govt. Receipt being No. 200641 dated 30.10.2022, it
appears that the said land measuring 07.17 decimal
decimals under dag No. Dag No. R.S. -557, is free
from any encumbrance from the year 2010 up-to the
year 2022.
13. Municipal Holding : Not Submitted.

17. Opinion : In the light of the above mentioned findings, we are of


the opinion that said Md. Anisur Rahman has acquired
the good right, title & ownership over the land
measuring 3.97+3.20=07.17 (Seven point one seven)
decimal by way of Purchase.

On face of the above, it is our view that the Bank can


only accept the Scheduled Property as security in the

form of legal mortgage against the loan facility subject
to obtain all original papers/documents to be kept in the
custody of the Bank.

Moreover, before creating mortgage over the Scheduled


land, the Bank should verify the spot physically for
ascertaining the actual and peaceful possession of the
present owners over the same.

For this entire opinion, we have assumed that:

● all documents/papers submitted to us as photocopies are complete and conform to


authentic original documents.

● all representations and statements made with regard to the documents by the party is
true and accurate.

This opinion is rendered only to you as our client and is solely for your benefit. No other
person may rely upon it for any purpose, without our previous written consent.
