SUB: PRIOR INTIMATION BEFORE FILING OF CRIMINAL COMPLAINT UNDER RELEVANT PROVISIONS OF
LAW FOR NON PAYMENT OF SBI CARD DUES IN RESPECT OF YOUR SBI CARD XXXXXXXXXXXXXXX0224

I have been instructed by my client, M/s SBI Cards & Payment Services Ltd. (SBICPSL), hereinafter referred
to as “my client” having its Registered office at Unit 401 & 402,4th Floor, Aggarwal Millennium Tower, E
1,2,3, Netaji Subhash Place, Wazirpur, New Delhi – 110034. to serve you with the following notice.

1. That my client aforesaid is engaged in the business of providing credit cards and having branches
throughout India.
2. That on your request, you, the above-named addressee were granted a credit card facility vide Credit
Card Number - XXXXXXXXXXXXXXX0224 vide Account Number - 0006528897350695093 and as such
you had been availing the credit card facilities of my client since the date of issuance of the same.
3. That you had been availing credit card facilities granted by my client subject to the terms and conditions
of Credit card agreement. Vide the said agreement, you had further undertaken to pay the bills raised by
my client, however you have failed and neglected to pay the same.
4. That as per the accounts maintained by our client in ordinary course of business, a sum of Rs.
3,51,095.75is due and payable by you, which you have failed to pay despite repeated demands, hence this
notice.
5. That you by your actions, have wilfully caused wrongful gain to yourself and wrongful loss to my client
and hence made yourself liable under various provisions of civil and criminal law.
6. That in these circumstances we are constrained to initiate legal proceedings against you including but
not limited to criminal action under various provisions of law including S. 420 of the Indian Penal Code,
1860 for recovery of outstanding dues.
7. Please note that the offence u/s 420 IPC attracts prosecution and the offence is cognizable i.e., arrest
without warrant and is non bailable one. Further, in case of conviction, the person can be liable for both
imprisonment and fine thereof.
8. Therefore, we hereby call upon you as a last opportunity to clear the outstanding of Rs. 3,51,095.75
immediately and not later than 7 days from the receipt of the notice, failing which, we shall be constrained
to initiate the legal proceedings against you including criminal action as warranted under the law as
explained hereinbefore.
9. Further kindly note that the legal proceedings shall be at your cost and peril including the recovery of
outstanding amount of Rs. 3,51,095.75along with interest/charges as applicable till the date of the
payment.

A copy of this notice has been retained in our office for further action. For further clarification, you may contact

am to 06.30 pm on working days. Please ignore this notice in case if you have already made the said payment
before the receipt of this notice.
