Disclaimer: There is no obligation (wujūb) to get married before the


age of 16 in Islāmic law and each nation has its own laws regarding
the legal age of marriage. This treatise merely discusses marriages of
the past in various locations including European, Asian, African and
Arabian societies with a view to providing the context for past social
norms and customs and refuting the baseless charge of pedophilia
against the Prophets of God and also against European royalty and
aristocracy of the past. This treatise does not encourage the breaking
of any law and is simply an academic discussion of a matter that has
been distorted and misrepresented by those with ideological hatred
for Islām.

INTRODUCTION
This treatise is a response to those spiteful Islām-haters who
make the accusation of “pedophilia” against the noble, revered
Prophet of Islām, Muḥammad (). This is a false, baseless
accusation made only by three groups of people:
1. Those who are genuinely ignorant and do not harbour any

malice or hatred as such but they are confused on this issue, and

simply desire to understand how a six year old was betrothed to


the Prophet of Islām because it is at odds with current social
norms. They have heard about this and are seeking to understand
it, but without any ill-will or malice. We will call this category,,
the Inquistive Truth-
Truth-Seeker.
Seeker
2. The rank ignoramus from the common riff-raff who
harbours spite and hatred without due right, having subscribed
to the views and sentiments of nationalist and far-right groups.
Such people have no understanding of culture and civilisation
and little knowledge of history and of the principles of those
sciences by which the cultures and social norms of societies are
studied. These are uneducated, intellectual cripples and are to be
put alongside domesticated animals. We call this category, the
Ignorant Blind-
Blind-Follower
Follower Devoid of Rational Faculties.

3. The sophisticated, ideologically motivated Islām hater
whose aim is to ridicule Islam and belittle Muslims due to
ideological hatred that is often coupled with aspects of racial
supremacy. They do this with full knowledge that they do not
seek truth, but only the attainment of agendas. Many of these
people are aware of some of the issues that will be discussed
below regarding this particular matter. However, they find

Muslims who are ignorant or are unable to articulate and express


views in a clear, lucid manner. They engage such Muslims in a
dialogue in order to catch them out, and then use the material
for anti-Islām propaganda. We will call this category the
Inflamed Hateful Loon whose undergarments are ablaze with
rank hatred. This seething, blazing hatred however is concealed
by an outer appearance of civility and pretence of impartiality,
genuineness and seeking of truth. Despite this, it is all but visible
on their faces and expressions, since a hatred that is blazing and
kindles a person’s undergarments cannot be kept hidden for
long.

handle each of these three categories of people in the
appropriate manner. However, it can be read by anyone of any
background interested in the issue.
By reading this brief treatise and understanding it well, the
reader will be able to immediately categorise any person who
wants to raise or debate this issue within a matter of minutes.
The reader will be able to distinguish between the sincere truth
seeker from the pretentious ignorant retard and both of these
from the blazing hate-

OUTLINE AND APPROACH


In this treatise we will outline the following:

1. Adulthood,
Adulthood in the history of cultures and civilisations, was
linked to the onset of the signs of puberty. A child graduated
directly into adulthood upon puberty and was considered an adult.
Puberty rites to mark this event were common in many cultures
and societies and remain to this day.

2. Mental maturity (bulūgh) and puberty which signifies


biological adulthood are two separate things. A child can reach
mental maturity but not display the signs of puberty, and a child

may display all the signs of puberty but not possess mental
maturity till years afterwards.

3. Cultural, environmental, social and economic factors


determine the age of adulthood and mental maturity. maturity The
concept of adolescence—slow graduation into adulthood—was
not known prior to the 20th century. It is something novel in
modern industrial societies brought about through socio-
economic factors. Only a hundred years ago in England and in
nations in general children were mentally mature at a much
younger age due to the socio-economic conditions. With changes
in these conditions, the transition to adulthood slowed down and
the concept of adolescence came into being. Thus, what is
perceived as “adulthood” does not have any fixed timeframe,
though historically among nations, it was tied to signs of
puberty.1 Thus, mental maturity may come before puberty, or it

4. In light of the above, attitude towards sex, sexuality,


marriage and age of consent for marriage are all determined
purely by the cultural and social norms of societies which
determine when a child reaches adulthood and mental maturity.
Further, these were largely private issues in which parents and
families made decisions for the best interests of their sons and
daughters, mostly without the intervention of state authorities.

early 20th century and the sexual revolution of the 60s in
producing a predatory sexual interest in children and calls for
lowering or abolishing the age of consent to facilitate
exploitation of children for sex. Nihilistic, existentialist
philosophies founded upon atheism are the driving force behind
sexual liberation movements and the present day attempts to
legalise pedophilia in Western nations, following the same
pattern as the legalisation and normalisation of homosexuality.2

6. The impermissibility

academic fraud. Anyone who does this—after his ignorance is


removed—exposes himself or herself as either a hate-filled liar,
seething with hatred or a retarded ignoramus on a par with
domesticated animals with respect to his or her intellect and
comprehension.

It is not possible for any person of any religious or ideological


background to actually use this argument of pedophilia against
the Prophet of Islām (). Neither a Christian, nor a Jew,
nor an atheist, nor any other religious background. It is quite
easy to expose any person of any background who insists on
making this accusation as either an ignoramus or a deranged

So the first thing that you begin with when any person comes to
you with this issue is to establish what is uncontested fact, that
adulthood and age of consent are determined by socio-economic
and environmental factors. These are not fixed matters but tend
to change within societies due to changing circumstances. In fact,
they also vary from individual to individual within the very same
society, culture, climate and environment.
So this is the first thing you explain and you will find out very
early on which category a person is from: The sincere truth-
seeker, the ignorant blind-follower or the spiteful loon. So you
have to test them first to see if they are willing to concede to the

undisputed, objective facts of history and of reality. This is well
established in the research literature and in anthropological
studies. None denies them save an ignoramus of the highest rank
or an arrogant, blazing loon. The truth seeker will be inquisitive
and eagerly anticipate the information you are about to present
to them, because it will illuminate them and remove the
difficulty this issue causes them. The others will become
inhibited and try to divert and deflect. Do not budge. Pin them
down [figuratively speaking] and drip-feed them with what
comes below. Do not divert off your course, just stick to the facts.
Now there are a ton of quotes, we will provide you with only a
handful here which are sufficient for the task at hand. Present
them and insist that an understanding must be reached about
this issue of the social norms and customs of marriage and age of
consent.
So let us start with a resource titled “Adolescence, Sexuality, and
the Criminal Law: Multidisciplinary Perspectives”—this is a handbook
discussing the state regulation of adolescent sexual behaviour
and provides some very useful historical information. This book
is written for those in the legal profession interested in issues of
criminality and the sexuality of children and adolescents, so it is

a highly appropriate book to cite from. In the chapter on Age of


Consent: A Historical Overview there occurs:
 “Age
Age of Consent throughout history has usually coincided
with the age of puberty although at sometimes it has been as
early as seven. Early on age of consent was a familial or tribal
matter and only became a legal one in the Greek-Roman period.
The Roman tradition served as the base for Christian Europe as
well as the Christian Church itself which generally. essentially
based upon biological development set it at 12 or 14 but

continued to set the absolute minimum at seven.”
Also:
 “In the twentieth century, however, we began extending

the age of adolescence to meet the demands of modern society

for greater education and job training. Age of leaving school was
raised as was the age for driving for drinking, for smoking, and
numerous other aspects of life. Age of marriage has also risen,
not necessarily because of laws, but because of changing roles of
society 4

And also, speaking of the Roman customs which were passed
on to other parts of Europe:
 “Marriage and age of consent remained private matters
between the families involved until the time of Augustus in the
first century when the state began to intervene. Marriage then
legally became a two step process, a betrothal which involved an
enforceable agreement between the heads of two households,
followed by marriage itself. Women who were not yet of age
could be married with the consent of their fathers. While the
women’s consent was not necessary for betrothal, it was for
marriage. Usually if a girl was betrothed before she had her first
menses, the couple were to wait for this before consummating
the marriage which can be regarded as the age of consent.

such a delay was not necessarily enforceable and was not always
observed (Friedlander, 1913). It was only late in the Empire that it
became law that children must be able to understand what they
were consenting to if they married, and this came to be accepted
as occurring by age seven (Balsdon, 1962).” 5

In another work Marriage Customs of the World6 there occurs:


 “Age
Age at Marriage. The age of the couple at marriage varies a

custom. According to Sharia (Islamic) law, for example, a girl
should marry soon after puberty presumably to ensure that she
retains her virginity for her husband. Thus, an Iranian girl may

be married at the age of nine years. Tibetans generally marry in

their mid twenties. Polish Gypsy girls would generally be married
at around twelve or thirteen years of age. Romanian Gypsy girls
are still married at about fourteen.. These ages seem to have been
common across many cultures. Puberty has been seen as the
acceptable age at which a girl could marrymarry. However, such a
young age has become less and less acceptable over the last
century or so. The Hindu Laws of Manu set out the ideal age
difference between a man and a woman for marriage, saying that
the man should be three times the age of the girl-a man of
twenty-four should marry a girl of eight. However, it also
occurred in Hindu writings that a man of thirty should marry a
girl of twelve (the age difference here being two-and a half times
the girl’s age) and that it would be sinful for a man to breach this
rule. Early Hindu religious writers wrote that a girl should he
married by the age of ten or twelve years, and if she was not
married by this age, she should be immediately married off, even
in the season when marriage was prohibited. However,
intercourse before puberty was forbidden. The age at which a

person can be married is obviously related to the legal “age of


consent” for sexual intercourse, which in turn relates to the age
of puberty, to perceived ages of adulthood (although in many
communities adulthood is perceived to he arrived at upon
marriage-in Ireland, for instance, an unmarried man of any age
would be treated as a child in his family, unless, of course, he had
entered the priesthood), and to the ability of couples to set up
individual family units.”
And also:
 “However, the age for betrothal or spousal may have had
little relationship to the age of puberty and may be much
younger than the age of marriage. Betrothal was the contract

between two families and was often viewed as tantamount to

being married (but without the sexual rights). In Hindu practice,


it was quite common for a young girl to he promised in marriage
to an older boy or man. In British and European practice, it was
not uncommon for young children to be espoused but with the
actual wedding not taking place until the boy was fourteen and
the girl twelve--that is, when they had reached puberty.”7

In his work The Wedding Day: In All Ages and Countries, Edward J.
Wood writes:
 “Fathers who possessed rank and wealth affianced their
children at a very early age, and compelled them to marry on
arriving at puberty...” and a page later, “Thomas, Lord Berkeley,
was contracted to Margaret, daughter of Gerald Warren, Lord
Lisle, in the forty-first year of Edward III and by reason of her
tender age - she was then only about seven years old - it was
arranged that she should remain with her father for four years;
but sickness happening in the family, they were married in the
November following,”8

Another author, Arthur Siccan writes:


 “Traditionally, across the globe, the age of consent for
sexual union was a matter for the family to decide, or a tribal
custom.

menstruation for a woman and pubic hair for a man. Sir Edward
Coke in 17th century England ‘made it clear that the marriage of
girls under 12 was normal, and the age at which a girl who was a
wife was eligible for a dower from her husband’s estate was 9.
The American colonies followed the English tradition, and the
law was more of a guide. For example Mary Hathaway of Virginia,
was only 9 when she was married to William Williams... I believe
that a lot of our current mores come from reluctance to let our

children mature mentally as quickly as our bodies do. Keep in

mind that not all societies share Western mores. And to my
surprise, until the latter part of the 19th century, children in the
Western nations were engaged and married at a much earlier
age. The trend to give children more time to mature is relatively
new. In his book, The Emphatic Civilization, (Penguin, NY, 200)
Jeremy Rifkin points out that the concept of adolescence only
emerged during the last decade of the nineteenth century and
the first three decades of the twentieth century. Society started
to think of childhood as extending beyond puberty, into the later
teenage years. Before that, children were considered to graduate
puberty 9
into adulthood with the onset of puberty.”

Finally, Professor of History, Margaret Wade Labarge writes, 


“It must be remembered that many medieval widows were not
old. Important heiresses were often married between the ages of
5 and 10 and might find themselves widowed while still in their
teens.”10

From these quotes, keep in mind the differences between


betrothal, spousal or contracting and consummating a marriage.
Parents would betroth their children into marriage and when
they reached puberty or maturity they would allow for the
marriage to be made concrete through consummation as the
child had reached adulthood and maturity. Understanding this—
which was a known practice in most societies including Britain,
Europe and the American colonies—will help refute doubts that
Islām-hating loons try to bring.

ENGLISH KINGS AND EUROPEAN ROYALTY

denial, diversion or hasty retreat—you are now in a position to


give some notable examples:
 Richard II was the King of England between 1377 and 1399
and as a widower, he took Isabella of Valois as his second wife at
the age of six (6) and she became the Queen consort of England
shortly after her marriage. They were married on 31st October
1396.
 King John (d. 1216), also a King of England, married Isabella
of Angouleme in 1200, when she was twelve
twelve (12).

 Agnes of Essex,
Essex Countess of Oxford was betrothed at age
three (3) to Geoffrey de Vere, brother of the first Earl of Oxford,
and turned over to be raised by the Veres soon thereafter. Agnes
later rejected the match with Geoffrey and by early 1163 at the
age of twelve (12) was married to his eldest brother Aubrey de
Vere III,
III 1st Earl of Oxford—who was aged forty-eight (48) at the
time—as his third wife. She had her first child—also called
Aubrey, who later become 2nd Earl of Oxford—in the same year.
 Mary Henrietta,
Henrietta eldest daughter of King Charles I, was
married to William II of Orange in 1641 at the age of nine (9).

- Customs in most cultures and civilisations including Europe
right into the 19th century,
and
- Sexual lifestyle philosophies that lie behind the modern
interest in pedophilia and which come from those with atheist
backgrounds and rejection or disdain of religion.
As alluded to earlier, a Jew or a Christian or a Hindu or any
other religion cannot really make this argument of pedophilia
against the Prophet of Islām as one only need to look into their
own history, their religious books and their notable figures as it
relates to the customs of marriage and their dishonesty is
immediately exposed. However, there are hate-filled Christians—
such as the nationalists of EDL, Britain First and other dishonest,
lying vermin—who use this issue ony to rile up the ignorant and
win support for their cause by fostering hatred against Islām and
Muslims through misrepresentation of this issue.

Once, the above is clear, you need to force the person to accept
what has preceded. You cannot proceed any further, until they
are willing to accept these factual realities. Therafter, you need
to address two other issues. The first is historical age of consent

loons, but sincere seekers of truth. So all remains good in such a

HISTORICAL AGE OF CONSENT LAWS


So the intent behind this section is simply to support what has
preceded, which is that age of consent laws are tied to what the
state, the society or culture believes and knows to be the age of
mental maturity alongside the age of puberty. In general, these
two matters coincided and mental maturity often came before
the signs of puberty. The disparity in these two events—puberty
and mental maturity—comes down to socio-economic and
environmental factors as has preceded, and even individual
biological constitution is a factor, since in the same society, the
same socio-economic conditions and environment, one girl may
reach puberty at the age of nine and another much later, at

twelve, or even later.

In the 19th century, the usual age of consent in the US was ten
years and in the state of Delaware until the mid 1960s it was
seven years.
In A Guide to America’s Sex Laws, the authors note:
 “The law governing the age of consent has changed
dramatically in the United States during this century. Most states
codified a statutory age of consent during the nineteenth
century, and the usual age was ten years” as stated by Richard A.
Posner (Chief Judge of the US Court of Appeals) and Katharine B.
Silbaugh (Associate Professor at Boston University School of
Law)11
Professor of Sociology Anthony Joseph Paul Cortese states:
 “In 1962, the American Law Institute recommended that the
legal age of consent to sex - that is, the age below which sex is
defined as statutory rape - be dropped in every state to age 10
(Katchadourian and Lund 1972: 439). In fact, until the mid 1960s,
the legal age of consent in Delaware was 7 (Kling, 1965: 216). So a

50 year old man could legally have sexual intercourse with a 7


year old boy or girl.”12
Mike Males, American sociologist and professor at the
University of California, writes:
 “These early laws specified that a girl consenting to sex had
to be at least 10 to 12 years old in most states, with a few
specifying ages as old as 14 or 16. In Delaware, the age of consent
was seven, based on ancient English laws setting the age
squire.”13
Kristin Luker writes:
 “According to British common law during the colonial
period, the age of consent was seven.seven Today we are astounded

that girls of this age were assumed to know enough about sex (or

about sin) to make such a decision competently.”14


Carolyn Cocca writes in Adolescent Sexuality:
 “At what age is a person capable of making and informed
decision about whether or not to engage in sex? Would it be 7,10,
12, 13, 14, 15, 16, 17, 18, or 21? Over the last 300 years, all the ages
listed above were thought to be that magic age at which one
could make such a decision, and all the ages listed above have, at
various times, been inscribed into law as the age of consent to
sex.”15
Sinikka Elliot notes:
 “As the United States grew increasingly urbanized in the
late 1800s, young people were gradually removed from their role
in the labour force and were conceptualized as innocent and
vulnerable. The statutes governing the minimum age under
which sex cannot be legally consensual, and laws concerning

marriage and workers’ rights, were modified to reflect these


changing discourses around childhood. Age of sexual consent, for
example rose from 7 during colonial times to 10, 12, and even as
high as 14 during the eighteenth and nineteenth centuries.”16

From the above it should be clear that age of consent laws were
tied to puberty and the reaching of mental maturity, which in the
past was a lot earlier than today.

THE INVENTION OF ADOLESCENCE.


Prior to the 20th century children were mentally mature at a
much younger age and the onset of puberty was seen as a direct
graduation into adulthood. The notion of adolescence is a new
construction and appeared in the early 20th century in
industrialized nations. In many other societies adolescence is not
recognized as a phase of life. Instead, there is a distinction only
between childhood and adulthood and many cultures and
societies have rituals to mark this direct transformation in
adulthood. Further, biological adulthood is not the same as legal
adulthood, the latter is an invention of modern societies.
As mentioned earlier, mental maturity is not necessarily

connected to biological adulthood (puberty) and is determined


by social and environmental factors. Due to changes in the social
and economic milieu, today’s children remain children for much
longer and do not attain maturity until a much later age thereby
wedging a gap between the age of puberty and the age of full
mental maturity. It should also be pointed out that mental
maturity can be reached well before puberty whose upper limit of
onset can be as late as fifteen years of age.
In the January 1995 edition of Psychology Today published an
article titled, The Invention of Adolescence. The article starts with
the following lead paragraph:
 “Are Romeo and Juliet the quintessential adolescents? On
the yes side, they were rebelling against family traditions, in the
throes of first love, prone to melodrama, and engaged in violent
and risky behavior. But the truth is that there was no such thing
as adolescence in Shakespeare’s time (the 16th century). Young
people the ages of Romeo and Juliet (around 13) were adults in
the eyes of society—even though they were probably
prepubescent.” The authors then state, “Paradoxically, puberty
came later in eras past while departure from parental
supervision came earlier than it does today”, meaning that
children became mentally mature before they reached puberty.

The authors continue, “Romeo and Juliet carried the weight of


the world on their shoulders - although it was a far smaller world
than today’s teens inhabit. Another way to look at it is that in
centuries past, a sexually mature person was never treated as a
‘growing child.’ Today sexually mature folk spend perhaps six
years - ages 12 to 18 - living under the authority of their parents.
Since the mid-1800s, puberty - the advent of sexual maturation
and the starting point of adolescence - has inched back one year
for every 25 years elapsed.”17
The historian Steven Mintz also writes of the invention of
adolescence:
 “The middle of the eighteenth century saw the emergence

of a new set of attitudes, which came to define modern

childhood. A growing number of parents began to regard
children as innocent, malleable, and fragile creatures who
needed to be sheltered from contamination. Childhood was
increasingly viewed as a separate stage of life that required
special care and institutions to protect it. During the nineteenth
century, the growing acceptance of this new ideal amongst the
middle class was evident in the prolonged residence of young
people in the parental home, longer periods of formal schooling,
and an increasing consciousness about the stages of young
people’s development, culminating in the ‘discovery’ (or, more
accurately, the invention) of adolesence around the turn of thet
twentieth century.”18

Culture and the Inventionof Adolescence (University of Alabama
Press, 2008), Kent Baxter discusses the historical, social and
cultural reasons behind the creation and appearance of the idea
of adolescence in early 20th century, and one can refer to that for
more details on the subject.

It is important to grasp the point that we are making by these


last two chapters. And it is: That children are no longer of the
same calibre in terms of mental maturity and worldly experience
as they used to be only as far back as a hundred years ago.
However, some religious cultures have retained the notion of a
boy turning into an adult at a specific age. For example, Jews
celebrate the bar mitzvah for a boy who turns thirteen. “Bar
mitzvah is Hebrew for ‘son of commandment.’ When a Jewish boy
turns 13, he has all the rights and obligations of a Jewish adult,
including the commandments of the Torah... From time
immemorial, Jewish custom has been to mark this milestone with
a synagogue ceremony welcoming the bar mitzvah boy to the

world of Jewish adulthood...”19 And likewise, a girl turning to an

adult at age twelve; “Bat mitzvah is Hebrew for ‘daughter of


commandment.’ When a Jewish girl turns 12, she has all the
rights and obligations of a Jewish adult... As soon as you turn
twelve, you become a Bat Mitzvah, a Jewish adult... Although in
the secular world you are not yet even a teenager, according to
Jewish law, a girl is considered an adult from the age of twelve.”20
A verse in the Qurʾān relates to orphans whose wealth is held
by those hold them in custody. The verse commands that these
orphans are to be trained and tested until they are competent in
handling their own financial affairs. Thereupon, their wealth is
returned to them:
َ ْ َ َ ً ْ ُ َ ْ َ َ َ ّ ْ ُ ََ َ ٰ‫َ َُْ ْ ََْ َ ٰ َ ﱠ‬
‫اح ف ِإن آن ْست ْم ِّم ْ ُ ْم ُرشدا ف ْٱدف ُعوا ِإل ْ( ِ ْم‬‫النك‬
ِ ‫وٱبتلوا ٱليتامى ح" ِإذا بلغوا‬
َ َ
‫أ ْم َوال ُه ْم‬
“And
And test the orphans [in their abilities] until they reach
marriageable age. Then if you perceive in them sound
judgement, release their property to them.”

The Qurʾān scholar, Imām al-Baghawī (d. 516H) stated: “Test
them in their mental abilities, their religiosity and their ability to

preserve wealth, “until they reach marriagable age” meaning until


they reach the level of men and women.”21 The age of reaching
the level of men and women is explained to be puberty. Imām al-
Qurṭubī (d. 671H), another famous Qurʾān scholar explains that
this verse refers to the age of mental maturity and marriage and
this is known by menstruation or wet-dream or pubic hairs. And
where these signs do not appear, then fifteen is the age of
maturity.22 And Ibn Kathīr (d. 774H), the famous Qurʾān scholar
explains, “Ibn ʿAbbās, Mujāhid, al-Ḥasan, al-Sudī and Muqātil bin
Ḥayyān [all are famous early authorities on Qurʾān exegesis] said,
‘Meaning, to test them’, ‘until they reach marriagable age’, Mujāhid
said, ‘Meaning, when they see a wet-dream’.” And Imām al-Ṭabarī

(d. 310H) cites from numerous early authorities that the verse

means: To train them and to test them with respect to their
mental abilities, their comprehension and ability to handle their
property until they reach the age of marriage which is upon
having a wet dream.23
One can see that in past societies, children would mature a lot
earlier as they would be involved in the pursuits and crafts of
their families from an early age. Today, this takes place at a later
age, because of factors such as compulsory state education,
starting work at a later age, lack of financial independence from
parents, time for pastimes and leisures and so on. These realities
are well noted in academic discussions of adolescence and
adulthood.

Upon all of what has preceded, Islām does not have any fixed age
for marriage and nor does it command “marrying children” to
have sex with them. Rather, the issue of marriage is left to the
social norms and customs of each society. Thus, if every society
on earth today accepted Islām, whether Europeans, Eskimos or

tribes in the Amazon jungle, their customs and traditions of


marriage would not be interfered with by Islām unless aspects of
them clashed specifically with its injunctions.24 Thus, in some
Western developed nations, marriage would remain at over 18
and in other nations it may be 16 and others, 14 and some, such as
parts of the United States,25 it may be 12. Islām would not interfere
with any of that, since it accommodates traditions and norms
(known as ʿurf, local custom) and some of the details in its
injunctions, sometimes return back to what is customary among
a people.
However, if the legal code of a particular Western nation—one
in which adulthood is legally defined and in which it is assumed

that a child remains a child after puberty and is not mentally

competent until he or she reaches eighteen— was imposed upon


the whole world, it would disrupt or harm societies which
function in their own ways because of customs and norms unique
to their environments and socio-economic situations. The
legislation of Islām is more accommodating and more in tune
with the realities of the cultures, lifestyles and social norms of
people.

PUBERTY,
PUBERTY, ADULTHOOD AND
AND MARRIAGE IN ARABIA
Earlier, we made clear from many citations the attitudes towards
marriage and sex in Europe—both before and after Islām—and
likewise in the past few hundred years. Here, we will cite from
just one Islāmic authority for a glimpse of these realities within
pre and post-Islāmic societies which were not much different to
other societies of the same time, or prior to them.
In al-Sunan al-Kubrā, the ḥadīth scholar Imām
Imām al-
al-Bayḥ
Bayḥaqī
aqī (d.
1066CE), writes, under the chapter heading “The Age at Which a
Woman Can be Found to Have Menstruated”:
 “From al-Shāfiʿī who said: ‘The earliest I have heard of
women menstruating are the women of Tihāmah. They

menstruate at nine years of age.’ And from al-Shāfiʿī who said: ‘In
Ṣanʿā [Yemen], I saw a grandmother of twenty-one years of age.
She menstruated at nine years of age, giving birth to a daughter
at ten. Then the daughter menstruated at nine years and gave
birth at ten.’ And it is mentioned from al-Ḥasan bin Ṣāliḥ that he
said: ‘I came upon a neighbour of ours who became a
grandmother at twenty-one years of age.’ And we have also
related from Āʿishah () who said: ‘When a girl reaches nine
years, then she is a woman.’ She means that this is a woman—
and Allāh knows best—who has menstruated, and hence is a
woman.”26
This quote should reveal that in Islām and in Arabian societies
a girl turned
turned into a woman at the onset of puberty and the
earliest this took place was at nine years of age. Given this, it was
possible for a woman to become a grandmother at the age of
twenty-one. The quotes above from al-Shāfiʿī and al-Ḥasan bin
Ṣāliḥ indicate that this was something rare and not common-
place.
As for sexual relations, then the only condition stipulated is
that the woman must be ready and capable of having intercourse

without it causing her harm. The right time for this was
determined by the parents who would decide when the marriage
could be consummated and allow cohabitation.
This has been the same in many societies, particularly when a
daughter was given away in marriage by her father before she
reached puberty, known as a betrothal or spousal in Europe. One
can find examples in the history of European royalty and
aristocracy of this practice. A girl would be given in marriage and
then it would be agreed by the parents when she would go and
cohabit with her husband upon turning into a woman—which
was connected to puberty—and this is when the marriage would
be consummated.

What the above indicates then is that the rabid, Islām-hating

loons have nothing to stand upon in their false claims against the
Prophet of Islām. It shows that the practice of marriage at any
given age is evaluated in light of the social norms and customs of
the time and not of 1400 years later, when sexual liberation and
lifestyle philosophies have poisoned the arena and all sorts of
agendas are behind the likes of these accusations.

THE MARRIAGES
MARRIAGES OF THE PROPHET IN BRIEF
It is necessary to give a brief outline of the marriages of the
Prophet () before discussing the specific marriage in
question. A special dispensation was given to the Prophet
() who was allowed multiple marriages, most of which
had specific strategic objectives. When we analyse each of these
marriages this affair becomes clear. Here, for the purposes of this
treatise, we will summarise the issues for the sake of brevity.
Besides his first marriage, all of the Prophet’s marriages were
of two types:
a) those with legislative and educational reasons and
b) and those with socio-
socio-political-
political-humane reasons which a

reasonably intelligent person can grasp and appreciate.
There are many examples of strategic socio-political
marriages which can be given from the history of civilisations
before and after Islām, especially among European royalty and
aristocracy. The one who is aware, is aware and the one who is
ignorant, is ignorant.
The above is explained through the following points:

1. Upright character and first marriage. His first marriage was at


the age of twenty-five to Khadījah bint Khuwaylid () who
was aged forty, fifteen years his senior at the time. She had
employed him in her trade because he was known to be honest
and trustworthy amongst his people. He remained married to her
monogamously for twenty-

indicates that from the early part of his life, through the peak of
his youth and vigour, then ten years into prophethood and
finally, till after fifty years of age, he did not have multiple
marriages. Further, it is known that the Quraysh tried to bribe
him into abandoning his call by offering him power, wealth and
women and reaching some sort of compromise. They failed in all
of these miserable attempts. This does not seem to fit the profile
of a man motivated by sexual desires at all.

2. Married widows. All of the women he subsequently married


except one were widows. Had he been motivated by desire, he
would have married multiple times during the peak of his youth
and vigour and chosen young, virgin women, not widows.

3. Educational objectives behind marriages. From the aims


behind his marriages were those educational in nature,
particularly facilitating the education of women and knowing
their duties and the rights Islām granted to them, removing them
from the oppression of the pagan societies they lived in. His
multiple marriages took place largely within the setting of
Madīnah in which legislative rulings pertaining to worship,

trade, dealings, marriage, divorce, inheritance and so on were

revealed in addition to those pertaining to faith and morals. In


Mecca, such verses were not revealed. There were rulings
pertaining to women’s issues such as menses, post-partum
bleeding, child birth, breast-feeding of children and so on.
With increasing numbers of Muslims and more and more
women coming into Islām, it was more befitting and suitable for
women teachers to educate the women in the issues that
impacted them which included: personal issues of hygiene,
marriage, divorce, possession of property, inheritance, buying,
selling, contracting, renting, lending, mortgaging, sponsoring,
suing, guaranteeing, complaining, keeping the family name and
so on. As women were oppressed and were without dignity and
rights, it was necessary to elevate them through education about
issues unique to them, their rights and duties.
The Wives of the Prophet () played this role in teaching
women and conveying the guidance that related to them and
their affairs. The multiple marriages of the Prophet fulfilled the
needs of education for women and this is one consideration of
the concession granted to the Prophet to take many wives. All of
his wives were intelligent, wise, learned women.

4. Socio
Socio-political considerations.
considerations. The Prophet () married
the daughters of his two closest companions, Abū Bakr and ʿUmar
() whilst giving his own daughters in marriage to ʿUthmān
and ʿAlī (). This formed a tight bond between them all and
these four men are known as the most virtuous and excellent
amongst his companions. They are also known as the four rightly
guided caliphs. The Prophet () married ʿĀʾishah bint Abī
Bakr and Ḥafṣah bint ʿUmar.
And as for his other marriages, they were mostly with women
from the Quraysh, who were the warring enemies of the Prophet
(). The intent behind them was to keep the ties of kinship
between tribes—[the Arabs possessed a very strong tribal spirit

with deeply embedded notions of loyalty, honour and chivalry]—

with the wider goal of softening the opposition of his staunch
enemies among the Quraysh. This actually had the desired effect
as anyone who is familiar with the Prophetic biography will
know. Abu Sufyān ()—the staunchest of enemies—was both
softened and repelled because the Prophet () married his
daughter.
If the fact that European royalty often inter-married as a
means of maintaining peace and cordial relations with previously
warring nations and holding on to their own power27—such as
when King Richard II of England married six year old Isabella of
France in 1396—then it should not be hard to accept that the
Prophet was an extremely wise statesman in his strategic choice
of marriages. The Prophet () was not intending to split
and divide the Arabs, rather he wanted them to be united and
hence, these marriages were extremely strategic. They ensured

that as a leader and statesmen, he was holding together elements


of the Quraysh tribe, a matter that would work to keep unity
instead of disintegration.
The strategic use of dynastic and political marriage as a means
of maintaining unity and growing power without means of war
can be found among European royalty such as the Austrian
Habsburgs. These types of affairs are only understood by the
intelligent and wise, by the politically astute and experienced,
the learned and cultivated.

5. Human considerations.
considerations. Without going into all the details—
which would be too lengthy to mention here—the marriages of

the Prophet to Juwayriyah bint al-Ḥārith, Ṣafiyyah bin Ḥuyayy,

Umm Ḥabībah and Sawdah had humane considerations behind


them.

In summary:
Khadījah bint Khuwaylid (),
As for the marriage with Khadījah
then this took place before Prophethood. As for the marriages
with Sawdah () and then ʿĀʾishahʿĀʾishah (), then they took
place after the death of Khadījah which had affected the Prophet
considerably. The passing away of his first wife of twenty-five
years, Khadījah, brought hardship in the household on top of the
grief and sorrow of losing her.
As for the marriage with Ḥafṣ afṣah (), then she was the
daughter of ʿUmar bin al-Khaṭṭāb (). Her husband died and
she was left as a widow. The Prophet’s marriage to her was to
strengthen his ties with her father. As for the marriage with
Umm Ḥabībah
abībah,
ībah then she is the daughter of Abū Sufyān, the most
severe and staunch enemy of the Prophet (). She was an
early convert and had to emigrate to Abyssinia to flee
persecution from her father and family. The Prophet ()
married her whilst she was in Abyssinia via representation on

behalf of Negus, the Christian King. This marriage protected her


from persecution and also softened Abū Ṣufyān’s stance.
bint Khuzaymah (), then she was sixty
As for Zaynab bint
years old when the Prophet () marrried her. She was
constantly in the service of the poor and needy. Her husband had
been killed in the battle of Uḥud. So the Prophet ()
married her to console her and allow for her to continue in the
Jaḥsh (), then
aid of the needy and poor. As for Zaynab bint Jaḥ
the Prophet () was ordered to take her as a wife for a
legislative reason which was to abolish a blindly-followed custom
among the Arabs known as al-Tabannī. A child could be adopted,
treated as a real son, take the adopter’s name, and receive full

material and inheritance rights as well as be subject to all the

marriage laws (as to whom he could or could not marry). This
practice also had an effect on lineage and social structure. Islām
came to abolish this unjust practice and the marriage to Zaynab
was the means for this abolition.
As for Umm Salamah Hind al- al-Makhzūmiyyah
Makhzūmiyyah (), she was
one of the very early converts along with her husband, ʿAbdullāh
bin al-Asād, who later died. She had suffered considerable
persecution from the pagans and the Prophet accommodated her
in marriage for humane reasons.
As for the marriage with Ṣafiyyah bint Huyayy (), She is
from the direct descendants of Aaron, the brother of Moses
() and thus has an honourable and lofty status in that
respect. Her tribe acted treacherously towards the Prophet and
they were meted out justice in accordance with their own law,
the Torah. The Prophet recognised her noble lineage and offered
her two choices: To choose Islām in which case, he will free her
and marry her or to remain upon Judaism in which case she will
be freed and returned to her people (Banū Naḍīr).28 She freely

and voluntarily chose marriage with the Prophet (). The


Prophet did not actually marry her until after her waiting period
(ʿiddah) was completed29 and after al-istibrā— which refers to
either the completion of a menstrual cycle if a woman is not
pregnant or the delivering of a baby if the woman is pregnant—
Ṣafiyyah was prepared for marriage in the house of Umm Sulaym.
The Prophet did not consummate his marriage with her until
after she accepted Islām and he had freed her. Hence, he did not
have sexual relations with her whilst she was Jewish, nor whilst
she was a captive. Rather, she freely accepted Islām and chose to
marry him after declining the choice to remain upon Judaism and
return to her people. Further, the marriage took place after al-

istibrāʾ and all of this is clearly establish in the books of history

(tārīkh) and traditions (ḥadīth).


Ṣafiyyah recognised that she was honoured by the Prophet by
his offer of marriage to her which made her into one of the
“Mother of the Believers” which demands respect and honour
from all Muslims. And in some reports it is related that she would
say to the other wives of the Prophet () such as ʿĀʾishah
and Ḥafṣah, “How can you both be better than me when my
father is Aaron, my uncle is Moses and my husband is
Muḥammad?”30

() said to her: ‘Make your choice, if you chose Islām I will take you as
wife for myself and if you chose Judaism, I’ll set you free and send you to your
people.’ She said; ‘O Allāh’s Messenger indeed I longed for Islām and testified
for you even before you gave me this invitation when I came to you. I have no
guardian among the Jews, neither father nor brother and I prefer Islām over
disbelief. Allāh and His Messenger are more beloved to me then freedom and

The intent behind all of this is to provide a wider context and


picture and to show that we do not have the profile of a man
motivated by sexual desires. Rather, he was motivated by loftier,
nobler objectives connected to his role as a Prophet of God who is
tasked with conveying His message in best way possible to an
enmitous, war-hungry people who stopped at nothing to halt him
and his message. His marriages were strategic marriages which
had far reaching consequences. He was able to pacify his enemies
through some of these marriages by marrying their daughters.
He made concrete his ties with his closest friends and most
powerful figures after him. He conveyed the teachings of Islām to
multitudes of women through his wives who became learned

scholars in their own right by virtue of being his wives. And he

showed pity and compassion to widowed women who had been
persecuted for their faith by taking them in marriage.
The sophisticated person with an understanding of history,
society and politics will grasp these affairs very well. This is why
the intelligent, educated breed of Englishman of the past was able to
speak of the Prophet of Islām with some degree of justice.
 David George Hogarth (d. 1927), English archaeologist
author and keeper of the Ashmolean Museum, Oxford, wrote,
“Serious or trivial, his daily behaviour has instituted a canon
which millions observe this day with conscious mimicry. No one
regarded by any section of the human race as Perfect Man has
been imitated so minutely. The conduct of the Founder of
Christianity has not so governed the ordinary life of His
followers. Moreover, no Founder of a religion has been left on so
solitary an eminence as the Muslim Apostle.”31
 William Montgomery Watt (d. 2006), Professor (Emeritus) of
Arabic and Islamic Studies at the University of Edinburgh, wrote,
“His readiness to undergo persecutions for his beliefs, the high
moral character of the men who believed in him and looked up to
him as leader, and the greatness of his ultimate achievement - all

THE MARRIAGE TO ʿĀʾISHAH ()


Given what has preceded, we can now place the marriage of
ʿĀʾishah into the given context, and provide some of the unique
circumstances of this marriage. This marriage took place after an
extremely difficult time for the Prophet () whilst in
Mecca. His first wife, Khadījah (), had passed away. His uncle
who had been granting him protection against the enmitous
Quraysh, Abū Ṭālib, had passed away. And he, along with the
Muslims who believed in him, had just come out of a three year
economic boycott made against them. This was a difficult time.
An elderly woman, Khawlay bint Ḥakam, who was an assistant in
the Prophet’s household suggested the marriage to him. In the

Musnad of Imām Aḥmad, from Abu Salamah and Yaḥyā who both
said: “When Khadījah passed away, Khawlah bint Ḥakīm, the wife
of ʿUthmān bin Maẓʿūn came and said: ‘O Allāh’s Messenger, will
you not marry again?’ He said: ‘Who [shall I marry]?’ She said: ‘If
you wish, there is a virgin and if you wish, there is a non-virgin
[widow or divorcee].’ He said: ‘Who is the virgin?’ She said: ‘The
daughter of the most beloved of Allāh’s creation to you, ʿĀʾishah,
the daughter of Abū Bakr.’ He said: And who is the non-virgin?’
She said: ‘Sawdah, the daughter of Zamʿah, she believed in you
and followed what you say.’ He said: ‘Then go to them and
mention this to [their families].’”34
Thereafter, Abu Bakr (), the father of ʿĀʾishah () was
pleased to betroth his daughter to his closest friend, the Prophet
(), when she was six. The marriage was consummated at
the age of nine, when ʿĀʾishah became a woman.

Because of her young age, sharpness in memory and intellect,
ʿĀʾishah (), became from the greatest of the scholars of Islām
and a teacher and instructor to thousands of men. She was an

expert in legal affairs, inheritance law, language, history, poetry


and medicine.35
Hisham bin Urwah, narrating from his father (Urwah) who
said: “I accompanied ʿĀʾishah () [taking knowledge from
her] until I said before her death by four or five years, ‘If she died
today, I would not have been remorseful over anything that I
missed from her (regarding knowledge) [due to having acquired
an abundance of it already], for I did not see anyone more
knowledgeable of a verse that was revealed, nor an obligation,
nor a Sunnah, and I do not know of anyone more knowledgeable
of poetry and its transmission, and nor of a day of the days of [of
the history] of the Arabs, and nor of lineage and nor of such and

and such and nor of judgements and nor of medicinal treatment

than her’.”
From Masrūq who was asked: “Was ʿĀʾishah () proficient
in al-Farāʾiḍ, the laws of inheritance?” He said: By Allāh, I saw the
most senior of the Companions of Muhammad () asking
her about the laws of inheritance.36
Urwah bin al-Zubayr said: “I have not seen a woman more
knowledgeable of medicine, jurisprudence or poetry than
ʿĀʾishah.”37
ʿĀʾishah is from the greatest scholars of Islām, surpassing
many man, and she is highly respected and revered by Muslims,
and her marriage to the Prophet () is seen as an honour
for her. She brougth tremendous benefit to Islām and Muslims
and in particular to women, by virtue of her tremendous
scholarship. Muslims are not ashamed or cowered by the
hounding of the Islam-hating, resentful loons who try to use the
issue of this marriage to malign the Prophet and malign Islām.

This marriage has no connection, from near or far, to


“pedophilia”. Rather, it was a marriage, consummated between
two adults upon the customs of the society at that time. These
types of unions can be found in European, American and other
societies right into the 19th century, if not beyond.
The great Islāmic scholar, Shaykh Muḥammad bin Ṣāliḥ al-
ʿUthaymīn commented on the statement of Ibn ʿAbbās, the
Prophet’s cousin, to ʿĀʾishah (), “O ʿĀʾishah, the Prophet
() did not marry any other virgin besides you”, as occurs
in al-Bukhārī, with the following: “This is a refutation of the
Christians who said: ‘Muḥammad was a lustful man’ who had no
concern except for women.” If it had been as they had said, then

he would have chosen many virgins [as his wives]. And all of us

would choose virgins over non-virgins, unless there was a reason
not to do so, as was done by Jābir (). As for the Messenger
(), then he saw that in his numerous marriages there was
closeness to people, and the spreading of knowledge. For how
many a tradition is there that we do not know of except that it
came through the Wives of the Prophet (). And how
many of the elite of Quraysh were there who attained nobility
due to being in-laws of the Prophet. They were closer in their aid
and support of the Prophet () than others besides them,
as is appparent. Hence, the Prophet () did not marry any
virgin except for ʿĀʾishah () and he married her because her
father was the nearest of people to him and the strongest of them
in companionship with the Messenger of Allāh (). Hence,
he married the daughter of Abū Bakr and the daughter of ʿUmar
bin al-Khaṭṭāb.”38
Once all of this is clear, we are now ready to discuss what has
arisen in the modern era of the interest in “pedophilia” and for
which efforts are being made, to normalise it and make it
acceptable in Western societies.

Pedophilia in Western secular, liberal nations should be viewed
historically in light of the sexual revolution movements that
went into motion due to the philosophies and activism of people
like Wilhelm Reich,
Reich a student of Sigmund Freud,
Freud and Rene Guyon,
Guyon
a psychologist in the Freudian school after whom a society was
established with its slogan as “sex by year eight or else its too late”39
and which promoted incest with young children. Likewise, the
influential hedonistic lifestyles of philosophers such as Jean-
Jean-Paul
Sartre and Albert Camus and unscrupulous, fraudulent, immoral
“sex-researchers” such as Alfred Kinsey.

Kinsey was a pornography-addicted, bi-homosexual,
pedophile propagandist who often boasted of his large collection
of homosexual pornography to his friends. All data regarding
Kinsey is not “alleged” but in plain black and white in his own
writing and communications. Dr. Judith Reisman’s book, Kinsey,
Sex and Fraud, is an excellent reference work for detailed
evidence and her website is an excellent resource for learning
more about the child sexualization agenda that is sweeping
Western nations, spearheaded by gay activists under the banner
of human rights.41 Following the exposition of Kinsey multiple
efforts are in motion to whitewash Kinsey from the factual
allegations and to portray him as a hero.
Kinsey oversaw the sexual abuse and molestation of babies
and infants as part of his research to promote sexual freedom

ideas form the foundations of all modern sex education in
schools which can be summarized as follows: The The pretense of

marriage by consent with anyone who has reached puberty and
mental maturity.
In contrast, “pedophiles” have a sexual interest driven by
materialist, atheistic, liberal philosophies of sexual freedom and
the pursuit of unbridled lust. This makes them naturally
predatory and exploitatory. This goes a long way in explaining
why wars are being waged in Western societies by certain sexual

The tradition of marriage involving mentally mature 7-12 year
olds with the knowledge and oversight of their legal guardians
upon principles of fidelity and chastity which was acceptable in
many societies all across the world and cannot be put in the
same category as the predatory lust of post 1960s sexual
revolution philosophies which spawned the likes of Jimmy
Saville, Cyril Smith MP, Gary Glitter, Jeffrey Epstein and a host of

Let’s take a look at just one of aforementioned characters, Jean


Paul Sartre (d. 1980), the famous French existentialist
philosopher . Sartre was a serial seducer.

psychologically harmed by the disturbing experiences they were
put through. Jealousies would make them retaliate against each
other. Simone would sleep with men and Sartre would retaliate
by sleeping with girls (and sometimes, their sisters too).
Both would then recount to each other the sordid details of
their escapades. Simone de Beauvoir, who was a feminist, hated
marriage and family. She would recruit her pupils, exploit and
abuse them and then pass them on to Sartre for joint pleasure.
Girls were groomed by Beauvoir so Sartre could take their
virginity and Sartre’s rationale was that these girls would be
“empowered” by the experience and that in no way was it
harmful for them.

Albert Camus,
Camus fellow existentialist and close friend of Sartre,
“joined in most of the couple’s sex games. Camus slept with all
their impresssionable young girls.”43
The reader should note that these permissive philosophies
(whose propounders and practitioners such as Sartre and Camus
utilized to justify private lives of depravity outside the tradition
of marriage) played a role in helping to shape the negative
perception towards what had been a normal and standard
practice in many cultures and civilizations for thousands of
years: Marriage between a male and female adult of any age
(where the attainment of adulthood was marked by puberty)

In 1977, around seventy French intellectuals and politicians


signed a petition seeking to abolish all age of consent laws (for
sex). Michel Foucault44 writes in his History of Sexuality and Sexual
Morality and the Law (1990) that the list of signatories included
himself, Jean-Paul Sartre, Simone de Beauvoir, the jurist Jean
Danet, filmmaker Alain Robbe-Grillet, writer Philippe Sollers,
pediatrician and child psychoanalyst Françoise Dolto and many

the Liberation paper in March 1979 another letter of petition
signed by 63 intellectuals was published in support of a man who
had fornicated with six to twelve year olds. It was asserted in the
letter that a girl of six years old could give informed consent to
sex with an adult.46

Jean-Louis Bory (1919-1979), French writer and film-maker,
sodomist and activist. His autobiographical works include The
Skin of Zebras (1969) All Born of Woman (1976), and My Half of Orange
(1973). He appeared in the gay association Arcadia, giving his first
public lecture. He joined Front Homosexuel d’Action Révolutionnaire
and co-authored a book with its leader Guy Hocquenghem.
d) Guy Hocquenghem (1946–1988), sodomist, French writer
and queer theorist. Hocquenghem was the first male member of

e) Georges Lapassade (1924-2008), French philosopher and
sociologist, sodomist.
f) Christian Hennion (1949-1999) French journalist and

(FHAR). In 1995 he and his partner left Paris to travel in Sénégal,

So look at these leading intellectuals in France and consider what


motivated them to write and sign such a petition.

philosophies and sexual revolutions.
One should note that those at the forefront of campaigning for
lowering [if not abolishing] the age of consent in Western nations

instances. Namely, marriage between two adults—keeping in mind
puberty signalled direct transition to adulthood—overseen by parents

REMOVING A DOUBT
The more determined among the Islām-hating loons will not give
up after all of this because they have agendas to fulfil that are
based upon ideological hatred mixed with tinges of white supremacy
and far-right nationalism. So they have a doubt that they often
raise and we will address it briefly here.

MARRIAGES TODAY
The doubt comes after the reasons for marriage at a younger age
in the past have been explained and hence, the falsehood of the
accusation of pedophilia made clear. They then try to make it
appear that this explanation itself necessitates that Islam

encourages marriages of nine year olds. This is not true at all.


Rather, as we have stated, Islām does not specify any particular
age for marrriage as this is a matter that is determined by the
socio-economic and environmental factors of each society or
culture. Further, contemporary Muslim scholars are aware that
women may have their rights violated by their parents or
guardians and have spoken in this regard.
A notable Islāmic scholar, Shaykh Muḥammad bin Ṣāliḥ al-
ʿUthaymīn (d. 2001) spoke about unscrupulous and unjust fathers
who marry off their daughters out of their desire for the wealth
of suitor, to extract lots of wealth out of the suitor.
In his commentary on the Ṣaḥīh al-Bukhārī, a compilation of
Prophetic traditions, he explained that the marriage of ʿĀʾishah
() to the Prophet () cannot be generalised by fathers
to justify marrying their daughters early and that it is a must that
a daughter only be married by her father when she reaches
maturity and gives her consent. He states that any other opinion:
“Will lead to corruption in this era of ours ...” and further states:
“... And that which I consider is that from the angle of regulation
and disciplinary measures in the present era is that a father
should be prevented from marrying his daughter, absolutely,
until she reaches maturity and is asked for her permission... And

there is nothing to hinder us from preventing people from


marrying off women who have not reached maturity, absolutely
[without exception]...” and then the Shaykh went on to give
numerous precedents from the caliph ʿUmar () who
implemented laws to curb the excessive, unjust behaviours of
people in the affair of divorce and to suspend, temporarily, the
application of laws for theft in circumstances which demanded
that. This shows that Muslim scholars are aware of circumstances
which may demand regulation in matters that affect personal
rights or that affect the welfare of people. Thus, upon what
Shaykh al-ʿUthaymīn has mentioned, Muslim rulers have the
capacity to implement rules in order to address evils or violation

are married off without their consent at an early age.
Today, given the changes that have been brought to societies
and nations, to their economies and social structures—and we
include Muslim societies here too—it is clear that full mental
maturity is reached at a delayed age—unlike times gone by—and
that marriage at ages below mental maturity can bring about
harm or exploitation. We also see in many Muslim countries that
the age of consent for marriage are around 18 for males and
slightly lower for females at around 16 to reflect these changing
circumstances.
However, it should be made clear that the Islāmic legislation
does not specify any particular age for marriage and leaves the
affair to the customs and norms and habits of each society. And
since most developing societies are undergoing the same changes
today due to globalisation of economies and markets, access to
education, and mixing or merging of cultures, it is inevitable that
age of marriage is going to rise in all places.

THE MOVEMENT TO NORMALISE PEDOPHILIA


Finally, it should be noted that there is a movement in motion in
the West trying to lower the age of consent [for predatory sex]. It
is gaining ground due to its Fabian-like stealth mode of
operation. This movement is using similar tactics that were used
by homosexual propagandists and marketing experts to make
homosexuality normal, acceptable and fashionable over the past
three decades. Their aims are to abolish the age of consent if
possible and if not, to lower it as much as possible.
Those behind this movement, and its most vocal figures are
not Jews, Christians or Muslims—from religious backgrounds—
but they are atheists and socialists, and they are coming from the

angle of sexual liberation philosophies, for the pursuit of lusts,


and for exploitation camouflaged as “freedom” and “human
rights” for all ages and for destroying the family institution upon
which material and inheritance rights are built.

It is not hidden that a pedophile (pederast) subculture is part of


the broader “gay rights” movement. Mainstream homosexual
activists indirectly serve the cause of this subculture and its goals
to legalize pedophilia by campaigning against “sexual ageism.”
The campaigning strategies that were taken with respect to “gay
rights” are being implemented with respect to “child rights” by
which it is meant, “a child’s right have sex with adults.” Instead
of saying “homosexual pedophiles desire sex with boys” which is
the empirically accurate depiction of the affairs, it is deceptively
and cunningly presented as if children want to have sex with
adults and are being discriminated against. Thus, “child rights”
will be campaigned for using the “anti-discrimination” card.
Marshall Kirk and Hunter Madsen,
Madsen, authors of “After the Ball”,
write in this sophisticated and well-thought out propaganda
manual which is behind the success of the LGBT movement, “And
when we say talk about homosexuality, we mean just that. In the
early stages of any campaign to reach straight America, the

go to this stage, basically, you can bring in the “rights” argument
and you are almost there.
Then with lots of help from Hollywood movies, literary fiction
promoting soft-pedophilia to children, and meme-conveyance
through music and other forms of entertainment, you can
convince the general by gradually changing their perceptions
and playing with their emotions.

CONCLUDING REMARKS
In this treatise we have look at the accusation of “pedophilia”
against the Prophet of Islām [and by extension, the Prophets of
God in general and European royalty of the past] and exposed it
as a lie, deception and academic fraud.

It is incorrect to equate between the modern-day interest in
pedophilia [which is connected to sexual liberation movements
and philosophies] with the marriage practices of most nations in
history in which the age of adulthood and consent was much
lower, being tied to puberty which coincided with full mental
maturity or even came after it.
There are only three types of people who pursue this:
- the inquisitive truth seeker,
- the ignorant rabble,
- or the rank hater whose undergarments are ablaze.
