MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Agreement is made and entered into by and between:

The residents of Sitio Sapa-Seco (Kms. 7-8) Community in Upper Bunguiao, Zamboanga City, herein
acted for and in behalf by the BARANGAY GOVERNMENT OF BUNGUIAO, Zamboanga City, a legal
government unit existing under and by virtue of laws of the Philippines with principal office at Bunguiao,
Multi-Purpose Hall, Zamboanga City, duly represented herein by the Punong Barangay, Hon. NESTOR H.
ATILANO, hereinafter called and referred to as the CONSUMERS:

The UPPER BUNGUIAO MULTI-PURPOSE COOPERATIVE, a multi-purpose cooperative of upland

agricultural farmers which operates a mini-water system at Km. 10, Upper Bunguiao, Zamboanga City,
herein represented by its Board Chairman, BIENVENIDO LIMBANG, of legal age, Filipino, married, and a
resident of Bunguiao, Zamboanga City, hereinafter called and simply referred to as the COOPERATIVE.

WITNESSETH: That –

WHEREAS, the CONSUMERS maintain a water collection box at Sitio Sapa-seco, Upper Bunguiao
which was recently rehabilitated out of the 20% Development Fund of the Annual Appropriations of the
barangay for Fiscal Year 2008 and which, however, at present store and holds water that is found to be
unsafe for drinking;

WHEREAS, there exist an existing pipeline that carry safe water from the Mini-water system at
Km. 10, Upper Bunguiao, which was installed earlier for such purpose by the COOPERATIVE but was made
to close due to delinquencies by the former consumers in the payment for the water service;

WHEREAS, the COOPERATIVE has expressed willingness to resume water service to the residents
of Sitio Sapa-seco including the Elementary School;

NOW THEREFORE, for and in consideration of the above-premises, the parties hereto have
agreed and by these presents, hereby agree to the following terms and condition, to wit:

1. The COOPERATIVE shall supply water to the CONSUMERS who are made up of household
residents of Kilometers 7 and 9, Sitio Sapa-seco, Upper Bunguiao, Zamboanga City, for and in
consideration of the monthly payments of _____________________________ (P ___________),
Philippine Currency, to be paid by each household consumer within the first five days of each
month to an authorized collector;
2. The COOPERATIVE shall supply water service to Sitio Sapa-seco Elementary School free from any
forms of payments and/or charges;
3. The COOPERATIVE shall maintain the water facility from the source to the collection box at Sitio
Sapa-seco and shall have the right to cut off or close down water connection to delinquent
household consumers who fail to pay for their monthly water bills for three (3) consecutive
payment periods;

This AGREEMENT expires on _________________________.
