Honorable Lilibeth M. Nufio, Chairman of the Committee on Ordinances and

Resolutions, convened the meeting at exactly 09:38 in the morning to discuss the
following Proposed Ordinances:

1. Proposed Ordinance No. 2022-83, entitled “An Ordinance Requiring

Barangay in the City of Zamboanga to Adopt the Seal of Good
Housekeeping”, authored by Hon. El King Omaga and Hon. Vice-Mayor
Josephine E. Pareja

2. Proposed Ordinance No. 2022-55, entitled “An Ordinance Amending

Section 2 of Ordinance No. 414, entitled “An Ordinance Granting Burial
Assistance by the City Government of Zamboanga to Indigents and for
Other Purposes”; and

3. Proposed Ordinance No. 2022-33, entitled “An Ordinance Amending

Section 2 (A) of Ordinance No. 414, series of 2013, entitled ‘An Ordinance
Granting Burial Assistance by the City Government of Zamboanga to
Indigents and for Other Purposes’”, authored by Hon. Cary John O. Pioc

 As to Proposed Ordinance No. 2022-83, the Body has agreed to reschedule
the committee hearing on a later date since there are revisions recommended by the
Department of the Interior and Local Government.
As to Proposed Ordinance Nos. 2022-55 and 2022-83, Councilor Charlie
M. Mariano explained that based on the gist of the two proposed measures, the
objective is the same which is to substantially increase the assistance being granted
by the City Government of Zamboanga to indigents and their families to conform
with the present reality on the ground. Considering the similarity of the above
mentioned proposed ordinances, the proponents have agreed that both be
consolidated.
Councilor Mariano added that by the year 2023, there is will to be a substantial
reduction in the Internal Revenue Allotment and which definitely affect the number
of beneficiaries that would be eligible for the burial assistance if it will be pegged at
Fifteen Thousand Pesos (15,000.00Php). Consequently, he suggested that the
original proposition of Fifteen Thousand Pesos (15,000.00Php) be reduced to
Eight Thousand Pesos (8,000.00Php) and the same shall cover the following:
Embalming Services at Three Thousand Pesos (3,000.00Php), Coffin at Five
Thousand Pesos (5,000.00Php), and the item for Transportation be removed.
Councilor Al-Jihan R. Edding commented on Section (2), Paragraph (b) of the
proposed ordinance that it is commendable because it is the first time that the burial
of a Muslim had been specifically addressed to and she suggested to put a specific
amount taking into account how a Muslim individual is buried. Thus, Councilor
Mariano recommended to rephrase the aforementioned provision, to wit: “(b) If the
deceased is a Muslim, the amount of Eight Thousand Pesos (8,000.00Php) shall
be allotted for burial expenses and shall be given to the immediate family.”
Mr. George Acejas the representative from La Merced Funeral Homes
recommended that the burial assistance will not be given in cash but in a form of a
guaranty letter instead which was accepted by the authors. Corollary, Section 2 on
Disposition shall be read as: “The said amount shall be paid by the City
Government directly to the funeral home for the embalming and coffin of the
deceased through a guarantee letter.”
Councilor Mariano finalized Section (2), Paragraph (c) by changing the
amount of Fifteen Thousand Pesos (15,000.00) to Eight Thousand Pesos
(8,000.00Php). Thus, it will be written as: “(c) However, indigent-beneficiaries
have an option of availing a portion of, or the entire maximum and fixed amount
of Eight Thousand Pesos (P8,000.00) of the burial assistance and use the
remaining or entire amount, as the case may be, as payment for burial
space/ground/niche for the interment of the deceased-indigent at the designated
burial site in the Zamboanga City Public Cemetery.”
Mr. George Acejas of La Merced Funeral Homes, Mr. Mark Anthony Baro
from Remedios Funeral Homes, and Ms. Vidad from Villa Funeral Homes
enunciated that they have no objection and expressed their support on the proposed
ordinance.
After an extensive discussion, the Body has decided to approve the Proposed
Ordinance at the somites level, as amended.

Copy of the Proposed Ordinance with corrections are attached to this

committee report.
This report is being transmitted to the plenary for its approval and/or
appropriate action.

EXPLANATORY NOTE

WHEREAS, on April 27, 1989, the Sangguniang Panlungsod of

Zamboanga enacted Ordinance No. 96 entitled “An Ordinance Granting Free
Burial Expenses by the City Government of Zamboanga to Indigents and for
Other Purposes;”

WHEREAS, on October 28, 1999, the Sangguniang Panlungsod enacted

Ordinance No. 221, amending Section 2 of said Ordinance for the primary
purpose of enhancing the burial benefits being dispensed by the City Government
to indigent residents;

WHEREAS, on September 19, 2012, the Sangguniang Panlungsod of

Zamboanga enacted Ordinance No. 394 “An Ordinance Establishing and
Prescribing the Rules and Regulations, Administration, Operation, Disposition,
Fees and Use of the Zamboanga City Public Cemetery in Barangay Mampang,
and Appropriating Funds for the Operation Thereof, and Section 8 thereof
provides for discounted rates for the burial of adult and/or infant indigents;

126 (e) It shall also submit a monthly report to the Office of the
127 City Mayor, with a copy thereof being furnished the Committee on
128 Urban Poor of the Sangguniang Panlungsod.”

130 SECTION 3. SEPARABILITY CLAUSE. Should any provision, section
131 or part of this Ordinance be adjudged or declared illegal or unconstitutional by
132 any court of competent jurisdiction, such judgement shall not affect or impair the
133 remaining provisions, sections or part which shall continue to be in force and
134 effect.

136 SECTION 4. REPEALING CLAUSE. All ordinances, rules and
137 regulations, or part thereof, in conflict with or inconsistent with any provision of
138 this Ordinance, are hereby repealed, amended or modified accordingly.

140 SECTION 5. EFFECTIVITY CLAUSE. This Ordinance shall take effect
141 upon approval thereof.
