BEFORE THE MINNESOTA

BOARD OF SOCIAL WORK

In the Matter of STIPULATION TO CEASE


Mandy Erin Hyland, LICSW PRACTICING SOCIAL WORK
License No. 17135

1. The Minnesota Board of Social Work ("Board") has received information

related to alleged activities that could affect the license of Mandy E. Hyland, LICSW

("Licensee"), to practice as a licensed independent clinical social worker.

2. Licensee was criminally charged on June 28, 2023, in Olmsted County

Criminal Court with Criminal Sexual Conduct – 3rd Degree – Penetration – Prohibited

occupational relationship, in violation of Minnesota Statutes section 609.344. 1(d), with

reference to 609.344.2(1).

NOW, THEREFORE, LICENSEE AND THE BOARD HEREBY STIPULATE

AND AGREE AS FOLLOWS:

1. The Minnesota Board of Social Work ("Board") is authorized pursuant to

Minnesota Statutes sections 148E.001 to 148E.290 to license and regulate social workers and

to take disciplinary action as appropriate.

2. Licensee holds a license from the Board to practice as a licensed independent

clinical social worker in the State of Minnesota and is subject to the jurisdiction of the Board.

3. The Board has received information alleging that Licensee has engaged in

conduct that may violate the Board's Practice Act, including engaging in unprofessional conduct

and failure to report adverse actions to the Board.

4. Licensee shall CEASE AND DESIST from practicing social work in any

manner in the State of Minnesota and shall neither offer nor provide any social work services

within the state until this Stipulation is rescinded or modified.


5. The Board shall not initiate any disciplinary action against Licensee while

criminal charges are pending as long as she complies with the agreements in this Stipulation.

This Stipulation is not disciplinary action.

6. The Board may resume its investigation and disciplinary process following

disposition of Licensee’s criminal charges. Licensee shall inform the Board of resolution of the

criminal charges within ten days of the resolution.

7. Licensee's noncompliance with and violation of this Stipulation shall be

considered a violation of Minnesota Statutes section 148E.l 90, subdivision 2 (violating an

order of the Board) and constitute grounds for disciplinary action.

8. Licensee agrees that if she violates the terms of this Stipulation, the following

actions may be taken:

a. The Board may, pursuant to Minnesota Statutes chapter 14 and

Minnesota Rules 1400.5100 to 1400.8400, file a contested case at the Office of

Administrative Hearings.

b. Licensee agrees that in a contested case about an alleged violation of

this Stipulation, the administrative law judge may be limited to consider whether this

Stipulation was violated and whether there was sufficient or reasonable cause to excuse

such violation. If the administrative law judge finds that there has been a violation and there

is not sufficient or reasonable cause to excuse the violation, he or she may recommend that

it is appropriate for the Board to take disciplinary action against Licensee's license.

c. Licensee agrees that, in the event the Board receives findings of the

administrative law judge that there has been a violation of this Stipulation, the Board may

order disciplinary action, including a suspension or revocation of Licensee's license to

practice social work.
