2. Thereof, name of Mr. Vasant Sahadev Mhaske is entered on the 7/ 12

3. Mr. Vasant Sahadev Mhaske then sold the land bearing Survey

5. Following to which Mrs. Rama Shekhar Mhaske (Lawfully wedded wife
of Mr. Shekhar Sahdev Mhaske) name was entered as owner of the
land bearing Survey Number 137/5 admeasuring 00 H 54 R+ Pot

11. THAT from the perusal of 6D Mutation Entry No. 8823 it is revealed
that the said Mr. Narayana Vithhoba died on 18.06.1978leaving
behind him his legal heirs 1) Mr. Dnyaneshwar Narayan Pathare,
2) Mrs. Yamuna Devram Khavale, 3) Mrs. Jijabai Jaywant Thopte,
4) Mrs. Bhanubai Balosa Kakade, 5) Mrs. Shakubai Dynoba Randive,
and 6) Mrs. Lahanbai Haribhau Taware; and accordingly the names of
the aforesaid legal heirs were duly recorded in all the concermed
Revenue Records of the said land vide 6D Mutation Entry no 8823.
12. THAT from the perusal of 6D Mutation Entry No. 9716 it is revealed
that, the said Mr. Bala Ghenu Pathare died on 17.02.1957leaving
behind his legal heirs namely 1) Mr. Sopan Bala Pathare, 2) Mrs.
Anusuyabai Sadashi Awahale, 3) Mrs. Deubai Tukaram Sawant, 4)
Mrs. Jijabai Balkrushna Gaikwad, 5) Mrs. Anjanabai Raghu Thakur,
and 6) Raubai Baburao Gaikwad, and accordingly the name Mr. Bala
Ghenu Pathare was entered in the owner's column as HUF Manager
and the names of the other legal heirs were duly entered in the other
rights column of all the concerned Revenue Records of the said land
vide 6 D Mutation entry No 9716

30.09.1996, the aforementioned owners, i.e, Mr. Annada
Jabaji Pathare as HUF, Kondiba Shivram Patahre as HUF manager,
and Mr. Bala Ghenu
Pathare with the consent of 5 others, sold and
transferred the land admeasuring 4 Hectares 67 Area from out of land
bearing Survey No 137/1 totally admeasuring 9 Hectares 34 Ares
Situated at village Charoli Budruk , Taluka Haveli District Pune in

registered in the Office of the Sub Registrar Haveliand proper effect of
the said Sale Deed is duly given to all the concerned Revenue Records

of the said land by 6D Mutation

14. THAT from the perusal of 6D Mutation entry No. 11310, it is revealed
that the said Mr. Ranjit Prakash Mhaske availed the financial

assistance of Rs. 13,00,000/- from Ganesh Vividh Karya Seva


Sahakari Sociaty Limited by creating a charge on the said Survey No.
137/1 and proper effect of the said charge is duly given to all the
concerned revenue records of the said Land by 6D Mutation Entry No.

11310.
15. THAT on 30.09.1996, the aforementioned owners, i.e, Mr. Annada

Jabaji Pathare as HUF, Ananda jabaji Patahre as HUF manager,


Kondiba Shivram Patahre as HUF manager, and Mr. Bala Ghenu
Pathare with the consent of 5 others, sold and transferred 4 Hectares

67 Area from out of9 Hectares 34 Ares in the land bearing Survey No

137/1 situated at village Charhvoi, Taluka Haveli District Pune in


favour Mrs. Pratibha Prakash Mhaske, which Sale Deed is duly
recorded in the Office of the Sub Registrar Haveli, and proper efect of
the said Sale Deed is duly given to all the concemed Revenue Records

ofthe said land by 6D Mutation Entry no 11032.


16. THAT from the perusal of 6D Mutation entry No. 11966, it is revealed
that the said Mrs. Pratibha Prakash Mhaske availed the financial
assistance of Rs. 4,00,00,000/- from Citizen Co-operative Bank
Lamited by creating a charge on the said Survey No. 137/1 and proper
cfect of the sad charge is duly given to all the concerned revenue
records of the said Land by 6D Mutation Entry No. 11966

17. THAT on 11.06.2003, the said Mr. Ranjit Prakash Mhaske sold and
transferred his rights in the said land bearing Survey No 137/1

admeasuring 4 Hectares at village
Taluka Haveli District Pune in favour of Dr. DY Patil Educational
Mrs.
Enterprises private Limited through its directors namely: 1)
Pushplata Dyandeo Patil, 2) Mr. Vijay Dyandeo Patil, 3) Mr. Ajinkya
Dyandeo Patil, 4) Mr. Sadashiv Siddhu Pawar, 5) Mrs. Shalini
Sadashiv Pawar, and 6) Mr. Sampat Sadashiv Pawar, which Sale Deed
is duly registered in the Office of the Sub Registrar Haveli-15 bearing
Registration No 1772/2003, and proper effect of the said Sale Deedis
duly given to all the concerned revenue records of the said land by 6D

Mutation Entry No 11975.


18. THAT on 11.06.2003, the said Mrs. Pratibha Prakash Mhaske sold
and transferred his rights in the said land bearing Survey No 137/1
admeasuring 4 Hectares 67 Ares situated at village Charhvoli, Taluka
Haveli District Pune in favour of Dr. DY Patil Educational Enterprises
private Limited through its directors namely: 1) Mrs. Pushplata
Dyandeo Patil, 2) Mr. Vijay Dyandeo Patil, 3) Mr. Ajinkya Dyandeo
Patil, 4) Mr. Sadashiv Siddhu Pawar, 5) Mrs. Shalini Sadashiv Pawar,
and 6) Mr. Sampat Sadashiv Pawar, which Sale Deed is duly
registered in the Office of the Sub Registrar Haveli-15 bearing
Registration No 1771/2003, and proper effect of the said Sale Deed is
duly given to all the con cerned revenue records of the said land by 6D
Mutation Entry No 11980.
19. THAT on 29.10.2005, the said Dr. DY Patil Educational Enterprises
private Limited through its director Mr. Sampat S Pawar applied for
the Non Agricultural use of land for Gat no 299 and Survey no 137/1
along with the other lands, which NA Permission was granted by the
Collector, Pune vide an NA order bearing relerence no

PRH/NA/SR/301/2004.
20. THAT on l9.04.2005, the said Dr, DY Patil Educational Enterprises
private Lumited availed the loan facilities of Rs. 27,00,00,000/.
(Rupecs Twenty Seven Crores only) from the State Bank of India vide
regstered mortgage bearing Serial no 3033/2005. Accordingly the
charge of the State Bank of India was duly entered in all the
concerned Revenue Records of the said land vide 6D Mutation Entry
No 12218 The aforesaid loan was repad and the charge of State
EBarik of India was duly removed vide D Mutation Entry No 13283
21. THAT from the perusal of 6D Mutation Entry No. 13285, it is revealeu

that the Directors of M/s DY Patil Educational Enterprises pnvate


Limited namely Mr. Sadashiv Siddhu Pawar, Mrs. Shalini Sadashiv
Pawar, and Mr. Sampat Sadashiv Pawar has been retired from the
COmpany and only Mrs. Pushplata Dyandeo Patil, Mr. Vijay Dyandeo
directors ol the
Pail, Mr. Ajinkya Dyandeo Patil was remained as a

duly recorded in
Company. The proper effect of the said change
was

all the concerned revenue records of the said Property by 6D Mutation

Entry No. 13285.

22. THAT from the perusal of the 7/12 Extracts of the land bearing8

No 299 situated at village Charoli Budruk, Taluka Haveli

behind his legal heirs namely 1) Mr. Dnyaneshwar Narayan

and Mr. Bala Ghenu Pathare with the consent of 5 others, sold and

transferred their respective shares in the land bearing Survey No 299


situated at village Charoli Budruk, Taluka Haveli District Pune to Mr.

Sunil Sahadeo Mhaske, which Sale Deed is duly registered in the


office of the Sub Registrar Haveli and proper effect of the said Sale
Deed is duly given to all the concerned Revenue Records of the said

land by 6D Mutation Entry no 11031.

No 299 situated
transferred his rights in the said land bearing Survey
at village Charoli Budruk, Taluka Haveli District Pune to Dr. DY Patil

Educational Enterprises private Limited through its Directors namely:


Mrs. Pushplata Dyandeo Patil, 2) Mr. Vijay Dyandeo Patil, 3) Mr.

Ajinkya Dyandeo Patil, 4) Mr. Sadashiv Siddhu Pawar, 5) Mrs. Shaliní


Sadashiv Pawar, and 6) Mr. Sampat Sadashiv Pawar, which Sale Deed
is duly registered in the Offce of the Sub Registrar Haveli 15 bearing
Registration No 1764/2003, and proper effect of the said Sale Deed is
duly given to all the concerned Revenue Records of the said land by
6D Mutation Entry No 10723
27. D. Y. Patil Educational Enterprises Pvt. Ltd subsequenty changed to

M/s. Ajeenkya D. Y. Patil Infra Pvt. Ltd and accordingly the name of
new company is recorded as the owner of the above lands in the

revenue records of the said lands.


28. M/s. Ajeenkya D. Y. Patil Infra Pvt. Ltd has purchased the said land
along with the adjoining lands, which was in excess of ceiling
prescribed under the Urban Land (Ceiling and Regulation) Act, 1976.
On application made by the company, the Hon'ble Collector and

Competent Authority, Pune vide its letter No. ULC/260-D


Trust/105/10 dated 22nd February 2010 and the Government of
Maharashtra vide its letter No. ULC/2204/246/Najakadha-2 dated
20th January 2009 has regularized the purchase of the said land

subject to condition that the said land is to be used for educational


purpose and if the land is converted by the company for non
cducational purpose, then the company has to pay an additional

anount tor such conversion.

29. Whereas then M/s. Ajcenkya D. Y. Patil Infra Pvt Ltd has applied for
the permission to convert the use 60% of amalgamated lands for
comnereal & residential purpOse and accordingly, the change in land

use was allowed by the collector and competent author1ty. Pune


Urban Aggloneration vide its letter bearing number ULC/No

ULC/260 D Trust/ 168/19 dated 28 05 2019 after payng the


applicable tees as imposed by the Collector ate, Pune dated 20

January 2009
30. Whereas M/s. Ajeenkya D. Y. Patil Infra Pvt. Ltd through its
authorized signatory Mr. Rohit Rajan Mhaskar sold the said land to
APAK Business Innovation Pvr. Ltd sale deed registered vide

registration entry 3195/2022 dated 30.03.2022


3. APAK Business Innovation Pvt. Ltd later applied for and receved
Building permission for the proposed apartment by Building Plan

sanctioned by Maharashtra Housing and Area Development Authority


with sanction letter no EE/BP/PMAY/A/MHADA/396/2022.
