DEED OF SALE WITH ASSUMPTION OF MORTGAGE

KNOW ALL MEN BY THESE PRESENTS:

This Deed of Sale with Assumption of Mortgage made and executed by and between:

NOEL BALDONADO CENITA, Filipino, of legal age, married to ELVIE MERCADO


CENITA and with postal address at Barangay Munting Ilog, Silang, Cavite herein referred as the
VENDOR;
AND

NELNA PERALTA SARABIA, Filipino, of legal age, single and residing at 58 Zorra St.,
Paltok, Quezon City, NCR-Second District, herein referred to as the VENDEE,

WITNESSETH:

WHEREAS, the VENDOR is the present owner of a parcel of land located at Pinoy
Village, Barangay Sabutan, Silang Cavite with an area of FORTY (40) SQUARE METERS
covered by Transfer Certificate of Title No. 076-2020000402 including the residential house
found thereon by virtue of Contract-To-Sell executed on October 15, 2020 docketed as Doc No.
316; Page No. 64; Book No. 196; Series of 2020 under the notarial register of Atty. Joshua P.
Lapuz. The said parcel of land is more particularly described as follows:

That in consideration of the sum of TWO HUNDRED FORTY THOUSAND PESOS


(Php240,000.00) Philippine Currency, receipt of which is hereby acknowledged, the VENDOR
from the VENDEE, the VENDOR hereby SELL, TRANSFER and CONVEY unto the said
VENDEE, her heirs, assigns and successors-in-interest the above-mentioned house and lot;

WHEREAS, the VENDEE is fully aware that the subject properties are still being
amortized at the time of this Deed of Sale and the VENDEE shall assume the total and
outstanding obligation of the VENDOR to PAG-IBIG Home Development Mutual Fund.
Whereas, VENDEE hereby binds herself to pay monthly amortization of the above-mentioned
mortgaged property until full payment;

WHEREAS upon full payment by the VENDEE of the monthly amortizations due, the
VENDOR shall execute the Deed of Absolute Sale over the property and surrender
possession and control thereof to the VENDEE;

That the VENDOR join the VENDEE in requesting the authorities for the approval,
recognition, institution of the VENDEE, the claims, rights, interests and ownership over the
above-mentioned house and lot and obliges himself to execute, sign and deliver any and all
documents or papers which may be necessary for this purpose.

SPECIAL POWER OF ATTORNEY

KNOW ALL MEN BY THESE PRESENTS:

I, NOEL BALDONADO CENITA, Filipino, of legal age, married to ELVIE


MERCADO CENITA and with postal address at Barangay Munting Ilog, Silang,
Cavite do hereby name, constitute and appoint NELNA PERALTA SARABIA,
Filipino, of legal age, single and residing at 58 Zorra St., Paltok, Quezon City, NCR-
Second District, to be my true and lawful Attorney-in-Fact for me in my name, place
and stead, to do and perform the following acts, to wit:

“To appear and represent me in any and all transactions before the Pag-
IBIG FUND Home Development Mutual Fund concerning my housing loan application
located at Pinoy Village, Barangay Sabutan, Silang Cavite with an area of FORTY (40)
SQUARE METERS covered by Transfer Certificate of Title No. 076-2020000402.”

“To pay the monthly amortizations due, and to receive/claim any


documents from Pag-IBIG Fund particularly the Owner’s Duplicate Certificate of Title
and the Cancellation of Mortgage upon full payment of the said property.”

“To represent and transact official business with the Office of the Registry
of Deeds, Assessor’s Office, Bureau of Internal Revenue and other agencies in
connection with the cancellation of mortgage and transfer of ownership in her name; to
execute, sign and deliver Promissory Note/Notes in favor of the Pag-IBIG FUND, as
well as other documents that may be required by the said government financial
institution in connection with the said housing loan;

“To make, sign and execute, for and in my behalf, any documents which
may be necessary for the release of the Certificate of Title;

HEREBY GIVING AND GRANTING unto my said attorney-in-fact full powers and
authority to do and perform all and every act and thing whatsoever requisite and
necessary to be done in and about the premises, as fully to all intents and purposes, as I
might or could do if personally present, with full power of substitution and revocation and
HEREBY RATIFYING AND CONFIRMING all that our attorney-in-fact shall lawfully do or
cause to be done by virtue hereof in pursuance of the purposes above-stated.
