DEED OF EXCHANGE

KNOW ALL MEN BY THESE PRESENTS:

This Deed of Exchange made and entered into this _______ day of _______ in
____________, Philippines, by and between:

ARTEMIO H. NICOLAS, HELEN H. NICOLAS, ROMAN H. NICOLAS, RODEL

H. NICOLAS, MELYSAN H. NICOLAS, MARBELITA H. NICOLAS, and REY H.
NICOLAS, all of legal age, residents of Solsona, Ilcos Norte, Filipino Citizens, hereinafter
referred to as the FIRST PARTY;
-and-
HERMINIA MALVAR, a resident of Solsona, Ilocos Norte of legal age, Filipino
Citizen, hereinafter referred to as the SECOND PARTY.
WITNESSETH: That
WHEREAS, the FIRST PARTY are the lawful and registered owners of a parcel of land
situated at Brgy. Barcelona, Solsona, Ilocos Norte, Philippines and more particularly described in
Original Certificate of Title No. OC-6064 issued by the Registrar of Deeds of Ilocos Norte, to
wit:

A parcel of land, Lot 14970, Cad 574-d, VLT, situated at Barangay

Barcelona, Municipality of Solsona, Province of Ilocos Norte, Island of
Luzon, bounded on the NE by Lot 14969; on the SE by Lot 14971; on the
SW by Irrigation Canal; and on the NW by Lot 14913, 14917, 14918,
14924, 14925, 14928, 14929, 14930, 14931, 14934, 14938 and 14950,
containing an area of TWO THOUSAND THREE HUNDRED
SEVENTY-SEVEN (2,377) square meters, more or less.

WHEREAS, the Second Party is the lawful owner of a parcel of land situated at Brgy.
Barcelona, Solsona, Ilocos Norte, Philippines and declared under Tax Declaration No. 20-21-
0006-01138 with Property Identification No. 003-21-0006-030-54 and more particularly
described in the said Tax Declaration issued by the Municipal Assessor of Municipality of
Solsona, Ilocos Norte, to wit:

A parcel of land, Lot 14583-PART, Cad 574-d, situated at Brgy.

Barcelona, Solsona, Ilocos Norte, bounded on the NE by Brgy. Road; on
the SE by a canal; on the SW by Lot 14584,14582, and 14582; and on
NW by Lot 14582 and 14583-PART, containing an area of ONE
THOUSAND AND NINE HUNDRED TEN (1,910) square meters, more
or less.
WHEREAS, the FIRST PARTY agreed to convey, transfer, and cede a portion of their
above-described property consisting of ONE THOUSAND AND FOUR HUNDRED NINETY
(1,490) square meters in favor of the SECOND PARTY;

 WHEREAS, the SECOND PARTY likewise agreed to convey, transfer and cede a
portion of her above-described property consisting of ONE THOUSAND AND FOUR
HUNDRED NINETY (1,490) square meters in favor of the FIRST PARTY in exchange of the
property conveyed, transferred, and ceded by the latter;
WHEREAS, the portion of the property of the FIRST PARTY to be conveyed,
transferred, and ceded in favor of the SECOND PARTY shall be the Northern part of the above-
described property.
WHEREAS, the portion of the property of the SECOND PARTY to be conveyed,
transferred, and ceded in favor of the FIRST PARTY shall be the Northeastern part of the above-
described property (the portion where Helen H. Nicolas, Marbelita H. Nicolas, and Artemio H.
Nicolas constructed their residence. And the portion to be left to the SECOND PARTY shall be
the portion where her nephew, Virgilio Hipolito, constructed his residence);
WHEREAS, both parties have voluntarily agreed to exchange the properties as above-
described;
NOW THEREFORE, for and in consideration of the above premises, the FIRST
PARTY hereby cedes, transfers, and conveys unto the SECOND PARTY the Northern portion of
the first described property consisting of 1,490 square meters, and the SECOND PARTY
likewise hereby cedes, transfers and conveys unto the FIRST PARTY the Northeastern portion
of the second described property consisting of 1,490 square meters.
IN WITNESS WHEREOF, the parties have hereunto set their hands this ___ of ____ in

identification cards as written below their names, known to me to be the same persons who
executed the foregoing instrument and acknowledged before me that the same is their voluntary
act and deed.

That this instrument consisting of three (3) pages including this page where the
acknowledgment is written refers to the Deed of Exchange involving two parcels of land as
above-described and all situated in Brgy. Barcelona, Solsona, Ilocos Norte, duly signed by the
FIRST PARTY, SECOND PARTY, and their instrumental witnesses on each and every page
hereof.
