FORM OF CONTRACT AGREEMENT

This Agreement made the …….. day of ……………………… 2019 between

FARZINA MANJI P.O. BOX 8570 DARESALAAM (thereinafter called the
Client) and LEAL CONSTRUCTION COMPANY LIMITED OF P.O. BOX
100192 DSM ( thereinafter called “ the Supplier”) of the other part.

Whereas the CLIENT is desirous that certain works should be executed by the
CONTRACT FOR CONSTRUCTION OF RESIDENTIAL APARTMENT
BUILDING TO BE BUILT ON PLOT NO. 29,BLOCK 41 AT KINONDONI
CONTRACT NO. _____________________________________ and has
accepted the Tender by the Supplier for the execution and completion of such
works and the remedying of any defects therein in the sum of [TANZANIAN
SHILLINGS ________________________________________________ ONLY]
TSHS ________________________________ [hereinafter called “Contract price’]

HOW THIS AGREEMENT WITNESSETH AS FOLLOWS:

1. In this Agreement words and expressions shall have the same meanings as
are respectively assigned to them in the Conditions of Contract hereinafter
referred to,

2. The Following documents shall be deemed to form and be read and

construed as part of this agreement:
[a] The Letter of Acceptance
[b] The said Tender and Letter of Submission
[c] The Conditions of Contract
[d] The Specifications
[e] The Drawings; and
[f] The Priced Bills of Quantities

3. In consideration of the payments to be made by the Client to the Supplier as

hereinafter mentioned, the Supplier hereby covenants with the Client to
execute and complete the works and remedy any defects therein in
conformity in all respects with the provisions of the Contract.

4. The CLIENT hereby covenants to pay the Supplier in Consideration of the

Contract price or such other sum as may become payable under the
 provision of the Contact at the times and the manner prescribed by the
Contract

In witness whereof the parties thereto have caused this Agreement to be executed
the day and year first before written.
