AFFIDAVIT

I, MR. ROLANDO H. PANOY, 52 yrs old, married, laborer and resident of Purok

Vally, Barangay Dipolo, Molave, Zambonga del Sur, after having been duly sworn to

under an oath in accordance with law, hereby depose and say, to wit:

1. That on the 3rd week of March, 2012, at around 1:00 o’clock in the

afternoon, I was in the farm house of Mr. Bienvenido Mahawan, to rest in the swing, I

saw Levy (Levi) Durana Cañete, 36 yrs old married to Maricel, residing in the farm

house of Bienvenido Mahawan and I saw him removing the tire of Mr. Bienvenido

Mahawan’s trailer then I also saw him carrying it away from the farm;

2. That later on I learned that he met Mr. Roldan Bunghanoy residing at Bliss,

Molave, Zamboanga del Sur and Levy (Levi) Durana Cañete ask him if he wants to buy

the tire but Mr. Roldan Bunghanoy did not buy the tire because it doesn’t fit with his

motorcycle;

3. That when Bienvenido Mahawan ask me about his trailer tire, I told him the

truth that it was Levi aka Levy took it and look for a buyer of the said trailer tire. Later

on I learned that it was Boy Oriste Arnaiz who bought the said trailer tire for one

hundred fifty pesos (Php150.00) from Levy (Levi) Durana Cañete;

4. That I am executing this affidavit to establish the truth and veracity of the

foregoing facts and to support the filling of case against the suspect Levi D. Cañete

aka Levy D. Cañete in the court of law.

IN WITNESS WHEREOF, I have hereunto affixed my customary signature this 31 st day
