AFFIDAVIT OF DESISTANCE

I PAMELA CAPILI y ABENIA of legal age , house-wife,

single but with live-in partner & resident of Brgy. Tinago , Inopacan ,
Leyte after having duly sworn to in accordance with law hereby
depose and say that :

1. I am the complaining witness for Acts of Lasciviousness against

RICARDO HOLASCA y ERAYA ;

2. I am charging RICARDO HOLASCA y ERAYA for the crime of

ACTS OF LASCIVIOUSNESS / NPS Docket No.VII – 02f-INV-
22K-00105 ;

3. After my sober and soul searching assessment and analysis of the

incident, I have realized that the respondent accused cannot himself
decided not to continue with his criminal purpose having set one foot
on the verge of crimes, heed the call of his conscience and return to
the path of righteousness ;
 
4. Since I could not state with certainty and without doubt the liability of
RICARDO HOLASCA y ERAYA , in fairness to him, I am
permanently withdrawing my complaint against him. I clear him of
whatever responsibility or liability to me .
 
5. I hereby inform the Prosecutor of Hilongos , Leyte that I am
withdrawing my complaint for Acts of Lasciviousness i, Quezon
City .

6. I likewise request the Regional Trial Court , Branch 102 , Quezon

City to dismiss with prejudice the said criminal case .
