COMMISSION AGREEMENT

THIS COMMISSION AGREEMENT (“Agreement”) is entered into this day _____________


between, (“Company”) and ____________________ (“Agent”). The purpose of this Agreement is
to establish a Commission Plan and other parameters of employment where Agent can be
successful and rewarded for his/her efforts in achieving individual sales goals and the
Company can gain value from his/her employment.

I- Terms of the Agreement

This Agreement shall continue in effect from the above date until terminated by
Company. The Company may terminate this Agreement with or without notice or cause.
Nothing in this Agreement shall guarantee employment or supersede the at-will
employment laws of the Republic of the Philippines.

II- Position and Employment Classification

Your title will be _______________________ and you will report directly to the Sales
Supervisor. You are considered an exempt Agent and not subject to minimum wage or
overtime regulations. You are expected to be on the phone at least 70% of your working
time.

III- Duties and Responsibilities

Agent is expected to make every effort to optimize his/her sales performance and
engage in activity on a daily basis that will facilitate this goal. Required duties are as
follows:
a. Engage decision makers in conversations regarding services
b. Updates and maintains prospect database on daily basis
c. Place outbound calls to prospects
d. Meet sales quotas and revenue targets and provide a superior client
experience.

IV- Compensation Structure

Commissions: Figures are based on new revenue sold and paid each calendar
month.

TOTAL SALES COMMISSION


$500.00 and below 0% (threshold)
$501.00 - $2,500.00 10%

$2,501.00 - $5,000.00 15%
$5,001.00 - $7,500.00 20%
$7,501.00 - $10,000.00 25%
$10,001.00 - $15,000.00 30%
$15,001.00 and up 33%
Mark up = 50% (with qualifier, with at least $1,000.00) *
*The mark-up should not exceed 100% of the SRP.

Acceptable Sales Targets are intended to describe what is the minimal expectation
of the Company and should not be misconstrued as the ultimate goal of the Agent. Agent
should seek to excel in his/her sales activity and push to attain the highest level of sales
possible.
Commission Payments: Commissions are paid every 15th of the month for the
previous month’s earnings contingent upon satisfaction of all other requirements of this
Agreement.

V- Commission Contingencies

1. If Company terminates Agent’s employment, he/she shall receive commissions


on all completed sales up to the date of termination, residuals for the previous
month, and prorated commissions for the month in which the termination
occurred.

VI- Policies and Procedures

Agent shall coordinate all sales activities with the Production Department to
accomplish seamless contact with the author. Agent must submit report for each sale to
the Production Department after payment is confirmed. Agent also agrees to adhere to any
written or verbal Company policies and procedures.

VII- Confidentiality and Non-Disclosure

You agree to abide by the attached AGENT CONFIDENTIALITY AND NON-


DISCLOSURE/NON-SOLICITATION AGREEMENT, which you will be required to sign before
starting your employment with the Company.

VIII- Entirety of Agreement

This Agreement supersedes all other Agreements, either oral or written, between
the parties to this Agreement, with respect to the obligations contained herein and
contains all of the covenants and agreements between the parties with respect to such
agreement.

To confirm that you agree to the terms and conditions as stated in this Agreement,
please sign and date the enclosed copy of this Agreement.
