Background:

i) Expert Express is of the opinion that the Sole Trader has the necessary qualifications, experience, and
abilities to assist and benefit the Expert Express’s business.
ii) The Expert Express desires to employ the Sole Trader and the Sole Trader has agreed to accept and enter
such employment upon the terms and conditions set out in this Agreement.

Commencement Date and Term

i) The Sole Trader will commence a full-time contract with the Expert Express on the
2nd December 2022

Job Title and Description

i) The initial job title of the Sole Trader will be the following of a OFFSIDER/JOCKEY. The job duties the Sole
Trader will be expected to performing will be the following: Help delivering company goods, managing/lifting
heavy boxes, and reaching target delivery KPI’s.
ii) The Sole Trader will perform all duties as requested by the Expert Express that are reasonable.
iii) The Sole Trader may make changes to the job title or duties of the Sole Trader where the change would be
considered reasonable for a similar position in the industry or business of the Expert Express. The Sole
Trader’s job title or duties may be changed by agreement and with the approval of both the Sole Trader and
the Expert Express or after a notice period required under the law.
iv) The Sole Trader agrees to abide by the Expert Express’s rules, regulations, policies, and practices, including
those concerning work schedules, vacation, and sick leave, as they may from time to time be adopted or
modified.

Sole Trader Compensation

i) Compensation paid to the Sole Trader for the service rendered by the Sole Trader as required by this
Agreement will include an flat rate of $150 p/day and one week in arrears.
ii) The Company will pay to the Sole Trader all remuneration due under his contract, less any authorized
deductions, in accordance with terms of his contract. Payment will be made fortnightly (two weeks in arrears
Saturday/Sunday) by EFT directly into the designated bank account. The bank account should be under
the sole trader’s name.
iii) Expert Express is entitled to deduct from the Sole Trader’s Compensation, or from any other compensation
in whatever form, any applicable deductions, and remittances as required by law.
iv) The Sole Trader understands and agrees that any additional remuneration paid to the Sole Trader in the
form of bonuses or other similar incentive remuneration will rest in the sole discretion of the Expert Express
and that the Sole Trader will not earn or accrue any right to incentive remuneration by reason of the Sole
Trader’s employment.
v) The Expert Express will reimburse the Sole Trader for all reasonable expenses, in accordance with the
Expert Express’s lawful policies as in effect from time to time, including but not limited to, any AD Blue and
Diesel fuel that the Sole Trader puts into the company van and any data topped up on the company device
 in connection with the business of the Expert Express. Expenses will be paid within a reasonable time after
the submission of acceptable supporting documentation.
vi) The Sole trader must provide proof of purchase to management for all reasonable expenses in order to be
reimbursed.
vii) He/she understands that working under the sole-trader contract they must invoice Expert Express every
week accordingly and are not entitled to full/time benefits.

Place of Work

The Sole Trader’s primary place of work will be at the following location

• Mentone

Time of Work

The Sole Trader’s normal hours of work, including breaks, varies between the hours 5:00 am – 7:00 pm (not exceeding
12 hours p/day) If you cannot finish deliveries in this time, bring all remaining parcels back to base and it will be delivered
the following day. The company does not pay overtime.
Monday to Saturday.

The Sole Trader is entitled to a half an hour break (unpaid)

Leave, Resignation and Termination of Employment

i) If the Sole Trader requires a day or more off, they need to inform their Expert Express a week in advance.
ii) If the Sole Trader wishes to resign from Expert Express, the Sole Trader must advise the Expert Express
14 days in advance - minimum. Once the company is advised, the sole trader must continue working during
the 14-day period. Without a proper notice will lead to 30 days of pay hold.
iii) Upon termination of employment the Sole Trader must sign and return the Privacy and Disclosure
Agreement (NDA) to the Expert Express. Once received Expert Express will; inspect the company vehicle
to assess that the vehicle is free from any damages, check for any outstanding toll invoices and fines.
Anything outstanding will be deducted from the Sole Trader’s final pay, which will be paid within 14 days
business days from the Sole Trader’s last day at Expert Express.
iv) Where there is just cause for termination, Expert Express may terminate the Sole Trader’s employment
without notice, as permitted by law.
v) Once notice has been given by either party for any reason, the Sole Trader and Expert Express agree to
execute their duties and obligations under this Agreement diligently.

Company cell phone and Company van use guidelines

The Expert Express Sole Trader contract outlines basic guidelines for all Expert Express Sole Traders who are eligible
to receive a company Van and Cell phone as part of their daily job duties. Our company expects Sole Traders to use
their cell phones and Van’s prudently during work hours.

Cell phone use guidelines:

i) Sole Traders must not use their cell phones for surfing the internet/gaming during work hours
ii) Use company-issued phones for business purposes only and preserve them in a perfect condition
iii) Each Sole Trader is responsible for their own device, therefore will be responsible for the costs of any
damaged or misplaced devices
iv) Sole Traders must not swap their devices with any other colleagues at any time unless you have been
advised otherwise

Company van use guidelines:

i) Sole Traders must report any damages or problems with their assigned vans to Expert Express
management as soon as possible
ii) It is the Sole Trader’s responsibility to keep track of when their vehicle is due for a service and to let Expert
Express management know in advance
iii) Sole Traders must check their van regularly to ensure gas, tire pressure, and all car fluids are at appropriate
levels
iv) Your van is your responsibility therefore Sole Trader’s will be held accountable for any damage’s
v) Sole Traders must attach photos of their van inside and out to their run sheet at the begging of each day
vi) Sole Traders will be responsible for any costs of damages
vii) Sole Traders must complete and send in their van checklist at the end of every week to management
 viii) Do not swap vans with your colleagues unless the Sole Trader has been advised to do so by management
ix) If a Sole Trader is involved in an accident, they must advise Expert Express management immediately
x) Expert Express is not responsible for paying fines Sole Traders accumulate while driving a company vehicle
xi) Do not allow unauthorised drivers to use a company vehicle unless required by an emergency

Sole Traders will face disciplinary consequences if they do not follow our policy rules and requirements. Which may
include verbal and written warnings, termination, and if necessary legal action.

Non-Disclosure Agreement (One Way)

In consideration of employment by Expert Express and disclosure by Expert Express of confidential and trade
secret information, the now terminated employee hereby covenants and agrees to the following:
Confidentiality:
Employee acknowledges that during his employment at Expert Express, he was exposed to valuable
confidential and trade information of Expert Express. The employee agrees to treat all such information as
confidential and to take all the necessary precautions against disclosure of such information to third parties.
Employee acknowledges that trade secrets of the company will consist of but are not limited to:
A) Technical information: Methods, processes, compassion’s, systems, techniques
B) Business Informa on: Customer lists, pricing data, sources of supply, financial data and marking,
profusion or merchandising systems and plans

The Employee understands that this Agreement does not and will not prevent him from working for any other
company after the terminator of his employment with Expert Express if the Employee does not use or disclose
any such confidential and proprietary information.
Termination:

The Employee agrees that they are not obligated to any extra pay or benefits once Expert Express has paid
them in full accordingly. The employee will be paid in the full amount after 14 days staring from when the
NDA has been signed and returned to Expert Express and once all Expert Express uniform and equipment
is returned to management promptly in good condition upon termination of the Employee’s employment by
Expert Express.
The Employee agrees and understands that they are not allowed to post any bad reviews, negative
comments, or any information on social media/the internet about or towards Expert Express.
The Employee understands that any damages to Expert Express property or outstanding fines will be
deducted from the Employees full and final salary.
Governing Law:

This Agreement will be constructed in accordance with and governed by the laws of the State of Victoria.
Binding Agreement:

This Agreement expresses the complete understanding of the parties with respect to the subject ma\er and
supersedes all prior proposals, agreements, representation, and understandings. This Agreement may not
be amended except in a writing signed by both parties.
The failure to exercise any right provided in this Agreement shall not be a waiver of prior subsequent rights.
This Agreement each party’s obligations shall be binding on the representatives, assigns and successors of
such party. Each party has signed this agreement through its authorised representatives.
The Employee has 14 days to raise any concerns she/he may have regarding this agreement.
