On 08/20/23, at approximately 1531 hours, Sgt. Daly, PO Fortin, and I responded to the North Kingstown
Town Beach located on Beach Street for an active disturbance. The North Kingstown Police Department
received multiple calls for an active disturbance between a male resident and a male subject on the beach over
beach rights. There were multiple reports that the male subject was throwing items into the water.

Upon officers’ arrival, there was no active disturbance. The incident had occurred at the south end of the
beach front, near the rear of the property of 70 Cold Spring Lane. In speaking with multiple subjects on the
beach, they stated that a subject identified as Christopher Brady (63 YOA), was involved in an altercation
with the resident at 70 Cold Spring Lane later identified as Andrew McClatchy (61 YOA). I spoke with
, who explained she had the incident recorded on video while PO Fortin spoke with Mr. Brady.
In speaking with both parties, the following was learned:

Mr. Brady was with his wife, Thuy Pham, and their daughter, at the beach. Mr.
Brady had set up his beach chair along with a Blue Tommy Bahama Umbrella on the beach front near the rear of
the property of 70 Cold Spring Lane. Mr. Brady and his family were sitting below the high tide line. Mr.
McClatchy and his wife, Debra McClatchy (66 YOA), along with their daughter, Paige McClatchy (31 YOA)
came out of the residence and confronted Mr. Brady.

Mr. McClatchy believed that Mr. Brady was trespassing on his property due to Mr. Brady and his family
being over the high tide line, which invaded his property. Mr. McClatchy began to video tape Mr. Brady from
his cell phone and yelled at him "Identify yourself, tell me your name!" Mr. McClatchy was acting out and
verbally antagonizing Mr. Brady, asking him where he lives and asking him to move to a different location on
the beach.

Mr. McClatchy then walked over to due to her video recording him. was sitting to
the left of Mr. Brady, approximately 10-12 feet away. Mr. McClatchy had his cell phone in his hands and was
recording , he placed the cell phone in front of ' face and asked her what her name was,
and she did not respond. Mr. McClatchy then responded, "So your nameless?"

Mr. McClatchy walked back over to Mr. Brady and asked if he was leaving and Mr. Brady responded
"No, call the cops." Mr. McClatchy took Mr. Brady's blue Tommy Bahama Umbrella, ripped it out of the sand
and threw the umbrella into the water. Mr. McClatchy then pulled out his cell phone again and placed it close to
Mr. Brady's face. Ms. P. McClatchy started to intervene in the situation and told Mr. McClatchy to walk away
and take the cell phone out of Mr. Brady's face. Mr. Brady's daughter placed the blue umbrella back in the sand
after it was thrown in the ocean.

At this time, Ms. McClatchy got involved in the argument with Mr. Brady involving the beach rights of
the property. Mr. Brady walked away and proceeded to sit in his beach chair, while Mr. McClatchy still heckled
Mr. Brady asking him "What’s your name?" Mr. Brady requested Mr. McClatchy to get the cell phone out of his
face. Mr. Brady asked Mr. McClatchy if he wanted to fight him and said, "how old are you?" Mr. McClatchy
then put his cell phone away and said to Mr. Brady, "Come at me!" and "Bring it!" Mr. McClatchy kept trying to
walk towards Mr. Brady in an aggressive manner while Mrs. McClatchy got in front of him to prevent an
altercation.

Mr. McClatchy then called Mr. Brady a "pussy" and he was able to get around Mrs. McClatchy, he
grabbed the blue Tommy Bahama umbrella and ripped out of the sand. Mr. McClatchy threw it on the sand and
bent the plastic pole, which caused it to break. Mr. McClatchy walked away after he damaged the umbrella still
yelling towards Mr. Brady to "Bring it!" Mr. McClatchy challenged Mr. Brady to a physical fight and used
profane language in front of Mr. Brady’s' daughter.

Mr. Brady completed a hand-written statement, scanned, and attached to this report, wishing to pursue
criminal charges in the matter. and other witnesses did not wish to complete a hand-written
statement. did send two videos to my email from her cell phone that captured the incident. They
were uploaded to image drive for this case. Pictures were secured of the umbrella and where Mr. Brady was
sitting in relation to the shoreline and Mr. McClatchy’s property.

Officer Fortin and I spoke with Mr. McClatchy who believed that Mr. Brady was a "Marxist Antagonizer"
due to the new law introduced relating to waters and navigation. Mr. McClatchy believed that there were

Facebook groups against him due to this new act being introduced. Mr. McClatchy stated that he confronted Mr.
Brady about the situation but he refused to leave. Mr. McClatchy admitted that he got out of control and
damaged Mr. Brady's umbrella. Mr. McClatchy was upset due to people going on the beach front near the end of
his property.

Mr. McClatchy referred to that new act introduced in January 2023, Relating to Waters and
Navigation-Coastal Resources Management Council. In Article 1 section 17, it states that people "shall continue
to enjoy and freely exercise all the rights of fishery, and the privileges of the shore, to which they have been
heretofore entitles under the charter and usages of this state, including but not limited to fishing from the shore,
the gathering of seaweed, leaving the shore to swim in the sea and passage along the shore; and they shall be
secure in their environment of the state."

At the end of the Act, it stated the public has rights and privileges up to 10 feet landward of the high tide
line. After reviewing this act, Mr. Brady was below the 10 feet of the high tide line.

Based on the above-mentioned facts and circumstances, Mr. McClatchy was taken into custody
(handcuffed; double locked and checked for fit) for one count of Vandalism and one count of Disorderly
Conduct. Mr. McClatchy was placed in the rear of cruiser 214 (seatbelted) without incident. I transported Mr.
McClatchy to police headquarters to be processed. Prior to and after transporting Mr. McClatchy, the rear of
cruiser 214 checked negative for weapons or contraband.

While at police headquarters, PO Robinson and I processed (photographed & fingerprinted) Mr.
McClatchy without incident. Mr. McClatchy was given his Rights Form which he stated he understood and
signed the form accordingly and did not wish to make a phone call. Mr. McClatchy was searched, made cell safe
and secured in cell #24 without incident.

At approximately 1750 hours, Mr. McClatchy was arraigned by Justice of Peace Michael Robinson. Mr.
McClatchy was released on $1,000.00 Personal Recognizance. Mr. McClatchy was issued a court date to appear
at Third District Court on 09/01/23 at 0900 hours. Mr. McClatchy was released along with this personal
property to the front lobby.
