INTRODUCTION

People with disabilities in Malaysia are generally referred to as special children,


children of heaven, people with disabilities and special needs.The existence of this group
in the entity of an actual society signal to the community about the social role of the
community against the survival of this special group based on three main elements,
namely 'al-Ta'aruf', 'al-Ta’amul', and 'al-Ta’awun'.The element 'alTa’aruf' refers to the
aspect of knowing each other in understand and accept their differences and
differences.The element 'alTa’amul' means talking or interacting with them with respect
the culture of life of this special group.In addition, the element 'alTa’awun' completes the
signal of the existence of the disabled people, that is with provide assistance, meet needs,
and create space and equal opportunities in various aspects of life.

There are various terms used to refer to the definition of disabled. In this context,
the definition of OKU will be referred to as 'People Ability Disorder' since this term is seen
more positively. This matter was also highlighted by the former Vice Chancellor of
Universiti Sains Malaysia (USM), Professor Tan Sri Datuk Dzulkifli Abdul Razak.
According to him in Utusan Malaysia (2012), this disabled group should be seen in a way
that is right because the difference is not in terms of physicality but in terms of ability
caused by a natural cause or a desired event. They should be judged on their abilities
based on their unique abilities different from those who are considered perfect.

Basically, the responsible ministry that manages the affairs of disabled people in
Malaysia is the Ministry of Development Women, Family and Society (KPWKM). Under
this Ministry, The disabled are those who have long-term physical, mental, intellectual, or
sensory deprivation when interacting with various obstacles, and may restrict participation
fullness and effectiveness in society. JKM established in 1946 was a body or department
under the aegis of KPWKM that offers services to the target group including the disabled.

According to the Department of Social Welfare (JKM), the disabledencouraged to


register under this agency. This is to find out the number, distribution and categories of
disabled people in this country for planning purposes programs related to prevention,

education, habilitation and rehabilitation, training and services. This is intended to plan
the provision of facilities suitable for the needs of the disabled. In addition, this registration
allows registered disabled people to get appropriate services according to needs based
on level their functionality or disability.

ISSUE

The issues that have always been highlighted are the status of a disabled person
as a recipient, whether the disabled person can be considered as a ar-riqab and also the
illah that allows this consideration. The concept of ar-riqab has been expanded by some
scholars and ‘fatwa’ in Malaysian, building on ‘ijtihad’ of Muhammad Rashid Reda and
Mahmud Shaltut. ‘Illah ar-riqab was defined as the release from shackles of the person.
The extension of the meaning and notion of ar-riqab, however, varies depending on the
‘fatwa’ issued by the state’s ‘fatwa’ council. Basically in a sense, it may be divided into
three key concepts which is shackles of ignorance, shackles of societal issue, and
shackles of numerous in many aspects.

A space has been made available for OKU to be positioned as ar-riqab as a result of the
extension of the notion and interpretation of ar-riqab by the academics. A reference is
made to the regulations on registration, restoration, and control of ar-riqab (Negeri
Selangor) 2013, Schedule (Rule 3), List ofar-riqab in Social Problems, Category Six as
follows: Those who are afflicted with chronic diseases are qualified to receive zakah aid
from the asnaf ar-riqab programme, according to Shackled with Chronic Diseases. This
demonstrates without a reasonable doubt that OKU is entitled to zakah, but that it must
remain within the parameters of the OKU category. Because the ar-riqab can be regarded
as a stranglehold, shackling, menace, and misery of life, the Jawatankuasa Fatwa
Terengganu came to the conclusion that it should not be worn. Therefore, it has been
decided that the OKU group should be given zakah because they have the above
characteristics of ar-riqab, which are that they are hindered by their physical or mental
limitations as well as their future situation, which involves the exposure of Islamic
education and the provision of benevolent assistance. However, whether or not to give
them zakah depends on the findings of research on the circumstances in which the OKU
find themselves, as outlined below (Muda, 2013):

● The standards and demands laid out by Shariah. The Ministry of Health and the
Department of Social Welfare Before a certain legal provision or law is released, it
is crucial to comply with these requirements and criteria and take into account all
factors related to it because this issue is connected to the new ijtihad. The State
Islamic Council and the Zakat institutions are expected to use this study as a guide
when examining the issue raised.

● If they are destitute or impoverished, then they should get support through zakah
on the basis that will free them from these qualities so that they can become self-
sufficient. For instance, you may provide them with sufficient funds to enable them
to launch a business in a field that is well-suited to their capabilities and interests.
Those who are in charge of the distribution of zakah funds in each nation should
come up with a plan to organize the provision of such capital, and that plan should
be implemented. For instance, providing help in the form of zakah over the course
of a year in payments and monitoring their business on a periodic basis.

● If the OKU are wealthy but do not know how to break free from the shackling
characteristics described above, they are eligible for assistance in the form of
training, such as courses recommended by relevant parties and agencies, paid for
with the zakah funds that have been designated for that purpose.

● If they are wealthy people who are able to liberate themselves from these shackles
either through their own efforts or with the help of someone else, then they are
ineligible to receive zakah since they have broken the conditions that qualify them
for receiving it.

PROBLEMS

● Aqidah Problems:

➔ Addicted to drugs.
➔ Shackled by the problem of sharia crime
➔ Shackled by the wrong practices of Islam
➔ Shackled with a perverse lifestyle
➔ Suffering from chronic illness

CONCLUSION

The distribution of zakat for asnaf al-Riqab in Malaysia was not standardized. Several
zakat institutions distributed zakat funds in the form of bondage new while others
maintained the original definition of asnaf. The difference of zakat asnaf definitions in
Malaysia was causing a lot of problems considering Malaysia is a small country. Some
efforts have to be made as soon as possible in order to prevent confusions among
muslims.
