TERMS OF REFERENCE

OCCUPANCY PERMIT

1. OBJECTIVE
In order to comply with the time elements of securing an occupancy
permit in the construction and renovation of a Project handled by LBRDC
(LBP Resources and Development Corporation)

2. SCOPE OF WORKS
The private entity shall:

2.1. Secure a checklist of requirements from the office of the building


official (OBO) where LBRDC has an engagement in a project.
2.2. Offer a proposal for the lump sum cost of securing the occupancy
2.3. Submit for approval all plans, drawings, specifications, and fire safety
inspection certificate (FSIC), CFEI, and required documents on behalf
of LBRDC in securing an occupancy permit, notwithstanding the fact
that all requirements for application shall be provided by LBRDC.

3. DURATION
The outsourced entity will obtain the permits within a reasonable
timeframe, taking into account the complexity of the project and the
requirements of the relevant authorities The private entity shall deliver
the occupancy permit of the project to LBRDC for a period of 30 days
more or less.

4. QUALIFICATIONS OF THE PROSPECTIVE PRIVATE ENTITY

4.1. A recognized company or individual that must be a legally registered


entity in the Philippines, where LBRDC has prospect engagement.
4.2. The company/individual has a minimum of at least two (2) years of
experience in the delivery of a similar type of business.

5. DELIVERABLES
The private entity shall deliver the project's occupancy permit to LBRDC
free from any questions or doubts about its origin and integrity. The
occupancy permit issued by OBO shall be passed through all required
legal processes.
6. DOCUMENTS AND SERVICES TO BE PROVIDED BY LBRDC AND
PMED

The following services and facilities will be provided by LBRDC.

6.1. DATA – LBRDC will provide the private entity with access to all
available data, information, maps, drawings, and documents relevant
to the application for an occupancy permit.

Documents to be Submitted

A. Certificate of Completion for Occupancy Permit signed and sealed by


Designing Engineers and Engineers in charge of supervision.

B. OTHERS
 Notarized authorization Letter (for Applicants representative)
 Affidavit of undertaking, consent, etc. (if necessary)
 Electrical Safety Certificate Signed and Sealed by Professional
Electrical Engineer
 Report of Insulation Report signed and sealed by Professional
Electrical Engineer
 Testing and commissioning for the Fire Detection Alarm System
(FDAS) signed and sealed by Professional Electronics Engineer
 Certificate of Completion for the Installation of Fire Detection Alarm
System (FDAS) signed and sealed by Professional Electronics
Engineer
 Water Potability test result signed and sealed by Professional
Mechanical Engineer
 Certificate of Completion signed and sealed by a Professional
Mechanical Engineer
 Hydrostatic Test Result of Cold-Water Line (CWL) signed and sealed
by a Professional Mechanical Engineer
 Gravity Test Result of Sewer Line (SW) signed and sealed by
Professional Mechanical Engineer
 Copy of Approved Building Permit and Ancillaries’ Permit
 Copy of Approved Plans

C. CLEARANCES
 Fire Safety Inspection Certificate
 Certificate of Final Electrical Inspection

D. BUILDING PLANS
 Signed and sealed 5 sets of As-Built Plan Architectural
 Signed and sealed 5 sets of As-Built Plan Structural
 Signed and sealed 5 sets of As-Built Plan Plumbing/ Sanitary
 Signed and sealed 5 sets of As-Built Plan Electrical
 Signed and sealed 5 sets of As-Built Plan Fire Protection
 Signed and sealed 5 sets of As-Built Plan Electronics
 Signed and sealed 5 sets of As-Built Plan Mechanical

 Signed and sealed 2 sets of Boring/Soil tests for 3 storey and above
 3 sets of Photocopies of PRC IDs and PTRs
 Boring/soil test for 3 storey and above
 Signed and Sealed 5 sets of Certificate of Final Electrical Inspection

 Signed and Sealed 5 sets of Plumbing Permit Forms
 Signed and Sealed 5 sets of Mechanical Permit Forms
 Signed and Sealed 5 sets of Electronics Permit Forms.

6.2. ACCESS – LBRDC will assist the private entity in arranging visits to
proposed project sites.

7. PAYMENT SCHEDULE

Payment for the scope of works done by the private entity shall be on a
milestone basis as tabulated herein:

8. DAMAGES AND PENALTIES

When the private entity fails to satisfactory deliver the required


documents or services under the contract/quotation within the specified
delivery schedule or inclusive of duly granted time. LBRDC shall impose a
penalty in the form of liquidated damages for any delay in the
commencement of required documents.
Failure to comply with the required documents set by LBRDC, a penalty of
one-tenth (1/10) of the contract price shall be imposed on the private
entity until the defect is corrected. Payment of liquidated damages shall
not affect the LBRDC liabilities. Once the cumulative number of liquidated
damages reaches ten percent (10%) of the amount of the contract, the
private entity may rescind or terminate the contract, without prejudice to
other courses of action and remedies under the circumstance.
