Please note that the Enforcement Directorate (hereinafter referred to as “ED”) conducted search and seizure at our aforesaid office on 21.08.2023 in connection with an investigation in ECIR Case No. KLZO/19/2022. The said search started at 11:35 AM on 21.08.2023 and continued till early hours of 22.08.2023. During the said search and seizure operation, our employees Asish Biswas and I were present at the office all throughout. Another employee Ms. Sushmita Chakraborty was present till 10:15 PM on 21.08.2023. ‘The ED team was led by Mr. Mithilesh Kumar Mishra and consisted of 5 other officers, namely, Mr. N. K. Mosha, Ms. Raksha Gupta, Mr. Jatin Bansal, Mr. Nawdeep Kumar and Mr. Mintu Handique. ‘The ED team was accompanied by two other persons, namely, Mr. Sucharit Mukhopadhyaya and Ms. Priyanka Sengupta who acted as panch witnesses. Our office has three desktop computer systems, all of which were thoroughly searched by the ED Officers who were granted access to such systems by us. The three desktop computer systems have the respective ID Nos. being (a) 45FFIA98-SD78- 42E9-AC5S-58326B2FA8FF, (6) _321C194B-FEBA-4921-9DF9-8E6ADO7DCIF7 and (c) A34CDIE2-7755-40F6-8004-3 10DC986814F. The ED officers seized the Hard Disk Drive of the desktop computer system bearing ID No. 4SFF1A98-5D78-42E9-AC55-58326B2FA8FF. The other two Hard Disk Drives belonging to the other two computer systems were not seized by the ED officers. Once the search and seizure was completed, the ED officers handed over a Panchnama to us along with the list of recovered and seized item. A bare perusal of the “List of Recovered and Seized Items” at SI. No. 12 will indicate one Hard Disk Drive being Seagate — 500 GB, S. No. 6CCMSEBD, ST-3500414CS, P/N-9GW142-160, Data Code 13232. A copy of the Panchanama alongwith the “List of Recovered and Seized Items” is enclosed herewith and marked as “A”. Yesterday i.e. on 24.08.2023, in usual course, we were going through the other two systems whose Hard Disk Drives were not seized by the ED Officers. We were surprised to find that the computer system having ID no, 321C194E-FEBA-4921-9DF9-8E6ADO7DCIF7 contained 16 numbers of Microsoft Excel files which were downloaded between 00:07 hrs. to 00.11 hrs. on 22.08.2023. I pertinent to mention here that during the aforesaid period, the said computer system was being ‘operated and controlled by the ED Officers and we did not have any access to such computer system, It is evident that these files were downloaded by the ED Officers while they had gained access to the said computer system under the pretext of conducting search and seizure. It is apparent that the ED officers have illegally and without our permission, accessed and downloaded files into our computer system on the pretext of conducting search and seizure. In the process, the ED officers have altered the information that is stored in our computer system having ID No. 321C194E-FEBA-4921-9DF9-8E6ADO7DCIF7. The ED Officers have thereafter stored such unknown and unverified data/information/files, that were illegally downloaded, in the computer system without the knowledge and/or permission of our company of any of its employees. Such acts have been done by the ED Officers dishonestly and by keeping us completely in dark. At around 11:35 hours, we, along with the officers of Enforcement Directorate headed by Shri Mithilesh Kumar Mishra, Assistant Director, Kolkata Zonal Office-II, Enforcement Directorate, CGO Complex, 3rd MSO Building, 6th + wi Shay: 2806/93Dated 22/08/2023 ‘From 21/08/2023 (11:35 hrs) to 22/08/2023 (00:15 hrs) Floor, DF Block, Salt Lake, Kolkata — 700064 reached the aforesaid office premises of M/s Leaps and Bounds Private Limited. After reaching at the aforesaid office premise, Shri Mithilesh Kumar Mishra and his team introduced themselves to one lady who introduced herself as Ms. Sushmita Chakraborty, office Executive of M/s Leaps & Bounds Private Limited. The officers then informed her about the purpose of their visit and showed the Search Warrant bearing No. 79 of 2023 dated 21.08.2023 issued by Shri Ramdhan Dagar, Deputy Director, Enforcement Directorate, Kolkata Zonal Office-II, CGO Complex, 3rd MSO Building, 6th Floor, DF Block, Salt Lake, Kolkata - 700064 under Section 17 of the Prevention of Money Laundering Act, 2002 (15 of 2003) authorizing Shri Mithilesh Kumar Mishra, Assistant Director, Kolkata Zonal Office-IL, Enforcement Directorate, CGO Complex, 3rd MSO-Building, 6th Floor, DF Block, Salt Lake, Kolkata — 700064 to” conduct search of office premises of M/s Leaps and Bounds Private Limited situated at P-733, Block-P, New Alipore, Kolkata-700053. ‘Ms. Sushmita Chakraborty signed on the said search authorization in token of having seen the same. We the panchas have also appended our dated signature on the said search authorization. Then Mr. Mithilesh Kumar Mishra, Assistant Director has introduced his team members to ‘Ms. Sushmita Chakraborty namely, Sh. NK. Mosha (Enforcement Officer), Smt. Raksha Gupta (Enforcement Officer), Sh. Jatin Bansal (Enforcement Officer), Sh. Nawdeep Kumar (Assistant Enforcement Officer) and Sh.Mintu Handique (Sepoy) and explained her about their purpose of visit and requested her to cooperate, The officers have then “ Sidiy Ne ys a? Then the officers enquired about the other office staff in the premises, to which Ms. Sushmita Chakraborty replied that along with her, one peon/office assistant namely Mr. Ashish Biswas ‘was also present. Thereafter, the officers of Enforcement Directorate commenced the search in our presence as well in presence of the aforesaid staff of M/s. Leaps & Bounds Private Limited. During the search, at 01:05 pm, one person, who identified himself Sh. Chandan Banerjee, Accounts Assistant of M/s. Leaps & Bounds Private Limited, R/o 57, Sister Nivedita Road, Tahkurpukur Mahestola, 24, Parganas South, West Bengal- 700063 arrived at the premises and he was also shown the search authorization number 79/2023 on which he appended his dated signature as a token of having seen the same. The officers of Enforcement Directorate started conducting the search of the said office premises which consists of one hall alongwith reception area, one record room, 2 cabins & one kitchen on the first floor. As a result of search, documents and electronic devices were recovered and seized. The details of the same are mentioned in the Schedule of Annexure — A to this Panchnama. We, the Panchas along with Mr. Chandan Banerjee had also put our dated signatures on every page of the documents numbered by hand. The officers have not seized any other document/ record/ material objects other than what has been mentioned in this Panchnama. The search procedure commenced at 11:35 AM on 21.08.2023 and concluded at 00:15 hrs on 22.08.2023. On conclusion of search, the officers have again offered themselves for their personal search to Mr. Chandan Banerjee to which he declined politely. After conclusion of the search, Summons was issued to Sh. Chandan Banerjee for recording his statement u/s 50 of PMLA, 2002. The Panchnama was typed on the laptop by the officers of Enforcement Directorate as per our narration.
