RULES & REGULATIONS
A) Administration & General Rule
• Organizer means the Unitedworld School of Law, Karnavati University.
• Competition means UWSL Intra Moot Court Competition, 2023.
• Participating Team means the team that has registered itself for the
competition as per the rules.

B) Time, Date & Venue


• The UWSL Intra Moot Court Competition, 2023, shall be held during 25th -
26th August, 2023.
• Venue: Unitedworld School of Law, Karnavati University Uvarsad-Adalaj Road,
Knowledge Village, Gandhinagar, Gujarat, 382422

C) Language
• The official language for the Moot Court Competition shall be English only.

D) Eligibility
• Students of B.A.LL.B/BBA.LLB (II, III, IV Year) are eligible to participate.
• One student cannot be the part of two teams.
• It is not compulsory that all the members of any teams shall be from the
same semester.

E) Team Composition
• There will be a maximum of 22 teams decided on the first come first serve
basis.
• Each team shall consist of Two Speakers and One Researcher.
• The organizing committee will assign a Team Code to each team.
• Only those members of the team who are designated as speakers will be
permitted to present oral arguments in the Competition.

F) Dress Code
• Participants are required to adhere to the following dress code while present
in any court room during the Competition
• Ladies: White shirt and black pant/black skirt along with black tie, black coat
and black shoes.
• Gentlemen: White shirt, black trousers, black tie along with black coat and
black shoes.
• Strict adherence to the dress code is solicited. Failure will result in
disqualification.
STRUCTURE OF
THE COMPETITION
• The formal commencement of the competition shall be on 25th August, 2023
(Friday) with the Orientation, registration of teams, draw of lots and exchange of
memorials. Any team which arrives late will not be allowed to participate in the
competition.

• The competition will only comprise of preliminary and final rounds. Each
team will present their arguments before a panel of judges, simulating a court
hearing. The Petitioner shall be allotted a total of 15 minutes to speak, including
any surrebuttals. The Respondent shall be allotted 15 minutes for rebuttal and
arguments. Any extension of time beyond the specified period shall be subject
to the discretion of the judges.

• The division of the time between the speakers is the discretion of the team
members, subject to a maximum 8 minutes for one speaker. Before the
commencement of the round, each team shall indicate to the court officer as to
how they wish to allocate their time.

• Top 4 teams, with highest total scores in prelim round shall be qualify for the final
round. The side to be represented by a team shall be determined by way of draw
of lots with the teams picking the lots after the completion of the preliminary
rounds.

• Each team shall get a total time of 20 minutes to present their case and this shall
include the time for rebuttal and Surrebuttal. Any extension of time beyond the
specified period shall be subject to the discretion of the judges.

• The scores or rankings obtained by each team in the final round will be
accumulated to determine the overall standings. Teams with the highest
cumulative scores or rankings will be declared winners.
MOOT PROPOSITION
• The “Sensational Voice of the Nation” prize went to Indiana native and 16-year-
old Justin Weiber. He was a phenomenal singer, incredibly accomplished in
classical and folk music as well as jazz, rock, rap, and hip-hop. He aspired to
advance his musical career by putting out fusion albums that mixed several
genres and by going on international music tours. He desired a multifunctional,
cutting-edge architectural wonder with a roof-top pool for holding parties, a
theatre for live musical performances, and a recording studio. He advertised the
job under the false pretence of being a major.

• Jack & Jones was a renowned builder and supplier of infrastructure. They
proposed to complete the entire project for Rs. 10,000,000. Both parties were
aware that the contract’s price was unreasonably low and that it would be paid
in installments as the various phases of the assigned task were finished.

• Justin agreed to their offer and signed a contract to develop the multipurpose
structure and supply all of its amenities. The first floor was designated for the
music theatre, the second floor was designated for the recording studio, and the
top floor was designated for the rooftop pool, according to the contract.

• Jack & Jones finished building the ground and first floor but were unable to
continue because of a lack of resources. They told Justin that without further
funding, they would not be able to finish the project.

• Justin was anxious to have the roof top pool construction finished as planned
because he had planned a poolside party to which he had invited top music
directors, producers, and other renowned members of the music industry
whom he believed would fund for his dream music albums and music tours. He
had asked for the building work to continue and for the remaining Rs. 7,00,000
to be paid for out of their own pockets. He had also promised to pay them the
money as soon as his record was published.

• The party went well and the roof-top pool was finished. Justin signed a contract
with Y Series Producers, who pledged to provide funding for the international
tours and the fusion albums. Justin said to Mr. Jack, Jack & Jones’ manager, “Sir,
you have saved my career. Don’t be concerned about Rs. 7,00,000”. With this as a
guarantee, Jack & Jones launched a brand-new undertaking. But Justin’s latest
fusion album was a total failure. His loud and strange fusion music was heavily
parodied by social media users and meme pages. He subsequently discovered
that he was unable to pay Jack & Jones the sum of Rs. 7,00,000/-

• On the basis of humanism, both parties resolved to change the contract on


Justin’s eighteenth birthday. Justin accepted the obligation he owed Jack &
Jones for previous services rendered, and both parties agreed that Justin would
settle the loan in easy monthly payments (EMIs) of Rs. 20,000 until the whole
amount of Rs. 7,00,000 was paid back.
• Justin believed that Jack & Jones did not complete the work exactly as he had requested. He also
emphasized how poor quality and unsatisfactory the building materials were. He calculated that it
would have only cost them Rs. 3,000,000. He asserted that he had already made the payment.

• Justin then made the decision to sell his property without giving Jack & Jones a single penny. When
they became aware of all the wrongdoing, they attempted to control him by applying intense pressure
in an effort to recoup the Rs. 7,00,000 they had spent on the building’s construction and amenities.
Even after such a long time and a different form of payment, Jack & Jones were unable to get Justin to
pay back the debt. In desperation, they handed him a court summons demanding that the money be
returned within 15 days. Justin, however, didn’t respond to the said notice or send any contact.

• In this situation, Jack & Jones ultimately chose to seek redress via the Court of Law. Jack & Jones brought
the lawsuit before the Civil Court of Dehali, in the State of Indiana, on the grounds that Justin Weiber
had previously refused to pay the loan made available to him for Rs. 7,00,000 and had accused him of
fraud, despite the fact that the building had been built in accordance with the terms of the contract.
Additionally, they asked for an injunction to prevent Justin from selling the house until the lawsuit was
resolved.

• After hearing the case, the Civil Court of Dehali ruled that a minor cannot enter into a contract, supporting
the decision in Mohori Bibee v. Dharmodas Ghose to release Justin from all obligations to Jack & Jones.
The Plaintiff’s claim of restitution was denied, and an injunction was not granted. The High Court of
Dehali heard an appeal that Jack & Jones preferred. The High Court decided to consider the matter on
the merits and granted an injunction.

The following are the issues framed for consideration:

• Whether there is a valid contract between Jack & Jones and Mr. Justin Weiber?

• Whether the judgment passed in Mohori Bibee v. Dharmodas Ghose needs reconsideration?

• Whether the Civil Court of Dehali was correct in rejecting the plea of restitution?

Note:

• Any other relevant issue that the mooters find


appropriate can be raised, subject to a maximum of
four issues in total.

• The principles of supply of ‘necessaries’, frustration of


contract, estoppel, ratification and novation may be
relied upon.

• Laws of Indiana are pari materia to laws in India.

• Common Law judgments and other foreign


judgments hold high persuasive value in Indiana.
MEMORIAL RULES
• All memorials submitted for all purposes of the Competition shall strictly adhere
to the rules of the Competition.

• Each Team participating in the Competition must prepare one Memorial on


behalf of Petitioner(s)/ Appellant(s) and one on behalf of the Respondent(s).

• The mode of citation throughout the memorial shall be 19th Edition of Harvard
Bluebook.

• The memorials shall not contain any form of identification apart from the team
code. If any such identification or mark, symbol, etc. which has the effect of
identifying the team is found on the memorial, then it shall result in instant
disqualification.

• Name of the soft copy of the memorial to be submitted should be named as the
Team Code followed by the side. For Example: TC01 Appellant

• Each Team must send a soft copy of their memorials, in PDF format only, for
evaluation by 15th August, 2023 (Tuesday) before 11:59 P.M.

• Memorials must be submitted to  kumcs.uwsl@karnavatiuniversity.edu.in  with


the subject “Memorials for UWSL Intra Moot Court Competition” followed by
TEAM CODE. Memorials submitted beyond the deadline shall incur a liability of
10 points for the first day of delay, and 10 points each day for every subsequent
day till 17th August, 2023 (Thursday). No extension of time will be granted with
respect to this deadline. Memorials shall be sent as an attachment with the mail
in the form of a single file for each side of the memorial.
GUIDELINES FOR
FORMATTING
All memorials shall be prepared to the following specifications:

• Memorial or counter memorial shall not be more than 25 typed pages.

• Font and size of the text of all the parts of the memorial (excluding footnotes)
must be the same and must be in Times New Roman 12 font size.

• The text of all parts of each memorial must be double line-spaced, with one-
inch margin on both sides.

• The texts of footnotes may be single line spaced. The font size of footnotes
must be 2 points less than the text font.

• There must be double spacing between separate footnotes and between each
heading and the body text of the memorial.

• Quotations of sources outside of the memorial of fifty words or more in any


part of the memorial shall be block quoted and must be single spaced.

• The Table of Content, Index of Authorities and Case Title are not included in the
25 typed page limit.

• The participating teams shall submit their team details by filling up the
