UNDER SECTION 13 B OF THE HINDU MARRIAGE ACT.

The Petitioners above named beg to submit as follows:

1. The Petitioners are Hindus and their marriage was solemnized on 27-10-2017,
at Poornima Convention Hall, Bangalore– 5600063, as per Hindu rites and
customs. The Petitioners herewith produce copy of the said Marriage Invitation
and the Marriage Photo for kind perusal and the same is marked are Documents
Nos.1 & 2 respectively Thereafter, the Petitioners together lived as Husband and
Wife till January 2019 in the house of Petitioner No.1. From 1 st Week of February
2019 the said Petitioner No.2 has been living separately with her paternal Senior
Uncle in the address as furnished above for the reasons stated infra .

2. It is humbly submitted that after the marriage, for some days, the conjugal
relationship between the Petitioners was quite congenial. Both of them lead good
married life. However, due to irreconcilable mis-understandings, there has been
incompatibility between the Petitioners which has widened itself as two parallel
lines, leaving no chance for get together in the days to come. Though both the
Petitioners tried to adjust with the other and lead a good married life, there has
been no tangible positive results. In fact, the parents and other well-wishers of the
petitioners also tried to patch up the differences between the petitioners. However,
the same also did not yield any positive results. The resultant position is that the
Petitioners are forced to live under different shelters for more than one year.

3. The Petitioners humbly submit that in view of the existing facts and
circumstances, there is absolutely no scope for the Petitioners resolving of their
differences and lead a peaceful and happy married life. The only alternative left
for the Petitioners is to approach this Hon’ble Court with the instant petition as
they have agreed to disagree with regard to patching up of their differences and to
live together and lead a happy married life. The sincere, honest, earnest and
prompt efforts of elders and well wishers of the Petitioners, has lead the Petitioners
to only concur for filing the instant Petition.
5.The cause of action for the petition arose subsequent to 1-2-2019 when 2 nd
Petitioner started living separately, within the jurisdiction of this Hon’ble Court.

6.The Petitioners also humbly submit that in view of the facts and circumstances
of the case narrated supra, there is no impediment for dissolving the marriage
between the Petitioners by granting a Decree for divorce by mutual consent.

7. It is also humbly submitted that the petitioners have signed this Joint Petition
for divorce, out of their free will and consent and there is absolutely no sort of
collusion between them in this regard. In other words, there has been physical
contiguity and mental cognition on the part of both the Petitioners in presenting
this petition.

8. The address of the Petitioners is as stated in the cause title for service of notice
that may emanate from this Hon’ble Court and the Petitioner No.1 is represented
by Counsel Miss Anjali, Advocate No.7, 2 nd Main, Jayanagar 2nd Block, Bangalore
– 560 004 and Petitioner No.2 is represented by Counsel – M/s Priya Associates,
Advocates, No.4, 2nd Block, Jayanagar, Bangalore-560 069.

VALUATION
The subject matter of the petition is valued for the purpose of court fee and
jurisdiction as per Sl.No.1 of Schedule-II of the Karnataka Court Fees and Suits
Valuation Act and a fixed court fee of Rs. 100 /- is paid on this petition.

PRAYER
WHEREFORE the Petitioners pray that this Hon’ble Court may be pleased
to grant Judgment and Decree dissolving the Marriage between the petitioners
which had been solemnized as per Hindu Rites and Customs on 27-10-2017, at
Bangalore City and also to grant such other reliefs, as this Hon’ble Court deems fit
to grant in the circumstances of the case, to meet the ends of justice.

1. We are the Petitioners in the above case and we know and we have made
ourselves acquainted with the facts and circumstances of this case.
2. The statements made at Paras 1 to 8 above are prepared to our instructions
and they are true to the best of our knowledge, belief and information.
