e BOARD OF a INVESTMENTS PHILIPPIN MEMORANDUM CIRCULAR NO. 2022-002 Series of 2022 To : ALL BOI CLIENTS AND ALL OTHERS CONCERNED SUBJECT : AREAS THAT ARE CONTIGUOUS AND ADJACENT TO THE NATIONAL CAPITAL REGION WHEREAS, R.A. 11534 (CREATE Act) was signed by the President on 26 March 2021 which took effect on 11 April 2021 and its Implementing Rules and Regulations (IRR) was published on 26 June 2021; WHEREAS, Section 296 of the CREATE Act, provides that the period of availment of incentives will be based on the location of the registered project and industry priorities as determined in the Strategic investment Priority Plan (SIPP). The location of the registered project shall be prioritized according to the level of development as follows: 1) National Capital Region (NCR); 2) metropolitan areas or areas contiguous and adjacent to NCR; and 3) all other areas. The metropolitan areas shall be determined by the National Economic Development Authority (NEDA); WHEREAS, Rule 3, Section 9 of the IRR of the CREATE Act, provides that the locational prioritization shall be subject for review and revision every three (3) years in accordance with the SIPP, or in exceptional circumstances, to attract substantial investment to respond to a situation or crisis or to target specific industries during national emergency, state of calamity, public health emergency, or other crisis of analogous circumstances; WHEREAS, Rule 4, Section 8 of the IRR of the CREATE Act, provides that subject to publication requirements and the criteria for investment priority determination, the BO! may at any time, include additional areas in the SIPP, after any of the terms of the declaration of an investment area, and temporarily suspend projects or activities therein if it considers that such project or activity is no longer a priority within the effectivity of the SIPP; WHEREAS, Rule 4, Section 9 of the IRR of the CREATE Act, provides upon approval of the plan, in whole or in part, or upon approval of an amendment thereof, the plan or the amendment, specifying and declaring the preferred areas of investments shall be published in at least one (1) newspaper of general circulation or the Official Gazette: provided, that all such areas in the existing SIPP shall be open for application until publication of an amendment or deletion thereof; WHEREAS, the BO! is mandated to promote and generate foreign and local investments, and develop globally competitive industries. As such, the Agency pursues robust industrial policy to further enable major industries and stimulate productivity and job creation; WHEREAS, the Board in its meeting on 25 March 2022, approved the use of the overall score of the Cities and Municipalities Competitive Index (CMCI) and the mean as filter to determine that areas that are adjacent and contiguous to NCR taking into consideration overall economic development and competitiveness of the areas; WHEREAS, it was also approved the inclusion of cities and municipalities that are equidistant to those that share borders with NCR and the other cities and municipalities in Laguna as proposed by the PIPP-SIPP Technical Working Group; Industry & Investments Building, 385 Sen, GilJ, Puyat Avenue, Makati City Philippines 1209 Trunkline: (+632) & 897.6682 + E-mail: philippines.business@bol.gov.ph « Website: http://www.bolgov.ph Social Media Accounts: BOIPhilippines @sWHEREAS, it was further approved that the list be reviewed as may be deemed necessary and as determined by the Board; NOW THEREFORE, in order to effectively carry out the intent and purpose of R.A. 11534, the Board in its meeting on 25 March 2022 and by virtue of Board Resolution No. 08-03, Series of 2022, respectively, with a quorum duly present, approved the list of cities and municipalities as the areas that are contiguous and adjacent to NCR, based on the overall score of the cities. and municipalities on the CMCI with the expanded coverage of Laguna, as follows: Bulacan Cavite Laguna Rizal Meycauyan City Bacoor Binan ‘Antipolo San Jose Del Monte City | Dasmarinas Cabuyao Cainta Imus Calamba Taytay San Pedro Santa Rosa This Circular shall take effect immediately upon publication in a newspaper of general circulation and three (3) copies thereof shall be filed with the Office of the National Administrative Registrar (ONAR), University of the Philippines (UP) Law Center, Diliman, Quezon City pursuant to Presidential Memorandum Circular No. 11 dated 09 October 1992.
