operational procedure has to be enacted through an Ordinance;

WHEREAS, v a r i o u s c o n s u l t a t i o n s b o t h w i t h t h e d r i v e r s a n d o p e r a t o r s a n d t h e r i d i n g p u b l i c h a d been
conducted;

AN ORDINANCE REGULATING THE OPERATION OF MOTORIZED TRICYCLES FOR

HIRE AND GRANTING OF FRANCHISE FOR THE OPERATION THEREOF WITHIN THE
TERRITORIAL JURISDICTION OF THE MUNICIPALITY OF SAN JOSE AND PROVIDING
PENALTIES THEREFOR, AMENDING FOR THE PURPOSE ORDINANCE NO. 016-2008

Article 1 - Title of the Ordinance

Article 2 - Statement of Objectives

This Ordinance has the following objectives:

^ " 1 . T o c r e a t e a m o n i t o r i n g s y s t e m in t h e grant, u s e , a n d r e v o c a t i o n o f f r a n c h i s e .
2. T o eliminate and prevent proliferation of colorum units.
3. T o g u a r a n t e e t h e actual u s a g e of t h e franchise.
4. T o s a f e g u a r d t h e well-being o f t h e c o m m u t i n g public.
5. T o e a s e traffic c o n g e s t i o n especially w i t h i n t h e t o w n proper.

Article 3 - Definition of Teri

operated to render transport service to the general public for a fee.

Article 4 - Municipal Tricycle Franchising and Regulatory Board (MTFRB)

Section 1. T h e M u n i c i p a l T r i c y c l e F r a n c h i s i n g a n d R e g u l a t o r y B o a r d i s c o m p o s e d o f t h e f o l l o w i n g :

• Municipal Mayor C h a i r m a n , o r a n y o n e designated by h i m

• Municipal Administrator Vice-Chairman
• Chairman, SB Committee on P u b l i c Utilities and Facilities Member
• Municipal Engineer Member
• Municipal Planning and Development Coordinator Member
• Any two (2) designated officials of TODA Members
• Municipal Treasurer Member
• President, Liga ng Mga Barangay Member

• Issue, renew, a m e n d , suspend, and cancel o r revoke franchises and prescribe appropriate terms and
conditions thereof.
• Promulgate, a m e n d , revise, and supplement rules and regulations for the proper implementation of this
O r d i n a n c e w h i c h s h a l l b e in f u l l f o r c e a n d e f f e c t u n t i l r e v o k e d o r m o d i f i e d b y t h e M u n i c i p a l C o u n c i l .
• D e t e r m i n e , fix, a n d a d j u s t f a r e s o r f e e s p r e s c r i b e d i n this O r d i n a n c e after public h e a r i n g a n d u p o n
approval of the Municipal Council.
• R e c o m m e n d c h a n g e s in t h e r o u t e s o f t r i c y c l e f o r h i r e f o r t h e p u r p o s e o f t r a f f i c d e c o n g e s t i o n .
• K e e p all r e c o r d s r e l a t i v e t o t h e i s s u a n c e , r e n e w a l , s u s p e n s i o n a n d c a n c e l l a t i o n o f f r a n c h i s e , a n d a l l
such other d o c u m e n t s a n d i n s t r u m e n t s associated with tricycle operation.
• Perform such other powers and functions as may hereafter be authorized bythe Municipal Council.

Article 5 - Tricycle Operators and Drivers Association

Section 1. T h e T O D A i s a n a s s o c i a t i o n o f t r i c y c l e o p e r a t o r s a n d d r i v e r s i n a s p e c i f i c a r e a i n t h e M u n i c i p a l i t y .
T h e Sangguniang B a y a n shall b e mandated t o accredit a t least o n e T O D A upon accomplishment o f the
necessary requirements. --..^

Section 2. D u t i e s a n d F u n c t i o n s . — \
• R e p r e s e n t its m e m b e r s in m e - B o a x d — — -"""^
• A i d t h e B o a r d in d i s s e m i n a t i n g i n f o r m a t i o n to all o p e r a t o r s a n d drivers.
• Assist t h e B o a r d in t h e m a n a g e m e n t of t h e designated terminals.
• R e p r i m a n d a n d report drivers w h o shall violate the provisions of this Code,

 Section 3. Membership to a \s highly encouraged for easier m a n a l H e n t by the Board. This shall not
however be construed to mean tnat non-membership shall result in any sanction.

Article 6 - Rules of Entry

Section 1. O n l y t h e f o l l o w i n g a r e e l i g i b l e f o r g r a n t o f f r a n c h i s e :
• Filipino citizen.
• R e s i d e n t s o f S a n J o s e f o r a t least 6 m o n t h s prior t o date o f application a s certified by their respective
Punong Barangay.
• A t least 18 years of age.
• A p p l i c a n t s in p o s s e s s i o n o f units w i t h valid registration p a p e r s f r o m t h e L a n d T r a n s p o r t a t i o n Office.

Section 2. A p p l i c a n t s s h a l l s u b m i t t h e f o l l o w i n g :
• Barangay Clearance from barangay of residence.
• Barangay Clearance f r o m t h e barangay which h a s jurisdiction over a r e a o f operation.
• Police Clearance.
• C o m m u n i t y T a x Certificate.
• 2 pes. 2 x 2 ID picture.
• Copy of the O R / C R of the motor vehicle.
• Copy o f Professional Driver's License.^
• Certificate o f R o a d w o r t h i n e s s o f unit f r o m Municipal Engineer
• Other documents that the Board m a y d e e m necessary.

• Application form and personal information sheet to be secured from t h e M T F R B .

Article 7 - Assembly Standard of Sidecar (Clearances)

T o afford c o n v e n i e n c e a n d safety, m i n i m u m sidecar m e a s u r e m e n t s should be a s follows:

• F r o m ground to sidecar flooring - 7 inches
• Interior: f r o m s e a t t o roofline - 32 inches
• Interior: flooring t o t o p o f s e a t - 8 inches
• S i g n a l lights, plate h o l d e r s , a n d o t h e r r e q u i r e d p a r a p h e r n a l i a s h o u l d b e in order.
• Mufflers and/or silencers shall likewise b e installed a n d properly maintained.

V i o l a t i o n s o f t h e a f o r e s a i d r e q u i r e m e n t s s h a l l w a r r a n t d e n i a l o f t h e i s s u a n c e o r r e n e w a l o f f r a n c h i s e . If t h e
s a m e shall b e altered after issuance o r renewal o f franchise, revocation o f t h e s a m e a n d confiscation o f t h e
u n i t w i l l b e e n f o r c e d w i t h a p e n a l t y o f two thousand five hundred pesos (Php2,500.00).

Article 8 - Effectivity and Duration of Franchise.

Article 9 - Grounds for Revocation or Cancellation of Franchise

T h e following shall constitute grounds for revocation or cancellation of franchise:

1. M a k i n g untruthful s t a t e m e n t s in the application f o r m or a n y d o c u m e n t submitted to t h e M T F R B .
2. Operator ceases to be a resident of S a n Jose.
3. Failure to o p e r a t e within 9 0 d a y s f r o m grant of franchise.
4. N o n - u s e of franchise for a period exceeding 3 months.
5. A l t e r a t i o n o f t h e unit.
6. Failure to r e n e w within the t i m e specified.
7. C o m m i s s i o n o f a c r i m e a g a i n s t a p a s s e n g e r .
8. U s i n g t h e unit in a n y criminal or illegal activity.
9. V i o l a t i o n of t h e provisions o f this O r d i n a n c e .
10. N o n - p a y m e n t of regulatory fees.
1 1 . Violation of t e r m s a n d conditions set forth in t h e franchise.

T h e revocation o r cancellation of franchise shall not be a bar to the prosecution of any other action that might
be appropriate according to law.

Article 10 - Renewal of Franchise

Section 1. R e n e w a l o f f r a n c h i s e s h a l l b e m a d e o n o r b e f o r e t h e 2 0 * d a y o f J a n u a r y o f e v e r y y e a r .

Section 2. F a i l u r e t o r e n e w a s m a n d a t e d b y t h e p r e c e d i n g s e c t i o n s h a l l w a r r a n t s u r c h a r g e s o f t h e t o t a l a m o u n t
to be paid a s provided for by t h e Local R e v e n u e C o d e , if any.

Section 3. T h e a p p l i c a t i o n f o r r e n e w a l s h a l l b e a c c o m p a n i e d b y t h e f o l l o w i n g :
• Original and photocopy of the previous franchise.
• Barangay Clearance from barangay of residence.
• Barangay Clearance f r o m the barangay which h a s jurisdiction over a r e a of operation.
• Police Clearance.
• C o m m u n i t y T a x Certificate.
• Certificate o f R o a d w o r t h i n e s s of unit f r o m Municipal Engineer
• Other documents that the M T F R B may d e e m necessary.

Article 11 - Number of Franchise

Section 1. T h e r e s h a l l o n l y b e a m a x i m u m o f 7 0 0 f r a n c h i s e s t o b e i s s u e d . A n y i n c r e a s e i n t h e n u m b e r o f
franchises shall only b e upon the recommendation and approval o f the Board and the Municipal Council,
respectively.

Section 2. T h e r e s h a l l a l s o b e , a s i d e f r o m t h e 7 0 0 f r a n c h i s e s , a d d i t i o n a l f r a n c h i s e s t o b e i s s u e d f o r u n i t s
operating outside the t o w n proper and in different subsidiary routes in the rural a r e a s o f the Municipality a s
m a y be r e c o m m e n d e d by t h e B o a r d a n d subject to approval of t h e Municipal C o u n c i l .

Article 12 - Units per franchise per person

Section 1. T h e r e s h a l l o n l y b e o n e u n i t f o r e v e r y f r a n c h i s e .

Section 2. E a c h a p p l i c a n t s h a l l b e e n t i t l e d t o a g r a n t o f a m a x i m u m o f t w o f r a n c h i s e s o n l y . F o r t h e p u r p o s e o f
this limitation, the applicant's s p o u s e and his o r her unmarried children shall b e considered a s o n e with the
applicant.

Article 13 - Assignment of use of unif;^

Section 1. A n o p e r a t o r c a n a s s i g n t h e u s e o f t h e u n i t t o a n o t h e r p e r s o n p r o v i d e d t h a t s u c h f a c t i s m a d e k n o w n
t o a n d a p p r o v e d by t h e B o a r d u p o n application.

Section 2. T h e o p e r a t o r s h a l l b e s o l i d a r i l y l i a b l e w i t h t h e d r i v e r f o r a n y l i a b i l i t y t h a t ^ m a y incur in t h e
u s e of t h e unit.

Article 14 - Transfer, Replacement and Non-use of Franchise

Section 1. A f r a n c h i s e i s t r a n s f e r a b l e b u t n o t s a l e a b l e . T h e t r a n s f e r s h a l l b e a l l o w e d o n l y a f t e r t h r e e ( 3 )
consecutive years o f ownership by the franchisee. A franchise transfer fee o f P 2 0 0 0 shall b echarged t o the
n e w applicant.

Section 2. A n y p e r s o n w h o t r a n s f e r r e d h i s / h e r f r a n c h i s e s h a l l b e p r o h i b i t e d t o a p p l y f o r a n e w o n e f o r a p e r i o d
of 5 years from date of such sale.

Section 3. C h a n g e o f u n i t i s a l l o w e d . T h e o p e r a t o r s h a l l h o w e v e r p a y P h p 3 0 0 a s f r a n c h i s e s e r v i c e f e e . T h e
applicant for c h a n g e shall also execute a n Affidavit warranting that h e / s h e shall c h a n g e the registration of the
replaced unit f r o m 'for hire' t o 'private,' except in cases w h e r e t h e r e p l a c e m e n t is d u e t o the fact that the
replaced unit h a s b e c o m e u n u s a b l e a s certified by t h e Municipal E n g i n e e r . F a i l u r e to effect t h e c h a n g e m a k e s
the replaced unit a c o l o r u m unit.

Section 4. R e p l a c e m e n t o f f r a n c h i s e d u e t o l o s s o f p l a t e o r o f d o c u m e n t s h a l l b e c h a r g e d P h p 3 5 0 .

Section 5. F a i l u r e t o o p e r a t e w i t h i n 9 0 d a y s a f t e r t h e g r a n t o f t h e f r a n c h i s e s h a l l c a u s e t h e r e v o c a t i o n o r
cancellation o f t h e s a m e except in cases w h e n reason f o r inoperation is that t h e unit h a s become
unserviceable a s certified by t h e Municipal E n g i n e e r .

Section 6. W h e n t h e u s e o f t h e f r a n c h i s e h a s c o m m e n c e d b u t s u b s e q u e n t l y b e c o m e s c o n t i n u o u s l y i n o p e r a t i v e
for a period e x c e e d i n g 9 0 d a y s , t h e f r a n c h i s e m a y be s u s p e n d e d o r r e v o k e d e x c e p t in c a s e s w h e n r e a s o n for
i n o p e r a t i o n is t h a t t h e unit h a s b e c o m e u n s e r v i c e a b l e a s certified by t h e M u n i c i p a l E n g i n e e r .

Section 7. W h e n t h e u n i t h a s b e c o m e u n s e r v i c e a b l e w h i l e t h e f r a n c h i s e i s still e f f e c t i v e , t h e o p e r a t o r s h a l l
e x e c u t e a n affidavit to this effect. T h e B o a r d shall t h e n d e t e r m i n e t h e a m o u n t of t i m e within w h i c h t h e operator
should replace the unit for him/her to retain the franchise.

Article 15 - Identification Card

T h e identification card o f t h e driver/operator i s s u e d by t h e M T F R B shall be displayed i n front of t h e p a s s e n g e r

s e a t for e a s y recognition by t h e c o m m u t i n g public.

Article 16 - Fare Matrix

A f a r e m a t r i x shall b e d i s p l a y e d in f r o n t o f t h e p a s s e n g e r s e a t for t h e i n f o r m a t i o n o f t h e c o m m u t i n g public. T h i

shall be i m m e d i a t e l y effective u p o n t h e d e t e r m i n a t i o n by t h e M T F R B a n d a p p r o v a l of t h e Municipal Council o f
the regular fares to be imposed.

Article 17-Uniform

All drivers shall w e a r a designed uniform for e a s y recognition and identification.

Article 18 - Color Code

' A terminal or a cluster of t e r m i n a l s shall be assigned a unit color a s m a y be n e c e s s a r y to easily identify their
designated route or zone.

Article 19 - Speed Limit

T h e m a x i m u m s p e e d limit s h a l l b e 6 0 k i l o m e t e r s per^tiour o r t h e specified s t r e e t / r o a d / h i g h w a y s p e e d limit,

w h i c h e v e r is lower. \
Article 20 - Plate and Franchisei^Lber

Section 1. T h e c o l o r e d p l a t e s h a l l b e a r t h e f r a n c h i s e n u m b e r w h i c h s h a l l s t a r t f r o m 0 0 1 t o 7 0 0 . T h e s a m e
shall be placed in t h e t o p c e n t e r o f t h e sidecar o f t h e unit for e a s y identification.

Section 2. T h e p l a t e s h a l l b e s u r r e n d e r e d t o t h e M T F R B i f f r a n c h i s e i s c a n c e l l e d o r r e v o k e d , o r i f t h e o p e r a t o r
voluntarily desists f r o m o p e r a t i n g t h e unit. F a i l u r e t o s u r r e n d e r t h e plate w i t h i n 1 0 d a y s f r o m o c c u r r e n c e o f
such circumstance shall be penalized with a fine o f P h p 1 , 5 0 0 .

Section 3. T h e p l a t e s h a l l r e m a i n t h e p r o p e r t y o f t h e M u n i c i p a l i t y a n d c a n n o t b e t h e o b j e c t o f a s a l e . A n y
person w h o is found t o h a v e sold the plate shall b e penalized with a fine o f P h p 2 , 0 0 0 o r imprisonment for a
period of 6 m o n t h s , or both, at the discretion of the court.

Article 21 - Number Code and Ban Sticker

Section 1. A n u m b e r c o d e s h a l l b e u t i l i z e d b y d i v i d i n g t h e l a s t f r a n c h i s e n u m b e r t o 5 , t h e l a t t e r r e p r e s e n t i n g
t h e 5 w e e k d a y s o f t h e w e e k . S o that, t h e first one-fifth shall b e prohibited t o o p e r a t e o n M o n d a y s , t h e s e c o n d
one-fifth shall be prohibited to operate o n T u e s d a y s , and s o o n and s o forth.

Section 2. T h e r e s h a l l a l s o b e a s t i c k e r o n w h i c h a d a y o f t h e w e e k i s p r i n t e d w h i c h s h a l l i n d i c a t e w h i c h d a y o f
t h e w e e k t h e unit is n o t a l l o w e d t o o p e r a t e . T h e sticker shall be placed in t h e c e n t e r o f t h e b o d y o f t h e sidecar.

Article 22 - Recognized Terminals

Aside f r o m the Central Parking Station t o b e determined later o n , only the following terminals within the t o w n
proper are recognized:
• T a y s a n Public Market
• Masajo St.
• Juez R o m a n Kalalo St.
• Custodio St.
• Poblacion 3.0 (near the former police station)
• Poblacion 3.0 (opposite R C B C )
• Bus Stop
• S a n J o s e District H o s p i t a l
• Esquivel residence (forSalaban - Dagatan Route)*
• Poblacion 1 (near Barangay Hall/PLDT)
* C r e a t i o n o f t e r m i n a l s o u t s i d e t h e t o w n p r o p e r i s n o t p r o h i b i t e d , a s l o n g a s it d o e s n o t i n t e r f e r e w i t h t h e
units operating within the t o w n proper.

Article 23 - Operating Conditions

Section 1. N o u n i t s h a l l b e o p e r a t e d i n v i o l a t i o n o f n a t i o n a l l a w s .

Section 2. W i t h i n 9 0 d a y s u p o n i s s u a n c e o f t h e f r a n c h i s e , t h e u n i t m u s t b e r e c l a s s i f i e d f r o m ' p r i v a t e ' t o ' f o r

hire'.

Section 3. F r a n c h i s e s h a l l b e v a l i d u p o n i s s u a n c e u n t i l t h e 2 0 * d a y o f J a n u a r y o f t h e f o l l o w i n g y e a r a n d s h a l l
be renewed annually thereafter.

Section 4. A l t e r a t i o n a n d m o d i f i c a t i o n o f t h e u n i t i s n o t a l l o w e d u n l e s s c e r t i f i e d b y t h e M u n i c i p a l E n g i n e e r a s
reasonable or necessary.

Section 5. W h e n a f r a n c h i s e i s cancelled o r r e v o k e d , t h e a w a r d o f t h e available franchise shall b e prioritized

as follows:
• T h o s e without existing franchise
• T h o s e with only one franchise
In c a s e t h e r e a r e s e v e r a l applicants falling u n d e r o n e category, t h e first c o m e first s e r v e d rule shall apply.

Section 6. D r i v e r s a r e r e q u i r e d t o d i s p l a y t h e i r p l a t e a n d - f ^ n ^ f e e n u m b e r a n d i d e n t i f i c a t i o n c a r d f o r e a s i e r

Article 24 - Grievance and IVlonitoring Council

T h e r e shall be created a G r i e v a n c e and Monitoring Council w h i c h shall be c o m p o s e d of the Municipal Mayor,

C h a i r m a n of t h e C o m m i t t e e o n Public Utilities a n d Facilities, C h a i r m a n o f t h e C o m m i t t e e o n P e a c e a n d Order,
any one m e m b e r of the Municipal Council, the President of Tricycle Operators and Drivers Association which
shall h e a r a n d decide c a s e s relative to c o m p l a i n t s brought by t h e riding public o r a n y aggrieved party a g a i n s t
a n operator or driver.

Article 25 - Prohibited Acts, Fines and Penalties

Article. 26-Appeal

appealable to the Board of A p p e a l s within 15 d a y s f r o m receipt of copy of t h e decision of the M T F R B .

Article 27 - Penal Provisions

Violation of the provisions of this Ordinance shall cause cancellation and or revocation isting franchise
without prejudice to imposition of fines.

Article 28 - Transitory Provisiuns

Section 1. A l l r u l e s a n d r e g u l a t i o n s n o t c o n t r a r y t o t h i s O r d i n a n c e s h a l l r e m a i n i n f u l l f o r c e a n d e f f e c t .

Section 2. P r o v i s i o n s o f t h i s O r d i n a n c e s h a l l b e s u b j e c t t o a p p r o p r i a t e I m p l e m e n t i n g R u l e s a n d R e g u l a t i o n s a s
m a y be d e e m e d n e c e s s a r y by t h e B o a r d .

Article 29 - Special Provision

T h e Buklod n g P a g k a k a i s a Tricycle Drivers a n d O p e r a t o r s A s s o c i a t i o n will b e a c c o m m o d a t e d with t w o (2)

m e m b e r s h i p s in t h e B o a r d a n d shall c o n t i n u e to be m e m b e r s until s u c h t i m e t h a t o t h e r a s s o c i a t i o n s h a d b e e n
a c c r e d i t e d , in w h i c h c a s e , all a s s o c i a t i o n s s h a l l f e d e r a t e a n d e l e c t t h e r e g u l a r r e p r e s e n t a t i v e s i n t h e B o a r d .

Article 30 - Separability Clause

If f o r a n y r e a s o n , a n y p r o v i s i o n , s e c t i o n , o r p a r t o f t h i s O r d i n a n c e i s d e c l a r e d i n v a l i d b y a c o m p e t e n t b o d y o r a
court o f c o m p e t e n t jurisdiction, such declaration shall not impair the validity o f the remaining provisions,
sections, or parts of this Ordinance.

Article 31 - Repealing Clause

All ordinances, orders, rules a n d regulations contrary to or inconsistent with the provisions of this Ordinance
are hereby repealed, a m e n d e d or modified accordingly.

Article 32 - Effectivity Clause

T h i s Ordinance shall take effect 15 days after publication.
