COUNTER-AFFIDAVIT

I, ANGELICAA MADRIÑA, of legal age, married, residing at Sitio Mahayahay,

Barangay Cansojong, Talisay City, Cebu, Philippines, after having been duly sworn to in
accordance with law, hereby depose and state;

1. That I am the wife of ROGIE DONAN MADRIÑA, the respondent for

criminal case for Violation of RA 7610 lodged by private complainant CHAE
REM MACARAYA, now pending before the provincial prosecutor’s office,
Cebu City with docket number VII-15-INV-18E-00205;
2. That the accusations of private complainant are all lies. The truth is this:
a. On March 30, 2018, at about 10:00 in the morning, I was washing
dishes outside our house, while at the same time watching my four (4)
year old son, RONGIE MADRIÑA playing in our yard. My son was
seated in a pedicab parked near our house when private complainant
CHEA REM approached him;
b. Upon seeing CHEA REM, I immediately approached the child to tell
her to go home because she always hit and hurt my son in the past;
c. However, the child stayed and refused to leave, so I just went back to
my chore but then I suddenly saw CHEA REM kicking my son on his
face causing him to fall off from the pedicab;
d. When I saw what happened, I immediately ran to my son who fall into
the ground. Then I wiped off the dirt from my son’s face which was
from the slipper of CHEA REM;
e. CHEA REM on the other hand ran towards their house;
f. After cleaning the dirt off from my son’s face, I carry him and we
went to the house of CHEA REM to talk to her guardians and tell them
of what their child did to my son;
g. This was not the first time that I went to their house because there
were incidents in the past that CHEA REM would physically hurt my
son by hitting him on the head or slapping him on his face or hit him in
the different parts of his body and I always tried to talk with the
guardian/s regarding those incidents;
h. Despite of those incidents, We (I and my husband) chose to forgive
CHEA REM because she was just a child and we deemed that it was
normal for kids to quarrel sometimes;
i. However, when my son was thrown off from a pedicab, I was thinking
it was not just a petty children’s quarrel and that the guardians of
CHEA REM should be made aware of the actions of the child so as to
reprimand her and teach her the proper values;
j. But Arlinda Macaraya, CHEA REM’s guardian ignored me and did
not care;
k. Then I went home and when my husband got home from working at
our neighbor’s I told him of the incident and he immediately went to
see the guardians of CHEA REM as well;
3. That it is not true that I threatened to kill CHEA REM nor to hurt her in anyway;
4. Further the psychological report did not state that the perceived behavior of the
child was in any way affected by the alleged incident.
