COUNTER-AFFIDAVIT

I, NIDA COMISION, Filipino, of legal age, with residence at Sitio Sangi, Brgy.
Calajoan, Minglanilla, Cebu, Philippines, after having been duly sworn to in
accordance to law hereby depose and states THAT:

1. That I am the respondent in this criminal case for Violation of RA 7610

lodged by private complainant Thea Grace C. Salvador now pending
before the City Prosecutor’s Office, Talisay City, Cebu;

2. That the accusations of private complainants are all lies. The truth is
this:

a. I and _______ were siblings and had been neighbors since the
time we got married to our respective spouses;

b. Since our father’s death, I do not have a good relationship with

my brother and his family. We always quarrel even with petty
things;

c. On December 20, 2015 at around 7:30 o’clock in the evening,

more or less I was the store of my neighbor buying a drink
when I saw private complainant;

d. When I saw her I made a joke if I can kiss her cheeks, but she
declined. I even told that it was just a joke; Then I laughed,
and then she walked away;
e. I did not mind what I said because I intended it as joke;

f. The allegations of private complainant that I kissed her lips is a

huge lie as I did not in any way kiss her; If ever I said
something about kissing it was meant as a joke;

g. Besides there were many people at the store at that time, and
nobody executed an affidavit in her favor that indeed I kissed
her;

h. Further NO psychological report is attached to the

criminal complaint showing how my alleged actions
became prejudicial to the child’s development;
3. That I am executing this counter-affidavit in order to attest to the
foregoing facts alleged above and to bolster my innocence;
