Shaffer 2454 43% STNE McCANNA, ND 58251 Election Integrity Act Initiative The intent of this initiative is toamend the North Dakota Constitution to provide election integrity by providing a method of verifying election results and providing a reasonable process for recalling elected officials. IF MATERIAL IS NOT UNDERSCORED OR OVERSTRUCK, THE MATERIAL IS EXISTING LAW THAT IS NOT BEING CHANGED. BE IT ENACTED BY THE PEOPLE OF THE STATE OF NORTH DAKOTA: North Dakota Constitution Article II, Entitled Elective Franchise is amended and reenacted as follows: Section 4. The intent of this section is to ensure the peoples’ right to free and fair elections and provide election integrity by providing verification of the election process and election results. 1. __An Election is not a legally binding election if the election process and the election results cannot be verified by qualified electors of the state. 2, __“Auditable voting system" means a voting system that: uses, creates, or displays a paper record that can be read by the voter and that is deposited by the voter into a secure ballot box; b. is not capable of being connected to the Internet, cellular network, or any other computer network or electronic device; and ¢. is not capable of being manipulated bv software, 3.___In this section "ballot box" means all secured ballot boxes used for the deposit of voters” marked ballots ata polling place, whether one or multiple physical ballot boxes are used 4,__ Since voting integrity is essential for a free state, all voting in North Dakota elections shall be done by paper ballots and counted by hand on the day of the election, 5.__Candidates having the highest number of votes in the first round of voting must be declared elected. All ballot measures and recalls receiving more yes votes than no votes in the first round of voting will be declared passed. Ranked-Choice voting is prohibited in the State of North Dakota. 6.__ The people of the State of North Dakota shall be guaranteed free and fair elections with auditable results, All elections shall be verified at any time by any qualified elector(s) of the state or citizen(s) of the United States who requests to do so. No citizen will be denied access to election information resulting from an auditable election with the exception that the identity of individual voters shall not be revealed on ballots that have been cast. This provision is in effect retroactively to statehood, ‘The Office of the Secretary of State shall adopt rules providing auditable voting systems for the tabulation, recording, preservation and scanning of all ballots cast in an election. These rules must be followed at all times: Allelections will be administered by a duly elected county auditor; All county precincts must have an open polling location(s); All county precincts shall have paper poll book specific to that precinct; All ballots shall have watermarks and bear the seal of the county in which it will be used: Acceptance of third-party non-govemment election-related funding by the state, counties, recincts, or any political subdivision is prohibited: f, Any political party can place their nominated candidates for state-wide or any other political subdivisions’ offices in any election by paying the North Dakota Secretary of State a registration fee of $150; g. Requiring a political party to gather signatures on a petition to qualify its candidates to be on am ballot is prohibited; h. Anelected official of a political subdivision, including a township officer, is subject to recall pursuant to section 10 of Article III of the Constitution of North Dakota; For the recall of an elected official pursuant to Article III of the Constitution of North Dakota, including a township officer, of a political subdivision or an audit of that political subdivision, circulators have one year to gather the required number of signatures of qualified electors on the recall or audit petition from the date the secretary of state or auditor approves the respective petition for circulation; i. A petition to initiate or refer a measure under Article III of the Constitution of North Dakota, circulators have three years to gather the required number of signatures of qualified electors on the initiative or referral petition from the date the secretary of state approves the petition for circulatior k. Proposed amendments to the Constitution of North Dakota shall be placed on a state-wide ballot only through an initiated measure pursuant to Article III Section 9 of the North Dakota Constitution. The North Dakota Legislature is prohibited from putting proposed constitutional amendments on the ballot directly without circulating a petition for an initiated measure and ‘obtaining the required number of signatures on such petition for an initiated measure; 1. A recall petition, of a petition to initiate, or a petition to refer a measure, or any other petition may not be circulated under the authority of Article III of the Constitution of North Dakota or by the authority of this section by an individual who is less than eighteen years of age: m. All petitions, including petitions for an audit or petitions authorized by a home rule charter, shall be circulated by U.S. Citizens or sovereign individuals. Such circulators are not required to be residents of North Dakota nor shall circulators be required to be residents of a particular political subdivision in North Dakota; Circulators of petitions maybe paid by the signature, by the hours, or by any other method of consideration: ©. Circulators of any type of petition, may circulate petitions for signatures on all public property without restrictions of any type; p. Circulators and sponsoring committees of any type of petition, measure, referendum, of recall will have no criminal and no civil liability for the act of being a circulator or sponsoring committee member, Online petitions are prohibited. All petitions must be paper petitions; ere 4 aa. bb. ce. dd, ee. BB. hh, ii, ii. Alll qualified electors must present proof they are a qualified elector by presenting one of the following: a photo ID, a North Dakota issued ID, the last four digits of their social security number, a U.S. passport, or an Affidavit of Truth as to their identify before voting in any election; Ballot boxes shall be monitored and secured at all times. Alll aspects of the auditable voting system shall be protected from tampering at all times. Public drop boxes for ballot collection are prohibited; 1f.a preponderance of evidence exists that indicates tampering was possible or likely in an election, a special election will be conducted within 60 days to replace the defective election and remedy the alleged tampering Absentee ballots will only be mailed to voters who request one in writing within a reasonable time period prior to Election Day. Mail-in ballots are otherwise prohibited; Absentee ballots are not exempt from the requirements of this section; Absentee ballots shall be retumed by being placed in the U.S. mail or retumed in person to the office of an election official; Someone chosen by a qualified elector to retumn their Absentee ballot may not retum more than two Absentee ballots in the same election; All absentee ballots must be received by the day before Election Day by 8 PM: Allabsentec ballots shall be counted and the official count of absentee ballots announced to the ‘public prior to any other ballots being counted; Election Day voting must end at 8 PM; Early voting is prohibited. With the exception of Absentee Ballots, all votes will be cast on Election Day; All qualified electors have the right to observe all aspects of the election process and the auditable Voting system. If a qualified elector is prohibited from observing any aspect of the election process or the auditable voting system, a special election will be conducted within 60 days to replace the defective election and allow the requested observation (s); An image of cach paper ballot cast in an election is to be scanned electronically including rejected and corrected ballots: Each ballot cast in an election is to be preserved pursuant to applicable federal law after the ballot is scanned; Electronic versions of the scanned ballots from all elections must be made immediately available for download on the Office of the Secretary of State's website for no less than 6 years: ‘A paper copy of scanned ballots from any election is to be made available to any individual upon ‘equest and payment of a nominal fee to be set by the Office of the Auditor; The results of an clection or the qualifications of a candidate to be on the ballot can be challenged at any time: Any qualified elector, upon providing a preponderance of evidence of voter fraud or election fraud, may submit a written request to the North Dakota Auditor to perform a full forensic audit on any election results, The Auditor, upon receiving such a written request and evidence, must perform the requested audit and the audit must begin within 14-days of receiving the petition: The requirements of this section shall not be suspended for any reason: and 8. Penalty. If any person violates the requirements of this Section, they will be fined a minimum of {$1,000 and a maximum of $10,000 and shall have personal civi iability to those whose rights under this Section have been violated, 9. This section is self-executing, North Dakota Constitution Section 3, 5 and 10 of Article III, POWERS RESERVED TO THE PEOPLE is amended and reenacted as follows: Section 3. The-petition-shall-be-ciroulated-only-by electors. Circulators of petitions shall swear thereon that the electors who have signed the petition did so in their presence. Each elector signing a petition shall also write in the date of signing and his post-office address. No law shall be enacted limiting the number of copies of a petition. The copies shall become part of the original petition when filed, Section 5. The legislature is prohibited from placing a measure to amend the state constitution on a state wide ballot An initiative petition shall be submitted only by citizens of North Dakota not less than one hundred twenty days before the statewide election at which the measure is to be voted upon. A referendum petition may be submitted only within ainety one hundred eighty days after the filing of the measure with the secretary of state. The submission of a petition shall suspend the operation of any measure enacted by the legislative assembly except emergency measures and appropriation measures for the support and ‘maintenance of state departments and institutions. The submission of a petition against one or more items or parts of any measure shall not prevent the remainder from going into effect. A referred measure may be voted upon at a statewide election or at a special election called by the governor. Section 10. Any elected official of the state, of any county or of any legislative or county commissioner district shall be subject to recall by petition of electors equal in number to twenty-five ten percent of those who voted at the preceding general election for the office of govemor in the state, county, or district in which the official is to be recalled. The petition shall be filed with the official with whom a petition for nomination to the office in question is filed, who shall call a special election if he finds the petition valid and sufficient, No elector may remove his name from a recall petition. The name of the official to be recalled shall be placed on the ballot unless he resigns within ten days after the filing of the petition, Other candidates for the office may be nominated in a manner provided by law. When the election results have been officially declared, the candidate receiving the highest number of votes shall be deemed elected for the remainder of the term, No official shall be subject twice to recall during the term for which he was elected. North Dakota Constitution Section 16 of Article IV, LEGISLATIVE BRANCH is amended and reenacted as follows: INSTRUCTIONS TO PETITION SIGNERS: You are being asked to sign a petition. You must be a qualified elector. This means you are eighteen years old, you have lived in North Dakota thirty days, and you are a United States citizen, All signers shall also legibly print their name, complete residential address or rural route or general delivery address, and the date of signing on the petition, Every qualified elector signing a petition must do so in the presence of the individual circulating the petition. 6
